Case Study: Beauty Clothing Sdn. Bhd is a company which living under 600 workers.The distribution of the workers is as started below If a company had more than 40 workers they had to manage their own policy at their workplace that must been confirmed by Department of Safety and Health (DOSH) Headquarters Office Branch Office A Branch Office B 250 workers 200 workers 150 workers

We did use the: Act 514 Section:30(1) Establishment of Safety and Health committe at place of work in accordance with this section if : a. There are 40 or more persons employed at the place of work ; or b.Every employer shall consult the safety and health committe c. A person who contravenes the provisions of this section shall be guilty of an offence and shall,on conviction,be liable to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding six months or to both.

d.Those employee had a responbility to follow on this act. 3.This company produces kids apparel to be exported and it has been in operation since 1990. The activities cover from cutting,sewing and writing 70% of the workers are female aged in range of 16-50 years old,however due to high demand,the company hire contract workers aged of 12-25 Act 1955 Part Viii

34. Prohibition of night work (1) Except in accordance with regulations made under this Act or any exemption granted under the proviso to this subsection no employer shall require any female employee to work in any industrial or agricultural undertaking between the hours often o'clock in the evening and five o'clock in the

morning nor commence work for the day without having had a period of eleven consecutive hours free from such work: Provided that the Director General may, on application made to him in any particular case, exempt in writing any female employee or class of female employees from any restriction in this subsection, subject to any conditions he may impose. (2) Any person -

(a) who is affected by any decision made or condition imposed under the proviso to subsection (1); and (b) who is dissatisfied with such decision or condition,

may within thirty days of such decision or condition being communicated to him appeal in writing therefrom to the Minister. (3) In deciding any appeal made to him under subsection (2), the Minister may make such decision or order thereon, including the alteration or removal of any condition imposed or the imposition of any further condition, as appears just and such decision or order shall be final. 35. Prohibition of underground work No female employee shall be employed in any underground working. 36. Prohibition of employment by Minister Not with standing the provisions of this Part the Minister may by order prohibit or permit the employment of female employees in such circumstances or under such conditions as may be described in such order. 3.(1) In this act,unless the context otherwise requires : contract of service means any aggrement wether oral or in writing,where a person agrees to employ another as an employee to a company with a period of certain time that been signed on the contract. 1.Electrical steam boiler 2.Electrical steam 3.Air compressor 4.Manual & electrical sewing machines 5.Cloth cutting machines 6.Knitting machines 7.Lifting machines Factories and Machinery (steam boiler unfired pressure vessel) Regulations,1970 Application of this act is to Part 1 GENERAL CONDITION : shall apply to every steam boiler and every unfired pressure vessel to which an autorished safe working pressure has not been assigned by the Chief inspector at the date of the coming into force. There of the steam boiler or unfired pressure vessel to which an authorised safe working pressure had been assigned at the date at the date coming into force of this regulations.
