1 Introduction
Starting and Ending a Westlaw Session
Complete these steps to sign on to Westlaw: 1. Go to www.westlaw.com. The Westlaw sign-on page is displayed. Type your OnePass username and password and a client identifier in the text boxes. 2. If desired, choose the following options: Select the Remember Username and Password check box if you want your OnePass username and password automatically entered each time you sign on to Westlaw. Select the Return to last research trail check box to use the research trail from your previous Westlaw session. The trail is displayed after you sign on. 3. Click Sign On. A tabbed page or your last research trail is displayed.
ENDING A WESTLAW SESSION

To sign off from Westlaw, click Sign Off at the top of any page. The time spent on Westlaw and the number of transactions are displayed.

Adding Tabbed Pages


When you sign on to Westlaw, youll see tabbed pages at the top of the page. You can select additional tabbed pages to suit your specific needs. The Paralegal page is designed to allow you to quickly and easily access the features and databases you use most often. Your state page provides easy access to your states case law, statutes, forms, and other materials. Tabbed pages are also available for general areas, e.g., the Public Records page. jurisdictions, including all 50 states and the federal circuits. Your state page includes your states statutes, cases, regulations, forms, and corporate records. topical areas, e.g., the Litigation page and the Intellectual Property page.

Introduction

ADDING THE TABBED PARALEGAL PAGE AND YOUR STATE PAGE

To add the Paralegal page and your state page, follow these steps: 1. Click Add a Tab at the top of any page. At the next page, click Add Westlaw Tabs to display a list of available tabbed pages (Figure 1-1). (To preview a page, click the page name.) 2. Select the Paralegal check box under General and the check box for your state under JurisdictionalState, then click Add to My Tab Set. 3. A list of the pages youve selected is displayed under In Tab Display. One page is designated as your default page (the page that is displayed when you sign on to Westlaw). To select a different page as your default, click Set as Default next to the page. To delete a page from the list, select the check box next to the name of the page and click Remove. 4. To display a tabbed page, click its tab.

USING THE PARALEGAL PAGE

The Paralegal page provides access to shortcuts, such as the Find service and KeyCite, in the left frame and links to state and federal cases and statutes, court documents, public records, and forms databases in easy-to-browse categories in the right frame (Figure 1-2). Click a database name to display a Search page for that database.
Personalizing the Paralegal Page

You can personalize the Paralegal page (and most other tabbed pages on Westlaw) to increase your Westlaw efficiency by editing the options displayed in each section. For example, you can customize content and display options by clicking Show next to Content and Display Options at the top of page. You can customize database groups in the right frame in a variety of ways, including moving entire database groups as well as individual databases within groups. Retrieving a Document by Citation
You can quickly retrieve a specific document when you know its citation by using the Find service at the Paralegal page or your state page. Type the citation in the Find by citation text box in the left frame and click Go. To print the document immediately after it is retrieved, select the and Print check box, if available, before you click Go. You can also click Find&Print at the top of the page to display the Find a Document page. Then type your citation in the Find this document by citation text box in the left frame and click Go. In most cases, your document will be retrieved regardless of capitalization, spacing, or use of periods. For example, you will retrieve the same U.S. Supreme Court opinion with the Find service whether you type 121 sct 1322, 121 SCT 1322, 121 s.c.t. 1322, or 121sct1322. Retrieving a Document Using a Find Template


You can use Find templates to assist you in retrieving federal and state statutes, regulations, and court rules. If you are unsure of the correct citation format, type the publication abbreviation, e.g., ca st for California statutes, in the Find by citation text box and click Go. A fill-in-the-blank template is displayed. To display a Find template for the USCA the CFR federal rules state statutes* state administrative codes* state session laws* state court rules*

Retrieving a Case by Party Name


To retrieve a case when you know one or more parties names, complete these steps: 1. Click Find a Case by Party Name in the left frame of the Paralegal page. 2. Type one or both parties names in the text boxes in the right frame. 3. Select the jurisdiction in which the case was heard or the reporter in which it was published and click Go. Note You can also click a link for a case law database under Federal Cases or State Cases in the right frame of the Paralegal page, e.g., All State Cases, and then click Search by Party Name at the Search page. Type one or both parties names in the text boxes and click Search Westlaw.

Using the Table of Contents Service to Retrieve a Document


The Table of Contents service allows you to browse the table of contents for a publication, view a document in the context of the sections surrounding it, and quickly retrieve related sections. It is available for state and federal statutes and regulations, court rules, most forms databases, and many treatises and practice guides. Browse a table of contents by clicking the plus (+) and minus () symbols. To retrieve a specific section, click its link. There are several ways to access the Table of Contents service: At the Paralegal page or your state page, click Table of Contents next to a database name in the right frame (Figure 2-1). At a database Search page, click Table of Contents, if available, at the top of the page. While viewing a document, click Table of Contents, if available, on the Links tab in the left frame.

3 Printing Documents
Printing the Document You Are Viewing
When you access Westlaw using Internet Explorer 5.5 or later, you can print a retrieved document or result list on an attached printer in HTML with just two clicks of your mouse. Click the Quick Print icon in the upper-right corner of the document or result list. When the Windows Print dialog box is displayed, click Print or Send Request, depending on your browser, to send the document to your attached printer and return to your Westlaw result.

Printing or Delivering Other Documents in Your Result


To print or deliver other documents on Westlaw, complete these steps: 1. Click the Print and Email, Print, Email, or Download icon in the upper-right corner of a retrieved document or result list. A dialog box is displayed that allows you to choose print or delivery options (Figure 3-1). 2. Specify whether you want to print or deliver all documents, the current document, selected documents, or the result list. If you select Current Document, you can also specify whether you want to include KeyCite history or citing references. 3. In the Page Options section, specify the pages you want to print or deliver, e.g., full text of documents. To print or deliver statutes without annotations, select Statutory Text Only. 4. Click Settings at the top of the dialog box to specify whether you want to include features such as KeyCite flags and highlighted search terms. Click Done when you finish making your selections. 5. Click Print/Send, Print, Send, or Save depending on the delivery method you selected.

Retrieving and Printing Multiple Documents


To retrieve multiple documents by citation, use Find. You can print the documents, send them to an e-mail address or fax machine, or download them. You can also choose to retrieve KeyCite information for the documents. To retrieve multiple documents using Find, complete these steps: 1. Click Find&Print at the top of any page. At the Find a Document page (Figure 3-2), type your citations, separated with semicolons, in the Enter Citation(s) text box in the right frame. You also can copy a list of citations from a legal document and paste it in the text box. 2. Under Select Result Options, select the KeyCite History or KeyCite Citing References check box to include KeyCite history or citing references in the result. To print the documents exactly as they appear in the West reporters using Adobe Acrobat Reader, select the Substitute with Reporter Images when available check box. 3. Under Select Delivery Options, select your delivery destination, e.g., Attached Printer or Email. If you select Attached Printer, Download, or Email, choose a document format from the corresponding drop-down list. 4. Click Send Request.

4 Checking Citations in KeyCite


KeyCite information is available for every case in Wests National Reporter System; more than 1 million unpublished cases; federal statutes and regulations; statutes and regulations from all 50 states; administrative decisions from selected federal agencies and selected states; patents issued by the U.S. Patent and Trademark Office; ALR annotations; and articles from hundreds of law reviews. Click KeyCite at the top of any page to get a detailed explanation of the KeyCite status flags.

Accessing KeyCite
There are several ways to access information in KeyCite. At a tabbed page, type a citation in the KeyCite this citation text box in the left frame and click Go. Click KeyCite at the top of any page to display the KeyCite page. Then type a citation in the KeyCite this citation text box and click Go. KEYCITE STATUS FLAGS FOR CASES

A KeyCite status flag (a red or yellow flag, a blue H, or a green C) indicates that KeyCite information is available for the case. A red flag warns that the case is no longer good law for at least one of the points of law it contains. A yellow flag warns that the case has some negative history but has not been reversed or overruled. A blue H indicates that the case has some history. A green C indicates that the case has citing references but no direct history or negative citing references.

KEYCITE HISTORY OF A CASE

To view the history of a displayed case, click Full History on the Links tab (Figure 4-1). The case history is displayed in the right frame and includes direct history, which traces the case through the appellate process and includes both prior and subsequent history, and negative citing references, which are cases outside the direct appellate line that may have a negative impact on the precedential value of the case.

The direct history of a case can be displayed in an easy-to-read graphical view that shows each court decision at the appropriate trial or appellate level (U.S. Supreme Court, state high court, intermediate court, or trial court). Click Direct History (Graphical View) on the Links tab to display the graphical view (Figure 4-2).

KEYCITE CITING REFERENCES FOR A CASE

To view a list of cases, administrative materials, secondary sources, and briefs and other court documents that cite your case, click Citing References on the Links tab (Figure 4-3). Negative citing cases are listed first; the remaining cases are listed according to the depth of treatment they give your case.

You can restrict your list of citing references by document type, headnote, Locate term, jurisdiction, date, or depth of treatment category. Click Limit KeyCite Display at the bottom of the KeyCite citing references result.
KeyCite Depth of Treatment Stars

KeyCite depth of treatment stars indicate the extent to which a citing case discusses the cited case.

KEYCITE STATUS FLAGS

A KeyCite status flag (a red or yellow flag or a green C) indicates that KeyCite information is available for the statute. A red flag indicates that the statute has been amended by a recent session law, repealed, superseded, or held unconstitutional or preempted in whole or in part. A yellow flag indicates that the statute has been renumbered or transferred by a recent session law; that an uncodified session law or proposed legislation affecting the statute is available (statutes merely referenced, i.e., mentioned, are not marked with a yellow flag); that the statute was limited on constitutional or preemption grounds or its validity was otherwise called into doubt; or that a prior version of the statute received negative treatment from a court. A green C indicates that the statute has citing references but no applicable history.
KEYCITE HISTORY FOR A STATUTE

Click a red or yellow KeyCite status flag or History on the Links tab to view the history of a displayed statute in the right frame (Figure 4-4). Statute history includes citations to cases affecting the validity of the statute, recent session laws that amend or repeal the section, proposed legislation, bill drafts, reports and related materials, credits, and historical and statutory notes.

KEYCITE CITING REFERENCES FOR A STATUTE

To view a list of documents that cite your statute, click Citing References on the Links tab. Citing references include cases that have affected the validity of the section, cases from USCA and state statute notes of decisions, cases that do not appear in notes of decisions, administrative decisions, Federal Register documents, secondary sources, briefs and other court documents, statutes and court rules, and administrative codes. Click Limit KeyCite Display at the bottom of the KeyCite citing references result to limit your list of citing references.

Checking Citations in Your Brief Automatically


WestCheck.com is Wests citation research application on the Web. You can use WestCheck.com to check your citations in KeyCite; create a list of cases cited by your cases; verify the accuracy of quotations in your documents; and retrieve the full text of documents. To access WestCheck.com, go to westcheck.com and sign on using your OnePass username and password. The WestCheck.com home page is displayed (Figure 4-5). WestCheck can automatically extract citations from documents in Microsoft Word 2007, 2003, 2002, and 2000, as well as from documents in Corel WordPerfect X4 Service Pack 1, WordPerfect Office X3 or WordPerfect 12, 11, and 10. You can also enter citations manually or copy citations from a table of authorities or other document.

Tracking the Case, Statute, or Regulation You Are Viewing


Has the U.S. Supreme Court or a state appellate court overruled a case on which youre relying? Or has it held a statute unconstitutional that is key to a current matter? KeyCite Alert is a service that automatically monitors the status of cases, statutes, administrative decisions, and regulations and sends you updates when their KeyCite results (i.e., history or citing references) change, providing you with the most current KeyCite information for your research. When you create a KeyCite Alert entry, you specify how frequently your document should be checked, e.g., daily or weekly. KeyCite Alert can deliver results directly to your e-mail address.
SETTING UP A KEYCITE ALERT ENTRY FROM A DISPLAYED DOCUMENT

When you are viewing a document or KeyCite result, click Monitor with KeyCite Alert on the Links tab in the left frame. The KeyCite Alert wizard is displayed (Figure 4-6), which will walk you through the steps for creating a KeyCite Alert entry. Click Next to move through each step, then click Finish to add your entry to the KeyCite Alert Directory.

SETTING UP A KEYCITE ALERT ENTRY FROM THE ALERT CENTER

If you know the citation of the document you want to monitor, click Alert Center at the top of any page. The Alert Center Directory is displayed. Click Wizard in the KeyCite Alert section and follow the step-by-step instructions to create your entry. Click Create in the KeyCite Alert section, then type the citation of the document you want to monitor in the Citation text box and click Go. The KeyCite Alert: Create Entry page is displayed. Specify your KeyCite Alert settings under Entry Details on the left side of the page. To change the delivery settings listed on the right side of the page, click Edit to display the KeyCite Alert: Edit Delivery Settings page. When you finish setting up your entry, click Save at the KeyCite Alert: Create Entry page to save it in the KeyCite Alert Directory.

Viewing the Search Result
When you retrieve your search result, the result list is displayed. The result list contains the citations of documents retrieved by your search (Figure 5-1). Click the title or the citation of a document to view its full text. In many databases, the result list includes your search terms and surrounding text for each document in a Terms and Connectors search result or the best portion of each document in a Natural Language search result. From the result list you can edit your search, print the result list or selected documents, link to additional resources when ResultsPlus information is displayed, or set up a WestClip entry for your Terms and Connectors query.
USING RESULTSPLUS TO ACCESS ADDITIONAL RESOURCES

When you search a statutes, regulations, case law, or analytical database, Westlaw automatically creates a ResultsPlus lista list of additional documents and West topic and key numbers that have a high statistical likelihood of matching the concepts in your search. Click a title in the ResultsPlus list to view the full text of the document, or click a topic and key number reference to retrieve a document containing case headnotes classified under that topic and key number. To return to the result list, click Full Screen List on the Result List tab or the Links tab.

Browsing Documents in the Result


Westlaw provides several tools to help you quickly and easily review the documents you retrieve (Figure 5-2).
USING NAVIGATION TOOLS

Click the Term arrows to view the next or previous occurrence of the search terms in your search result. The search terms are highlighted for easy identification. Click the Best arrows in a Natural Language search result to view the portion of each document most closely matching the concepts in your description. Click the Doc arrows to display the next or previous document in your search result. Use the Tools drop-down list in the lower-right corner to go to a specific page of a print publication, restrict your document display to specific fields, or copy document text including its citation. The options available vary depending on the type of document you are viewing.
BROWSING CONSECUTIVE SECTIONS

When you are viewing a statute, regulation, or treatise, click Previous Section or Next Section at the top of the document to view consecutive sections even if they were not retrieved by your search or Find request. For example, if you are viewing 29 U.S.C.A. 2612, click Next Section to view section 2613 and click Previous Section to view section 2611. To return to the document you originally retrieved, click Original Results at the top of the Links tab or the Result List tab.
VIEWING CITED DOCUMENTS

Hypertext links allow you to jump from a citation in the document you are viewing to the full text of the cited document. Simply click the link and the full text of the document is displayed.

LINKS TAB

The Links tab displays links to related information for the document you are viewing. The links available vary depending on the type of documents you retrieve. For example, the Links tab for a case law document displays links to the KeyCite result for the case petitions, briefs, and other court filings related to the case

ResultsPlus information specific to the case the table of authorities for the case Click a link to display the related information in the right frame.
LOCATING SPECIFIC TERMS

The Locate feature allows you to search the documents in your search result for a particular term or terms, whether or not the terms appeared in your original search. To use Locate, complete these steps: 1. Click Locate in Result at the top of the Links tab, the Result List tab, or the result list. The Locate Search Terms page is displayed (Figure 5-3). 2. Type your search terms in the Locate text box using the Terms and Connectors search method. 3. Click Locate. Your result list is automatically restricted to those documents in your search result that contain your Locate terms, and your Locate terms are highlighted in the document text. To modify your Locate request, click Edit Locate; to cancel your Locate request, click Cancel Locate.

COPYING AND PASTING TEXT WITH THE CITATION

The Copy with Reference feature automatically inserts the correct citation when you copy and paste text from a case, statute, regulation, treatise, or law review article into a brief or other legal document. To use Copy with Reference, follow these steps: 1. Select the text you want to copy (Figure 5-4). 2. Choose Copy with Ref from the Tools drop-down list at the bottom of the page and click Go. The Copy with Reference dialog box is displayed (Figure 5-5), containing the text you selected and the citation of the document containing the text. 3. Click Copy. Paste the copied text, which includes the citation, into your legal document.

6 Finding Forms
Retrieving Forms
You can access a variety of pleading and practice forms and checklists in the Forms and Checklists section of the Paralegal page. Click the Table of Contents link, if available, to browse a publications table of contents. You can also type a Terms and Connectors or Natural Language search. After you retrieve a form, you can download it and save it on your computer, or you can copy and paste it into a Microsoft Word or Corel WordPerfect document. You can also use FormFinder, which provides quick access to hundreds of text forms, official PDF forms, checklists, and clauses and an easy-to-use search template.

Using FormFinder to Retrieve Forms


FormFinder divides legal and business, transactional, pleading and practice, and litigation forms into relevant topics and subtopics. Complete these steps to search for forms using FormFinder: 1. Click FormFinder at the top of any page. The FormFinder search template is displayed. 2. Choose a topic from the All Topics drop-down list, or click Browse Topics to browse a list of topics. You can also choose a subtopic, if desired. For example, to retrieve forms and checklists pertaining to proprietary rights in copyrighted works, choose Copyright from the Select a Topic drop-down list, then choose Proprietary Rights from the Select a Subtopic drop-down list. 3. To restrict your search to specific jurisdictions, select the appropriate check boxes under Jurisdiction Selection. 4. To restrict your search to litigation or transactional forms, select the appropriate check box under Filter 1. To restrict your search to civil or criminal forms, select the appropriate check box under Filter 2. 5. To restrict your search to forms containing specific terms, type a Terms and Connectors search in the Enter Search Terms text box. 6. Click Search Westlaw.
Using Natural Language

You can also use the Natural Language search method to run a search. For example, to search for software license agreements, click the Natural Language tab and type software license agreement in the Search text box, then click Search Westlaw.
SEARCH RESULT

The left frame of the Results page contains a Result Summary, which categorizes the type of forms in the result, e.g., text forms or checklists (Figure 6-1). The number of documents in each category is displayed in parentheses. The right frame lists the first three documents in each category. To view all forms in a specific category, click view all next to the category heading in the right frame or click the category name in the Result Summary.

Retrieving Westlaw eforms


Westlaw eforms are available for local, state, and federal courts, as well as for government agencies. To search all eforms available on Westlaw, access the Westlaw eforms: State and Federal Courts and Agencies database (ALLFRMS). To view a list of Westlaw eforms databases for a selected state, click Directory at the top of any page. At the Westlaw Directory, type a short description of the forms you want, such as ohio eforms, in the Search the Westlaw Directory text box in the right frame, then click Search. To retrieve Westlaw eforms, follow these steps: 1. Access a database, e.g., Westlaw eforms: Ohio State Courts and Agencies (OH-FRMS). A search template is displayed. 2. Type a search describing the forms you want to retrieve, e.g., application & workers compensation in the Search text box. Limit your search by court or agency if desired. Click Search Westlaw. To view a form, click its link in the result list, then click the PDF icon in the document.
COMPLETING EFORMS

Each form contains fields for you to complete. These fields are indicated by blue shading to help ensure that you enter all necessary information. Westlaw eforms include features that allow you to share information and collaborate with clients and colleagues.

7 Finding Information About People


The Information About People section of the Paralegal page allows you to quickly retrieve information about individuals, including their addresses, their neighbors, their assets, and any adverse filings or criminal records. Some of the public records databases in this section require you to select one or more permissible uses under the applicable laws and rules before you can run a search. When a permissible use is required, choose the use from the drop-down list at a database search template. To set the permissible use as your default, select the Keep this selection as my default check box next to the list.

Locating People
Use the databases listed below to locate potential parties and witnesses for a lawsuit. Click People Records to display the search template for the People RecordsCombined database (PEOPLE-ALL) (Figure 7-1). Choose a permissible use from the Voters drop-down list and then type your search terms in the text boxes. (If your use is not listed in the Permissible Uses drop-down list, choose No Permissible Use, Search will exclude Voter Registration Records and proceed with your search. All other information in the database will be included in your search result.) The search template has flexible search requirements that enable you to search with partial name and address information that may not be suitable in other databases. Click Executive Affiliations to display the search template for the Executive Affiliation Records database (EA-ALL), which you can search for information on executives worldwide. Type a name in the Executive Name text box and click Search Westlaw. You can also run a search in a combined public records database for a specific state. With a single search, you can pull together a comprehensive picture of an individual. Click Public Records by State to display the Public Records CombinedIndividual States section of the Westlaw Directory. Click the name of a database you want to search.

Retrieving Adverse Filings


Adverse filings include lawsuit filings, which typically contain the names of the parties, case number, filing date, and type of action bankruptcy filings, which include personal and business bankruptcies under chapters 7, 11, and 13 of the Bankruptcy Code Uniform Commercial Code (UCC) filings and liens and civil judgment records To run a search, click Adverse Filings to display the search template for the Adverse FilingsCombined database (ADVERSE-ALL). Type a name in the Name text box and choose the types of records you want and the jurisdictions in which you want to search, then click Search Westlaw.

Locating Assets
You can retrieve information about the following types of assets: aircraft motor vehicles real property stocks watercraft unclaimed property You can use real property records to verify ownership, research property value, identify encumbrances, check tax information, and search for sales information. To run a search, click Asset Search to display the search template for the Asset LocatorCombined database (ASSET-ALL). Select a permissible use from the DPPA drop-down list, type the name of an individual in the Name text box, select the types of assets you want to search for and the jurisdictions you want to search, and click Search Westlaw.

Checking Criminal Records


Criminal records contain information on criminal offenders from state and U.S. district court filings, state departments of corrections records, state sex offender registries, and the Office of Foreign Assets Control. To run a search, click Criminal Records to display the search template for the Criminal RecordsCombined database (CRIM-ALL). Type a name in the Name text box, select a jurisdiction, and click Search Westlaw.

Using Additional Materials


Click Additional Materials to display the Person Finder section of the Westlaw Directory. Browse the section by clicking the links. For example, click Licenses, then click Attorney LicensesIndividual States to see a list of individual state attorney license databases. To access a database, click a database name.

The Information About Companies section of the Paralegal page allows you to quickly retrieve in-depth information about companies, including their corporate structure and registered agents.

Retrieving Company Profiles


The Company Profiles database (CO-PROFILE) compiles information from newspapers, trade publications, industry newsletters, analyst reports, and other current news sources and presents the information about a company in a single, easy-to-read report. Comprehensive profiles are available for approximately 420,000 public and private companies. To retrieve a company profile, click Company Profile to display the CO-PROFILE search template. Type a company name in the Company Name text box, enter other pertinent information, and click Search Westlaw. In addition to the result list, you may also see ResultsPlus information listing Investext PDF analyst reports or Securities and Exchange Commission (SEC) filings. In the result list, click the number next to the document you want to view.

Finding Owners, Officers, and Registered Agents


The Corporate Records and Business RegistrationsCombined database (CORP-ALL) contains corporate and business registration records from all states except Delaware and from the District of Columbia, Puerto Rico, and the Virgin Islands. Click Corporate Registration Records to display the CORP-ALL search template. Type a name in the Company Name text box, e.g., caribou +2 coffee, or registration information in the Registration text boxes. Limit your search to one or more states by selecting the check boxes under State Selection. Then click Search Westlaw. In the result list, click the number next to the document you want to view (Figure 8-1). Information you retrieve includes registered agent names and good-standing status.

Locating Company Reports, Financial Information, and Securities Filings


The following databases help you gather more detailed information about a company, including the companys past and current financial status as well as background information on corporate officers.. Click Dun & Bradstreet Reports to display a list of D&B databases in the Westlaw Directory. Click a database name to display a search template. For example, click D&B Business Records PlusUS to display the search template for the D&B Business Records PlusUS database (DUNBR-US). The DUNBR-US database contains information on the history, day-to-day operations, finances, and corporate affiliations of more than 44 million U.S. companies. Click Investext Analyst Reports to display a search template for the Investext PDF database (INVESTEXT-PDF), which contains full-text research reports written by investment specialists. Click Securities and Exchange Commission Filings to display the search template for the EDGARSEC Filings database (EDGAR). You can retrieve 10-K, 10-Q, and 8-K reports; registration statements; prospectuses; proxy statements; and other documents filed by companies with the SEC via the Electronic Data Gathering, Analysis, and Retrieval (EDGAR) system.
BUSINESS CITATOR REPORTS

You can also use the Business Citator ReportsCompany Search database (BC-COMPANYSRBD) to create customized reports on companies based on securities and intellectual property filings, litigation records, bankruptcy filings, officer and director profiles, and news reports. Under Business Citator Reports in the left frame, type a company name in the Search by Company Name text box and click Go. If you want to restrict your search to a specific state, click Advanced Company Search. Then type a company name in the Company Name text box, select a state in the States list box, and click Search Westlaw. A list of companies containing your terms in the company name or a related company name is displayed. Click the number next to the name of the company for which you want to create a Business Citator Report; all categories of information available for inclusion in the report are displayed in the right frame (Figure 8-2). Select the check boxes next to the categories you want to include and click Submit. Then click Complete Download at the Download Confirmation page. The Business Citator Report is displayed in PDF.

9 Retrieving Court Documents


The Court Documents section of the Paralegal page allows you to retrieve a variety of court documents, including dockets, briefs, litigation documents, and expert witness filings.

Locating Court Docket Information


Dockets databases allow you to access case docket informationincluding PDF images of selected filingswithout having to leave your office. You can obtain details about a partys litigation history and manage timelines during trial preparation. Docket information typically includes the names of the parties and their attorneys, the case number, the assigned judge, the nature of the suit, the type of claim, the case status, a list of documents on file, and the schedule of proceedings and appearances. To run a search, click Dockets. The Dockets (Court Docket Information) section of the Westlaw Directory is displayed. Click a database name to display a search template.
VIEWING A DOCKET

While viewing a court docket (Figure 9-1), you can update or track the docket.
Updating a Docket

To view the most recent additions to the docket, click Update at the top of the docket. If your search result contains several dockets, you can update them simultaneously while viewing the result list. Select the check boxes for the dockets you want to update and click Update Selected Dockets at the top of the list. At the Docket Update Request page, click Submit. The Docket Tools page is displayed at which you can view the updated dockets or print, e-mail, or download them.
Tracking Court Dockets

To track the docket, click Track this Docket at the top of the document to create a Docket Alert entry that will track changes in court docket information and notify you of these changes.

Retrieving Appellate Briefs


Westlaw includes thousands of appellate court briefs that can be searched by issue or by the name of a party, attorney, or judge. Click Briefs Multibase to display the search template for the Briefs Multibase (BRIEF-ALL). To search other briefs databases, click a database name under Appellate Briefs in the left frame of the search template or click More to display the Briefs section of the Westlaw Directory. Click a database name in the directory to display a search template.

Retrieving Trial Court Filings


The State and Federal Civil Trial Court Filings database (FILING-ALL) contains selected motions, memoranda, pleadings, and other documents filed with selected state trial courts and U.S. district and bankruptcy courts. Click State and Federal Civil Trial Court Filings to display the FILING-ALL search template. To search other court filings databases, click a database name under Pleadings, Motions, and Memoranda in the left frame of the search template or click More to display the Trial Filings section of the Westlaw Directory. You can use these documents to draft your own pleadings and motions.

Retrieving Expert Witness Filings


The Expert Witness Filings database (EW-DOCS) contains thousands of expert witness depositions, affidavits, reports, and trial transcripts from state and federal courts. To access the database, click Expert Witness Filings. The search template is displayed, which includes several drop-down lists you can use to focus your search. For example, to retrieve filings in Colorado cases involving experts in accounting and finance who are economists, choose Accounting and Finance from the Experts Field drop-down list and Economist from the Specialty drop-down list, select Colorado in the Jurisdiction list box, and click Search Westlaw. In the result list, click the title of the document you want to view. While viewing the document (Figure 9-2), you can click Petitions, Briefs, and Filings or View Expert Resumes, when available, in the left frame to retrieve additional information. Links to expert witness filings can also be found in selected cases, court dockets, and Westlaw Profiler records.

Westlaw Profiler provides instant access to biographical details and litigation history (e.g., links to cases, jury verdict and settlement summaries, court dockets, and appellate briefs) involving the attorneys, judges, and expert witnesses in your case. You can access profiles in several ways, including the following: In a document you are viewing, click the name of the individual in the document text. In the left frame of the Paralegal page under ProfilerProfessional, type a persons name.e.g., peter wright, in the Search by name and profession text box; choose a profession, e.g., Attorney/Judge or Expert Witness, from the Select a Profession drop-down list; choose a state from the All States drop-down list, if desired; and click Go.

Locating an Expert Witness


Experts are needed in litigation for many different reasons, such as explaining complicated issues to a jury, helping to determine whether legal standards of care were met, and evaluating statistical information. In addition, if opposing counsel is using a particular expert witness, you can familiarize yourself with that experts background. To find an expert witness by area of expertise, click Advanced SearchExperts under Profiler Professional. At the search template, you can select an area of expertise or click the name of an area to display related specialties. After you select an area of expertise or one or more specialties, select a state in the State Selection list box, if desired, and click Search Westlaw. In the result list, click the number next to the document you want to view. While viewing an expert witness profile (Figure 10-1), you can access additional information, when available, in the left frame. Click Expert Challenge Report to retrieve information about challenges to the experts testimony. Click Expert Evaluator Reports to retrieve litigation information for the expert witness. Click Expert Comparison Report to compare litigation information for up to three experts. Click a link under Profiler References, .g., Trial Filings, to view a list of those documents.

Researching an Attorney or Judge


Whether you represent the plaintiff or the defendant, it helps to know something about the attorney or judge involved in your case, such as the judges educational and professional background and his or her disposition of cases. To find a judge or attorney by practice area, click Advanced SearchAttorney/Judge under Profiler Professional in the left frame. At the search template, select one more practice areas; select a state in the State Selection list box, if desired; and click Search Westlaw. A list of judge or attorney profiles is displayed. Click the name of the individual whose profile you want to view. While viewing a judge or attorney profile (Figure 10-2), you can access additional information, when available, in the left frame. Click a link under Profiler References, e.g., Trial Court Orders, to view a list of those documents. Click Litigation History Reports to retrieve a report that analyzes an attorneys or judges litigation activities by category. Click Judicial Reversal Reports to retrieve a report that analyzes a judges appellate record.

When you need news and background information about an individual or company, use the features in the left frame of the Paralegal page. These features include the following: News Sources: Choose a source, e.g., All News, from the drop-down list and click Go. A Search page is displayed. People in the Headlines: Use this feature to search headlines and lead paragraphs for a persons name. Type a name in the text box; choose a date restriction from the drop-down list, e.g., Last 30 days; and click Go. Westlaw runs your search in the All News database (ALLNEWS). Companies in the Headlines: Use this feature to retrieve recent articles discussing a particular organization. Type the name of the organization in the text box; choose a date restriction from the drop-down list; and click Go. Westlaw runs your search in the ALLNEWS database.

Searching in News Databases


The features below at the ALLNEWS Search page (Figure 11-1) make searching with the Terms and Connectors search method easier: Case-Sensitive Searching: Click Case-sensitive Searching to specify capitalization requirements for search terms. For example, you can specify that all the letters in a term be uppercase in the documents you retrieve. Limit ALLNEWS: Click Limit ALLNEWS to limit your search in the ALLNEWS database to certain publication types. Search Only the Headlines and Lead Paragraphs: Select the check box for this feature to limit your search to the headlines and lead paragraphs of news articles. Identify Duplicate Documents: Select the check box for this feature to identify duplicate documents in your search result.

Using ResultsPlus
When you run a search in a news database to retrieve information about a company, your result list may contain a ResultsPlus list of additional document such as company profiles, Investext analyst reports, and SEC filings (Figure 11-2).

Tracking News Sources


After you run a Terms and Connectors search in a news database, click Add Search to WestClip at the top of the result list to create a WestClip entry. The WestClip service automatically runs the search at the frequency you select, e.g., daily or weekly, and sends the result to the destination you select, e.g., an e-mail address.

Use the Alert Center to track individuals and companies and follow developments. Click a link under Tracking and Alerts in the left frame of the Paralegal page or click Alert Center in the upper-right corner of any page to access the Alert Center.

WestClip
Use WestClip to run Terms and Connectors searches automatically on a daily, weekday, weekly, biweekly, or monthly basis. Your search results are delivered to the destination of your choice, e.g., e-mail address. With WestClip you can perform tasks such as the following: Monitor whether the U.S. Supreme Court has granted certiorari. Read a U.S. court of appeals decision as soon as it appears on Westlaw. Track federal and state legislation. Stay up-to-date on a practice area or legal issue of interest. Click WestClip under Tracking and Alerts to display the WestClip: Overview page. (If you have previously created a WestClip entry, the WestClip Directory is displayed.) Click Create Entry at the top of the page. At the WestClip: Create Entry page, type your information in the appropriate text boxes. If desired, click Edit to change delivery settings. Click Save when you are finished making your selections. You can also create a WestClip entry by clicking Add Search to WestClip while viewing a result list retrieved with a Terms and Connectors search. The WestClip: Create Entry page is displayed with the database identifier and search automatically added to the entry.

Docket Alert
Use the Docket Alert service to monitor new case filings and developments in ongoing cases. To access Docket Alert and create an entry, follow these steps: 1. Click Docket Alerts and Tracks under Tracking and Alerts. The Docket Alert: Directory page is displayed. (If you have previously created an entry, the Docket Alerts and Tracks: Directory page is displayed.) 2. Click Create Entry at the top of the page. The Docket Alerts and Tracks: Create Entry page is displayed. 3. Select Receive an alert when there are new developments in a specific case or Receive an alert when new cases are filed. Then click Go. 4. Select a court or courts. Click Save if necessary. 5. Complete your entry by typing information in the appropriate text boxes under Entry Details. You can change delivery settings, if desired, under Delivery Settings. 6. When you are finished making your selections, click Save. While viewing a docket, you can also click Track this Docket to display the Docket Track: New Developments in a Specific Case page, at which you can create an entry.

D&B Alert
Use D&B Alert to monitor various D&B reports. D&B Alert will notify you when changes are made to a companys Comprehensive Report, Business Information Report, or International Business Information Report. The results, indicating which sections of the report were updated, are e-mailed to you. There are several ways to create a D&B Alert entry: Click D&B Alert under Tracking and Alerts. At the D&B Alert: Create Entry page, type the company name and the D-U-N-S number in the text boxes and, if necessary, type your e-mail address. Then click Save. While viewing a D&B record for a company, click create a D&B Alert at the end of the record.

KeyRules Alert
Use KeyRules Alert to monitor changes in rules governing common court procedures. There are several ways to create a KeyRules Alert entry: Click Alert Center at the top of any page. At the Alert Center Directory, click Create in the KeyRules Alert section. The KeyRules Alert: Create Entry page is displayed. Type a name for the entry; choose the court from which you want to receive updated documents from the series of Court drop-down lists; choose a document type from the Document Type drop-down lists; type your e-mail address in the E-mail text box; and click Save. The entry is saved in the KeyRules Alert Directory. While you are viewing a KeyRules document, click Notify me of rules update at the top of the document. The KeyRules Alert: Create Entry page is displayed.

Viewing Entries for an Alert Service


Click Alert Center at the top of any page to display the Alert Center Directory. Click the arrow to the left of an alert service to view the most recent entries saved in the directory for that service. To view all entries for the service, click View All. To modify an entry, click the name of the entry. To remove an entry from the directory, select the check box next to the entry and click Delete.

13 Searching for Documents


Westlaw provide two search methodsNatural Language and Terms and Connectorsso you can search the way that is most effective for you. When you access a database, the Search page is displayed with your default search method selected. To select a different search method, click the appropriate tab. You can select Natural Language as your default search method by clicking Preferences at the top of any page. Then click Search in the left frame, select Natural Language under Search Method in the right frame, and click Save Changes.

Selecting Natural Language or Terms and Connectors


Use Natural Language when you are searching for broad concepts searching databases containing large numbers of documents and you want to retrieve a small number of documents to review a new or infrequent Westlaw user or you are unfamiliar with Terms and Connectors searching not retrieving the information you are looking for by using a Terms and Connectors search Use Terms and Connectors when you are searching for particular terms searching for a particular document searching for all documents containing specific information, such as all cases classified under a particular topic and key number or all opinions written by a particular judge searching a database for which Natural Language searching is not available

Accessing a Database
Click a database name in the right frame of the Paralegal page to run a search. If you don't see the database you want, you can browse the Westlaw Directory, which lists all the databases on Westlaw and their identifiers. Click Directory at the top of any page to display the Westlaw Directory. You can also type a description of the database you are looking for, e.g., colorado insurance cases, in the Search for a database text box in the left frame of the Westlaw Directory or the Paralegal page and click Go. A list of database names and identifiers is displayed. Click the name of the database you want to search. For detailed information about a database, click the Scope icon ( ) next to its name. If you have a special Westlaw subscription plan, e.g., a WestlawPRO plan, the databases in your plan will be listed in the right frame of the Westlaw Directory page. Click All Databases in the left frame to view all the databases on Westlaw.

Searching with Natural Language


The Natural Language search method allows you to use plain English to retrieve relevant documents. Simply enter a description of your issue using terms that describe its main concepts. Westlaw identifies legal phrases in your description (such as quantum meruit, adverse possession, and state of mind), removes common terms (such as is and for), and generates variations of terms (such as defamed, defaming, and defamation for defame). To search for documents using Natural Language, follow these steps: 1. Access a database or multiple databases. The Search page is displayed. 2. Click the Natural Language tab if it is not already selected. 3. Type a description of your issue, e.g., fair use of copyrighted material on the internet, in the Search text box (Figure 13-1). 4. Click Search Westlaw. The documents most closely matching the concepts in your description are displayed. Note The online thesaurus is useful for finding alternative search terms. After typing a description, click Thesaurus to select alternative terms for the terms in your search.

Searching with Terms and Connectors


Terms and Connectors searching allows you to enter a query that consists of key terms from your issue and connectors specifying the relationship between those terms. For example, you can specify that your terms appear in the same sentence or the same paragraph. Terms and Connectors searching is more precise than Natural Language searching and is particularly useful when you want to retrieve all documents that contain your terms. Complete these steps to search for documents using Terms and Connectors: 1. Access a database or multiple databases. The Search page is displayed. 2. Click the Terms and Connectors tab if it is not already selected. Type your query in the Search text box, e.g., willful! /s misconduct /s unemployment compensation /s disqualif! (Figure 13-2). 3. Click Search Westlaw.

USING CONNECTORS

In Terms and Connectors searching, you must place connectors between your terms. Connectors specify the relationship that must exist between terms in your retrieved documents. Refer to the chart below when you use the Terms and Connectors search method. CREATING PHRASES

To search for a phrase, place the phrase in quotation marks. For example, to use the phrase golden parachute in a search, type golden parachute.
ADDING ALTERNATIVE TERMS

Consider both synonyms and antonyms as alternative terms. For example, if you are searching for legal, you might also include illegal, lawful, and unlawful in your search. If you are searching for good faith, you might also want to search for bad faith.
ONLINE THESAURUS

The online thesaurus is useful for finding alternative search terms. After typing a query, click Thesaurus to select alternative terms for the terms in your search.
USING VARIATIONS OF WORD FORMS

When choosing search terms, consider the various forms they might take. Refer to the following chart for information about retrieving variations of word forms. 14 Searching Case Law


You can search case law databases using either the Natural Language or Terms and Connectors search methods. In addition, you can restrict your search by field or use West topic and key numbers to retrieve relevant cases that may not include your exact search terms.

Restricting Your Search by Field


Almost all documents on Westlaw are composed of several parts called fields. Each field contains a specific type of information. Use a field restriction in a Terms and Connectors query when you want to restrict your search to a particular document field or fields. In case law documents, the names of the parties, the name of the judge, and the names of the attorneys are each considered a separate field. Other fields, including the synopsis, topic, headnote, and digest fields, contain exclusive West editorial enhancements (Figure 14-1). The synopsis field (sy) contains a summary of the case prepared by West attorney-editors; the digest field (di) contains the headnotes and topic and key numbers in the case. Searching both fields at the same time can be very effective.

Using Topic and Key Numbers


Each legal issue in a case published by West is identified and summarized in a headnote. Each headnote is then classified under one or more topic and key numbers. The complete topic and key number outline used by West attorney-editors to classify headnotes is available on Westlaw in the West Key Number Digest, also referred to as the Custom Digest. You can use the West Key Number Digest to find topic and key numbers related to your issue and to retrieve cases with headnotes classified under those topic and key numbers.

To access the West Key Number Digest, click Key Numbers at the top of any page, then click West Key Number Digest Outline at the next page. The topic and key number outline is displayed. Click the plus and minus symbols to browse the outline. Alternatively, click Custom Digest at a case law database Search page. After you identify a topic and key number associated with the legal issue you are researching, you can run a search using that topic and key number in a case law database to quickly retrieve cases involving the same legal issue. For example, to search for cases with headnotes classified under topic 231H (Labor and Employment) and key number 758 (Wrongful Discharge in General), first access an appropriate database such as All Federal Cases (ALLFEDS). At the Search page, click the Terms and Connectors tab, type 231hk758 in the Search text box, and click Search Westlaw. You can also use a topic and key number search in conjunction with other search terms. For example, to search for cases with headnotes classified under the above topic and key number that relate to contracts, type 231hk758 /p contract.
SEARCHING FOR KEY NUMBERS

In addition to browsing the topic and key number outline for relevant topic and key numbers, you can also search for them using the Search for Key Numbers feature (Figure 14-2). Click Key Numbers at the top of any page. A page is displayed that contains the Search for Key Numbers text box. Type terms that describe your issue, such as family and medical leave, in the text box; change the jurisdiction if desired; and click Search. You retrieve a list of topic and key numbers from cases in your jurisdiction, as well as from other state and federal jurisdictions. Click a topic and key number in the list to view case headnotes classified under that topic and key number along with links to the full text of the cases containing those headnotes.

In addition to searching statutes and regulations databases, you can also use features such as the Table of Contents service, an alphabetical index, and the Popular Name Table (for statutes databases only) to assist you in retrieving statutes and regulations. To display Search pages for statutes and regulations databases, click the name of the database, e.g., United States Code Annotated, under Statutes and Codes in the right frame of the Paralegal page. You can also click Table of Contents or Statutes Index next to a database name to go directly to the table of contents or index for that database. If your states statutes database is not listed under Statutes and Codes, you can add it by clicking Edit next to Statutes and Codes and then typing its name in the Add Database text box and clicking Add.

Restricting Your Search by Field


The two most useful fields when you search statutes and regulations databases are the prelim (pr) and caption (ca) fields (Figure 15-1). The prelim field contains the title, subtitle, chapter, and subchapter headings of each section. The caption field contains the section number followed by terms that describe the contents of the section. For example, to retrieve federal statutes regarding the subject matter and scope of copyright, you could type a search such as pr,ca(copyright /p subject-matter scope). Other useful fields are the citation (ci) and text (te) fields.

Using the Table of Contents Service to Retrieve Multiple Sections


EXPANDING THE TABLE OF CONTENTS

When you are browsing the table of contents for a statutes or regulations database, you can easily expand a title, chapter, part, or subpart to view all included sections. Select the check box next to a title, chapter, part, or subpart and click Expand Selection(s). That portion of the table of contents will be expanded. Click Collapse All to collapse the entire table of contents.
RETRIEVING MULTIPLE SECTIONS OR ENTIRE TITLES, CHAPTERS, PARTS, OR SUBPARTS

To retrieve multiple sections or entire titles, chapters, parts, or subparts, select the check boxes next to the sections, titles, chapters, parts, or subparts you want to retrieve. Then do one of the following: Click Retrieve and Print to print documents immediately after they are retrieved. Click Search. The Table of Contents search page is displayed listing your selections. Click Search again to retrieve all the documents you selected. If you want to retrieve only those sections containing specific terms, type those terms in the text box before clicking Search again.

ACCESSING THE TABLE OF CONTENTS FOR PRIOR VERSIONS OF STATUTES OR REGULATIONS

The table of contents for the CFR, the USCA, or California, Florida, Illinois, Massachusetts, New Jersey, New York, Pennsylvania, or Texas statutes can be displayed as it existed on a particular date. To do so, complete these steps: 1. Access the table of contents for the CFR, the USCA, or any of the state statutes listed above. 2. Type a date in the Effective Date text box or select a date by clicking the Calendar icon, then click Go (Figure 15-2). The table of contents as it existed on the date you selected is displayed

Using an Index to Retrieve Statutes and Regulations


To access an alphabetical index to retrieve sections on a specific topic, click Statutes Index next to a database name under Statutes and Codes. You can also click Statutes Index at the top of a statutes database Search page or RegulationsPlus Index at the top of the CFR Search page. Then click the links and the plus and minus symbols until you see a section that interests you. To view the full text of a section, click its citation. To search for specific terms in the index, type them in the text box at the top of the page and click Search (Figure 15-3).

Using the Popular Name Table to Retrieve Statutes


When you know the popular name of an act, you can use the Popular Name Table to retrieve the statutory sections under which the act is codified. The Popular Name Table is available for both state statutes and the USCA. After accessing a statutes database, click Pop. Name Table at the top of the Search page. Then browse the alphabetical list for the name of the act. To see the statutory sections under which the act is codified, click the acts name or the citation next to the name. You can also access the Popular Name Table for the USCA from the USCA Popular Name Table database (USCA-POP).

Using the Links Tab to View Related Materials


When you retrieve a statute or regulation, the Links tab in the left frame displays links to documents on Westlaw that are related to the statute or regulation. For example, the Links tab for a statute provides access to KeyCite history and citing references and numerous primary and secondary sources (Figure 15-4). These sources include cases, related statutes, administrative codes and rulings, various legislative history documents, treatises, law review articles, and ALR annotations. For example, when you are viewing a statute, click Citing References to view a list of primary and secondary materials that cite the section Graphical Statutes to display the legislative history of the section in graphical view Table of Contents to view surrounding sections a title in the ResultsPlus list to view the text of the document Notes of Decisions to view cases chosen by West editors that construe or apply the section Text Amendments to link to public laws that enacted or amended the section

Using RegulationsPlus for Federal Regulations


After you retrieve a CFR section, use the RegulationsPlus links on the Links tab (Figure 15-5) to retrieve notes of decisions similar to the notes of decisions found in USCA and other West annotated statutes prior versions of the regulation relevant agency opinions and decisions related documents in the Federal Register notice of proposed and pending regulations

Retrieving All Sections of a Statute or Regulation (Without Annotations)


While viewing a specific statutes or regulations section, click the All Sections icon ( ) in the prelim field (Figure 15-6) to view all sections included in the chapter, subchapter, or part containing that section. The full text of all the sections without annotations will be displayed as a single document. You can then browse or print the document.

Using Graphical Statutes


Graphical Statutes helps you track changes to a statute in an easy-to-read graphical view. It is available for the USCA and statutes from selected states. Coverage dates vary. Graphical Statutes provides links to enacting and amending public laws relevant legislative history materials such as bill drafts, reports, journals, and Congressional Record documents cases that negatively affect the statute prior versions of the statute and future text of the statute not yet in effect legislation that has been enacted but has not yet been codified While viewing a statute, click Graphical Statutes on the Links tab to display the history of the statute in graphical view (Figure 15-7). The timeline at the top of the page shows the effective dates for each version of the statute.

Retrieving Federal Legislative History


The Legislative HistoryU.S. Code, 1948 to Present database (LH) contains congressional committee reports. The Congressional Record database (CR) contains the text of congressional debates as reported in the Congressional Record. The U.S. Code Congressional and Administrative News database (USCCAN) includes documents from the U.S. Code Congressional and Administrative News, such as the text of U.S. public laws; legislative history reports; and the text of presidential proclamations, executive orders, and presidential messages and signing statements.
