Prosecutor says fatal stabbing of
Marine appears to be hate crime
The April 21 fatal stabbing of a Marine across the
street from the Marine Barracks on Capitol Hill took
place minutes after another Marine accused of the
stabbing saw the victim hugging a gay male friend
outside a straight bar, according to the prosecutor in
the case.
Assistant U.S. Attorney Michael Liebman told
a D.C. Superior Court hearing on May 16 that the
government considers the incident a hate crime. But
a spokesperson for the U.S. Attorneys ofce said later
that the government has not charged the case as a hate
crime and that the case remains under investigation.
Liebman said defendant Pfc. Michael Poth, 20,
shouted an anti-gay slur at Lance Cpl. Philip Bushong,
23, and Bushongs gay friend, whom authorities have
not identied.
Liebman told Judge Ronna L. Beck, who presided
over a preliminary hearing, that the anti-gay slur came
minutes before Poth and Bushong got into a verbal
and physical altercation during which Poth allegedly
plunged a pocket knife into Bushongs upper chest,
piercing his heart.
Bushong was pronounced dead a short time later
at a hospital. D.C. police charged Poth with second-
degree murder while armed. Police didnt initially list
the incident as a hate crime.
Liebman did not identify Bushongs gay male friend,
saying only that Poth saw Bushong and the friend
hugging on the sidewalk outside Molly Malones bar and
restaurant on the 700 block of 8th Street, S.E. The bar is
located across the street from the Marine barracks at 8th
and I Streets, S.E., where Poth had been stationed.
This was a hate crime, the Washington Post quoted
Liebman as saying at the hearing. The victim and his
friend were embracing outside.
Friends of Bushong have said he was straight. He
had been stationed at the Marine Corps base at Camp
Lejeune, N.C., and was visiting Washington, where he
planned to move, friends and family members said.
At the time of his death, Bushong was days away from
being discharged honorably after having completed his
term of enlistment.
Poths attorney, David Benowitz, argued at the
hearing that Poth acted in self-defense. He pointed to
one of several video surveillance tapes played at the
hearing that showed Poth on the ground before getting
back on his feet. Benowitz said Poth was on the ground
because Bushong hit or pushed him.
Benowitz also noted at the hearing that a witness
told police that Bushong initiated contact with Poth. At
the time of his arrest, Poth told D.C. police homicide
detectives that Bushong punched him in the face and
head and he stabbed Bushong in self-defense.
According to accounts in the Post and the Washington
Times, Benowitz argued that the facts in the case didnt
support a second-degree murder charge and that the
charge should be reduced to manslaughter.
Court records show that Judge Beck denied the
request to lower the charge and ruled that prosecutors
established probable cause that Poth committed
second-degree murder while armed. She scheduled a
felony status hearing for the case on July 13.
Becks ruling came after D.C. Police homicide
Det. Dwayne Partman testied at the hearing that
a witness told police Poth shouted he was going to
stab somebody and cut their lungs out just after he
walked past Molly Malones bar. Partman testied that
the witness said Poth made that remark while Bushong
and his gay male friend along with other people were
standing in front of Molly Malones, the Post reported.
The Post also reported that two members of
the Marines dressed in civilian clothes entered the
courtroom before the hearing began and informed
the attorneys that the Marines had given Poth an other
than honorable discharge based on poor conduct that
occurred prior to Bushongs murder.
Liebman stated at the hearing that Marine Corps
ofcials informed prosecutors that Poth tested positive
for using synthetic marijuana and he had verbally
assaulted other soldiers and had to be restrained, the
Post reported.
William Miller, a spokesperson for the U.S. Attorneys
ofce, said he could not provide further details on the
case because it is pending in court and remains under
investigation. However, Miller said that at the present
time, the U.S. Attorneys ofce has not charged the case
in court as a hate crime.
Benowitz didnt immediately respond to a request for
comment.

Gay D.C. delegates headed to
Democratic convention
The D.C. Democratic State Committee on May 3
elected gay Democratic activist David Meadows as
an alternate delegate to the Democratic National
Convention in September, completing the citys
convention delegate selection process.
Meadows, a former president of the Gertrude Stein
Democratic Club, will join at the convention Gregory
Cendana, a gay labor activist; Lateefah Williams, the
Stein Clubs current president; and Jeffrey Richardson,
director of the Mayors Ofce of GLBT Affairs. Cendana,
Williams and Richardson won election as convention
delegates at a March 3 Democratic caucus held on the
campus of the University of the District of Columbia.
Gay Democratic activist Earl Fowlkes, a member of
the Democratic National Committee, will also serve as
a delegate to the convention from D.C. under a party
rule that makes all DNC members automatic delegates
to Democratic conventions.
The ve-member gay contingent will be among a
total of 44 delegates to the convention from D.C.
In past years, gays and lesbians also have attended
Democratic conventions from D.C. and other
jurisdictions as members of convention standing
committees. Committee positions, which are usually
appointed by the Chair of the Democratic Party, have
yet to be made for the 2012 Democratic Convention.

Dignity Washington marks 25 years
since expulsion from chapel
The gay Catholic group Dignity Washington on
Sunday is scheduled to commemorate the 25th
anniversary of the Catholic Archdiocese of Washingtons
decision to oust the group from its use of a Georgetown
University chapel to celebrate its Sunday Mass for D.C.-
area gay Catholics.
At the time, the Archdiocese said it acted on orders
from the Vatican, which banned gay Catholic groups
from using church facilities for meetings or religious
services. Vatican ofcials said individual gay Catholics
could continue to attend Mass at Catholic churches.
Dignity Washington spokesperson Tom Bower said
the anniversary of the 1987 ouster from the Georgetown
chapel as well as the 20th anniversary of the founding
of the Dignity chapter in Northern Virginia and the 20th
anniversary of the founding of the D.C. gay Catholic
group Defenders would be held together Sunday at St.
Margarets Episcopal Church at Connecticut and Florida
avenues, N.W. He said the anniversary commemorations
would be held immediately following the groups
regularly scheduled 6 p.m. Mass at St. Margarets Church.

White House to host Pride reception
The White House will host a reception to celebrate Pride
month on June 15, according to a White House ofcial.
The gatherings have taken place during each of the
three previous years of the Obama administration.
At each of the events so far, President Obama has
appeared with rst lady Michelle Obama to address
attendees, who have largely been made up of leaders
in the LGBT movement. Last year, Obama announced
his intent to certify the end of Dont Ask, Dont Tell in
a matter of weeks, not months.

Read this Patient Information before you start taking COMPLERA and each time you
get a rell. There may be new information. This information does not take the place of
talking to your healthcare provider about your medical condition or treatment.
What is the most important information I should know about COMPLERA?
COMPLERA can cause serious side effects, including:
1. Build-up of an acid in your blood (lactic acidosis). Lactic acidosis can happen in
some people who take COMPLERA or similar (nucleoside analogs) medicines. Lactic
acidosis is a serious medical emergency that can lead to death.
Lactic acidosis can be hard to identify early, because the symptoms could seem like
symptoms of other health problems. Call your healthcare provider right away if you
get any of the following symptoms which could be signs of lactic acidosis:
s feeling very weak or tired
s have unusual (not normal) muscle pain
s have trouble breathing
s have stomach pain with
- nausea (feel sick to your stomach)
- vomiting
s feel cold, especially in your arms and legs
s feel dizzy or lightheaded
s have a fast or irregular heartbeat
2. Severe liver problems. Severe liver problems can happen in people who take
COMPLERA or similar medicines. In some cases these liver problems can lead to death.
Your liver may become large (hepatomegaly) and you may develop fat in your liver
(steatosis) when you take COMPLERA.
Call your healthcare provider right away if you have any of the following symptoms
of liver problems:
s your skin or the white part of your eyes turns yellow (jaundice).
s dark tea-colored urine
s light-colored bowel movements (stools)
s loss of appetite for several days or longer
s nausea
s stomach pain
You may be more likely to get lactic acidosis or severe liver problems if you are
female, very overweight (obese), or have been taking COMPLERA or a similar
medicine containing nucleoside analogs for a long time.
3. Worsening of Hepatitis B infection. If you also have hepatitis B virus (HBV) infection
and you stop taking COMPLERA, your HBV infection may become worse (are-up). A
are-up is when your HBV infection suddenly returns in a worse way than before.
COMPLERA is not approved for the treatment of HBV, so you must discuss your HBV
therapy with your healthcare provider.
s Do not let your COMPLERA run out. Rell your prescription or talk to your healthcare
provider before your COMPLERA is all gone.
s Do not stop taking COMPLERA without rst talking to your healthcare provider.
s If you stop taking COMPLERA, your healthcare provider will need to check your health
often and do regular blood tests to check your HBV infection. Tell your healthcare
provider about any new or unusual symptoms you may have after you stop taking
COMPLERA.
What is COMPLERA?
COMPLERA is a prescription HIV (Human Immunodeciency Virus) medicine that:
s is used to treat HIV-1 in adults who have never taken HIV medicines before. HIV is the
virus that causes AIDS (Acquired Immunodeciency Syndrome).
s contains 3 medicines, (rilpivirine, emtricitabine, tenofovir disoproxil fumarate)
combined in one tablet. EMTRIVA and VIREAD are HIV-1 (human immunodeciency
virus) nucleoside analog reverse transcriptase inhibitors (NRTIs) and EDURANT is an
HIV-1 non-nucleoside analog reverse transcriptase inhibitor (NNRTI).
It is not known if COMPLERA is safe and effective in children under the age of 18 years.
COMPLERA may help:
s Reduce the amount of HIV in your blood. This is called your viral load.
s Increase the number of white blood cells called CD4+ (T) cells that help ght off
other infections.
Reducing the amount of HIV and increasing the CD4+ (T) cell count may improve your
immune system. This may reduce your risk of death or infections that can happen when
your immune system is weak (opportunistic infections).
COMPLERA does not cure HIV infections or AIDS.
s Always practice safer sex.
s Use latex or polyurethane condoms to lower the chance of sexual contact with any
body uids such as semen, vaginal secretions, or blood.
s Never re-use or share needles.
Ask your healthcare provider if you have any questions about how to prevent passing
HIV to other people.
Who should not take COMPLERA?
s Do not take COMPLERA if your HIV infection has been previously treated with
HIV medicines.
s Do not take COMPLERA if you are taking certain other medicines. For more
information about medicines that must not be taken with COMPLERA, see What
should I tell my healthcare provider before taking COMPLERA?
What should I tell my healthcare provider before taking COMPLERA?
Before you take COMPLERA, tell your healthcare provider if you:
s have liver problems, including hepatitis B or C virus infection
s have kidney problems
s have ever had a mental health problem
s have bone problems
s are pregnant or plan to become pregnant. It is not known if COMPLERA can harm
your unborn child
Pregnancy Registry. There is a pregnancy registry for women who take antiviral
medicines during pregnancy. Its purpose is to collect information about the health
of you and your baby. Talk to your healthcare provider about how you can take part
in this registry.
s are breast-feeding or plan to breast-feed. The Centers for Disease Control and
Prevention recommends that mothers with HIV not breastfeed because they can pass
the HIV through their milk to the baby. It is not known if COMPLERA can pass through
your breast milk and harm your baby. Talk to your healthcare provider about the best
way to feed your baby.
Tell your healthcare provider about all the medicines you take, including prescription
and nonprescription medicines, vitamins, and herbal supplements.
COMPLERA may affect the way other medicines work, and other medicines may
affect how COMPLERA works, and may cause serious side effects. If you take certain
medicines with COMPLERA, the amount of COMPLERA in your body may be too low and
it may not work to help control your HIV infection. The HIV virus in your body may become
resistant to COMPLERA or other HIV medicines that are like it.
Do not take COMPLERA if you also take these medicines:
s COMPLERA provides a complete treatment for HIV infection. Do not take other HIV
medicines with COMPLERA.

one that is listed above.
Know the medicines you take. Keep a list of your medicines and show it to your
healthcare provider and pharmacist when you get a new medicine. Your healthcare
provider and your pharmacist can tell you if you can take these medicines with
COMPLERA. Do not start any new medicines while you are taking COMPLERA without
rst talking with your healthcare provider or pharmacist. You can ask your healthcare
provider or pharmacist for a list of medicines that can interact with COMPLERA.
How should I take COMPLERA?
s Stay under the care of your healthcare provider during treatment with COMPLERA.
s Take COMPLERA exactly as your healthcare provider tells you to take it.
s Always take COMPLERA with a meal. Taking COMPLERA with a meal is important
to help get the right amount of medicine in your body. A protein drink does not
replace a meal.
s Do not change your dose or stop taking COMPLERA without rst talking with your
healthcare provider. See your healthcare provider regularly while taking COMPLERA.
s If you miss a dose of COMPLERA within 12 hours of the time you usually take it, take
your dose of COMPLERA with a meal as soon as possible. Then, take your next dose
of COMPLERA at the regularly scheduled time. If you miss a dose of COMPLERA by
more than 12 hours of the time you usually take it, wait and then take the next dose
of COMPLERA at the regularly scheduled time.
s Do not take more than your prescribed dose to make up for a missed dose.
s When your COMPLERA supply starts to run low, get more from your healthcare provider
or pharmacy. It is very important not to run out of COMPLERA. The amount of virus in
your blood may increase if the medicine is stopped for even a short time.
s If you take too much COMPLERA, contact your local poison control center or go to the
nearest hospital emergency room right away.
What are the possible side effects of COMPLERA?
COMPLERA may cause the following serious side effects, including:

s New or worse kidney problems can happen in some people who take COMPLERA.
If you have had kidney problems in the past or take other medicines that can cause
kidney problems, your healthcare provider may need to do blood tests to check your
kidneys during your treatment with COMPLERA.
s Depression or mood changes. Tell your healthcare provider right away if you have
any of the following symptoms:
- feeling sad or hopeless
- feeling anxious or restless

Read this Patient Information before you start taking COMPLERA and each time you
get a rell. There may be new information. This information does not take the place of
talking to your healthcare provider about your medical condition or treatment.
What is the most important information I should know about COMPLERA?
COMPLERA can cause serious side effects, including:
1. Build-up of an acid in your blood (lactic acidosis). Lactic acidosis can happen in
some people who take COMPLERA or similar (nucleoside analogs) medicines. Lactic
acidosis is a serious medical emergency that can lead to death.
Lactic acidosis can be hard to identify early, because the symptoms could seem like
symptoms of other health problems. Call your healthcare provider right away if you
get any of the following symptoms which could be signs of lactic acidosis:
s feeling very weak or tired
s have unusual (not normal) muscle pain
s have trouble breathing
s have stomach pain with
- nausea (feel sick to your stomach)
- vomiting
s feel cold, especially in your arms and legs
s feel dizzy or lightheaded
s have a fast or irregular heartbeat
2. Severe liver problems. Severe liver problems can happen in people who take
COMPLERA or similar medicines. In some cases these liver problems can lead to death.
Your liver may become large (hepatomegaly) and you may develop fat in your liver
(steatosis) when you take COMPLERA.
Call your healthcare provider right away if you have any of the following symptoms
of liver problems:
s your skin or the white part of your eyes turns yellow (jaundice).
s dark tea-colored urine
s light-colored bowel movements (stools)
s loss of appetite for several days or longer
s nausea
s stomach pain
You may be more likely to get lactic acidosis or severe liver problems if you are
female, very overweight (obese), or have been taking COMPLERA or a similar
medicine containing nucleoside analogs for a long time.
3. Worsening of Hepatitis B infection. If you also have hepatitis B virus (HBV) infection
and you stop taking COMPLERA, your HBV infection may become worse (are-up). A
are-up is when your HBV infection suddenly returns in a worse way than before.
COMPLERA is not approved for the treatment of HBV, so you must discuss your HBV
therapy with your healthcare provider.
s Do not let your COMPLERA run out. Rell your prescription or talk to your healthcare
provider before your COMPLERA is all gone.
s Do not stop taking COMPLERA without rst talking to your healthcare provider.
s If you stop taking COMPLERA, your healthcare provider will need to check your health
often and do regular blood tests to check your HBV infection. Tell your healthcare
provider about any new or unusual symptoms you may have after you stop taking
COMPLERA.
What is COMPLERA?
COMPLERA is a prescription HIV (Human Immunodeciency Virus) medicine that:
s is used to treat HIV-1 in adults who have never taken HIV medicines before. HIV is the
virus that causes AIDS (Acquired Immunodeciency Syndrome).
s contains 3 medicines, (rilpivirine, emtricitabine, tenofovir disoproxil fumarate)
combined in one tablet. EMTRIVA and VIREAD are HIV-1 (human immunodeciency
virus) nucleoside analog reverse transcriptase inhibitors (NRTIs) and EDURANT is an
HIV-1 non-nucleoside analog reverse transcriptase inhibitor (NNRTI).
It is not known if COMPLERA is safe and effective in children under the age of 18 years.
COMPLERA may help:
s Reduce the amount of HIV in your blood. This is called your viral load.
s Increase the number of white blood cells called CD4+ (T) cells that help ght off
other infections.
Reducing the amount of HIV and increasing the CD4+ (T) cell count may improve your
immune system. This may reduce your risk of death or infections that can happen when
your immune system is weak (opportunistic infections).
COMPLERA does not cure HIV infections or AIDS.
s Always practice safer sex.
s Use latex or polyurethane condoms to lower the chance of sexual contact with any
body uids such as semen, vaginal secretions, or blood.
s Never re-use or share needles.
Ask your healthcare provider if you have any questions about how to prevent passing
HIV to other people.
Who should not take COMPLERA?
s Do not take COMPLERA if your HIV infection has been previously treated with
HIV medicines.
s Do not take COMPLERA if you are taking certain other medicines. For more

What should I tell my healthcare provider before taking COMPLERA?
Before you take COMPLERA, tell your healthcare provider if you:
s have liver problems, including hepatitis B or C virus infection
s have kidney problems
s have ever had a mental health problem
s have bone problems
s are pregnant or plan to become pregnant. It is not known if COMPLERA can harm
your unborn child
Pregnancy Registry. There is a pregnancy registry for women who take antiviral
medicines during pregnancy. Its purpose is to collect information about the health
of you and your baby. Talk to your healthcare provider about how you can take part
in this registry.
s are breast-feeding or plan to breast-feed. The Centers for Disease Control and
Prevention recommends that mothers with HIV not breastfeed because they can pass
the HIV through their milk to the baby. It is not known if COMPLERA can pass through
your breast milk and harm your baby. Talk to your healthcare provider about the best
way to feed your baby.
Tell your healthcare provider about all the medicines you take, including prescription
and nonprescription medicines, vitamins, and herbal supplements.
COMPLERA may affect the way other medicines work, and other medicines may
affect how COMPLERA works, and may cause serious side effects. If you take certain
medicines with COMPLERA, the amount of COMPLERA in your body may be too low and
it may not work to help control your HIV infection. The HIV virus in your body may become
resistant to COMPLERA or other HIV medicines that are like it.

How should I take COMPLERA?
s Stay under the care of your healthcare provider during treatment with COMPLERA.
s Take COMPLERA exactly as your healthcare provider tells you to take it.
s Always take COMPLERA with a meal. Taking COMPLERA with a meal is important
to help get the right amount of medicine in your body. A protein drink does not
replace a meal.
s Do not change your dose or stop taking COMPLERA without rst talking with your
healthcare provider. See your healthcare provider regularly while taking COMPLERA.
s If you miss a dose of COMPLERA within 12 hours of the time you usually take it, take
your dose of COMPLERA with a meal as soon as possible. Then, take your next dose
of COMPLERA at the regularly scheduled time. If you miss a dose of COMPLERA by
more than 12 hours of the time you usually take it, wait and then take the next dose
of COMPLERA at the regularly scheduled time.
s Do not take more than your prescribed dose to make up for a missed dose.
s When your COMPLERA supply starts to run low, get more from your healthcare provider
or pharmacy. It is very important not to run out of COMPLERA. The amount of virus in
your blood may increase if the medicine is stopped for even a short time.
s If you take too much COMPLERA, contact your local poison control center or go to the
nearest hospital emergency room right away.

Activists join police to talk
crime, prevention

Nearly 150 people gathered at the
Westminster Presbyterian Church in
Southwest last weekend for the sixth
annual Capital TransPride.
Author Everett Maroon delivered the
keynote address; while Helping Individual
Prostitutes Survive executive director
Cyndee Clay, Rainbow History Fund founder
Mark Meinke and TransPride founder
SaVanna Wanzer were honored for their
work on behalf of trans Washingtonians.
Transgender Health Empowerment, the
Latino History Project, the Gay and Lesbian
Activists Alliance and Equality Maryland
were among the more than 20 organizations
that co-sponsored the event.
We reached a much larger audience
than we did last year, said Capital
TransPride Co-Chair Holly Goldmann, who
is also a D.C. LGBT Community Center
board member.
Former Sexual Minority Youth Assistance
League member Terra Moore, Gays and
Lesbians Opposing Violence vice chair
Hassan Naveed, Jason Terry of the D.C.
Trans Coalition, trans activist Ruby Corado
and Ofcer Juanita Foreman of the
Metropolitan Police Departments Gay and
Lesbian Liaison Unit discussed anti-trans
violence in the District on a panel that former
TransPride chair Danielle King moderated.
Corado, whose community center for
LGBT Latinos in Columbia Heights is slated
to open June 6, said the situation for trans
Washingtonians has improved over the last
decade. Challenges, however, remain.
These days we do have the ability that
we can be ourselves and we can actually
function during the day, Corado said.
We come out in different neighborhoods
in this city. There are people who are really
willing to embrace us and have done so
well. However, we still have other people
that are not quite receptive of the idea of
a trans person being themselves.
MPD statistics show that there were 10
reported bias-related crimes based on
gender identity and expression in the city
in 2010, compared to ve in 2009 and four
in 2008.
A National Coalition of Anti-Violence
Programs report indicates that 70 percent
of anti-LGBT murder victims in 2010
were people of color and 44 percent
of them were trans women. The NCAVP
study further noted that trans people
and people of color are twice as likely
to experience violence or discrimination
than non-trans white people. The report
also indicates that trans people of color
are more than twice as likely to experience
discrimination than whites.
Lashay Mcleans murder last July in
Northeast and the subsequent spate
of anti-trans violence that included an
off-duty District police ofcer allegedly
shooting three trans women and two male
friends while they sat in a car underscores
the problem. Prosecutors charged Gary
Niles Montgomery with second-degree
murder while armed in connection with
the stabbing death of Deoni Jones at a
Northeast Metro bus stop on Feb. 2.
Its time we look at ourselves and come
together, said Corado in response to
Kings question about what trans women
of color can do to curb violence directed
against them. You really need to take an
active role because until we become part
of the solution, you cant expect someone
else to do it for us.
Corado and several other panelists were
quick to applaud GLLU and the MPDs
efforts over the last year to combat anti-
trans violence in the city. Terry described
D.C. Mayor Vincent Gray as the most
trans-friendly administration the city has
ever seen, but he stressed that City Hall
has not done enough to ensure trans
Washingtonians safety.
We have to get serious in addressing
biased policing in this city, Terry said.
Terry also cited Police Chief Cathy Laniers
comments during a WTOP interview in
February that trans people need to do more
to keep themselves safe as another example
of what he described as blaming the victim.

stressed. Its not your fault.

Unanimous ruling allows
couples to divorce

The Maryland Court of Appeals last
week unanimously ruled that same-sex
couples who were legally married in other
jurisdictions can get divorced in the state.
The 7-0 decision comes after Maryland
resident Jessica Port and Virginia Anne
Cowan of the District of Columbia
appealed a Prince Georges County
trial judges 2010 denial of their divorce
petition. The women married in California
in October 2008, less than a month before
the states voters approved Proposition 8
that banned nuptials for gays and lesbians.
Port and Cowan separated eight months
later and led for divorce while they both
lived in Maryland.
Attorney General Douglas Gansler
opined in February 2010 that the state
could recognize same-sex marriages that
were legally performed in the District of
Columbia and other jurisdictions. Gov.
Martin OMalley subsequently ordered
state agencies to recognize such unions.
A valid out-of-state same-sex marriage
should be treated by Maryland courts as
worthy of divorce, according to applicable
statutes, reported cases and court rules of
this state, read the decision.
OMalley welcomed the 21-page ruling.
Todays unanimous decision by the
Maryland Court of Appeals conrms
that the policy of recognizing out-of-
state same-sex marriages that we have
implemented in the Executive Branch is
valid and consistent with the law, he said
in a statement. To treat families differently
under the law because they happen to
be led by gay or lesbian couples is not
right or just. Todays decision is another
step forward in our efforts to ensure that
every child is protected equally under the
law. As a free and diverse people, the
way forward is always to be found through
greater respect for the equal rights of all;
for the human dignity of all.
Michele Zavos, a lawyer with Zavos
Juncker Law Group who represented Port,
applauded the decision.
Were all enormously excited because
this decision establishes marriages
between same-sex couples that are
valid in another jurisdiction are valid in
Maryland, she said.
The National Center for Lesbian Rights
and Lambda Legal served as co-counsel
on the case.
The decision could not be better for
our community, said NCLR Legal Director
Shannon Minter. The court accepted all
of the arguments we presented. Although
the holding is specically about divorce,
the analysis would apply to any marital
benet or protection.
The courts ruling comes less than three
months after OMalley signed the states
marriage equality bill into law.
Rhode Island Gov. Lincoln Chafee
on Monday signed an executive order
recognizing out-of-state same-sex
marriages. Then-New York Gov. David
Paterson in 2008 directed state agencies to
recognize the nuptials of gays and lesbians
who legally wed in other jurisdictions.
Maryland voters will likely vote on a
referendum in November that would bar
marriage for same-sex couples. Both the
plaintiffs lawyers and legal observers noted
that the ban on nuptials for gays and lesbians
would not impact the courts decision.
One reason this decision is so
important is that the courts ruling will
not be changed even if, in the worst case
scenario, the new marriage equality law
were to be repeated in a referendum
vote, said Minter. Valid marriages from
other states would still be recognized in
Maryland. Because same-sex couples can
marry right next door in D.C., this provides
powerful protection.

Marvel announces nuptials for gay superhero
NEW YORK Northstar, a character in Marvel Comics Astonishing X-Men series
will marry his long-time boyfriend Kyle in June, according to the Hufngton Post.
While Northstar introduced in 1979 isnt the publishers only gay character,
he was one of the rst, coming out in 1992. The character has been at the center
of controversy for many years since coming out, but has helped the comics stay
at the forefront of cultural change with plotlines that included the ying mutant
adopting a baby with AIDS and becoming a teacher.
When gay marriage became legal in New York State, it raised a question, since
most of our heroes reside in that state, said Marvel editor Axel Alonso. How
would Northstar, the rst openly gay character in comics, respond to this new
development?
The announcement was made Monday on ABCs morning talk show, The
View, drawing praise from host Whoopi Goldberg.
12 NFL players say theyd welcome gay teammate
LOS ANGELES Outsports, a gay sports-focused website, released the names
of 12 professional football players that say they would welcome a gay teammate.
Rookies Robert Grifn III, Trent Richardson, Coby Fleener and others joined
revered retired veterans Jevon Kearse, Ahman Green and Eddie George in calling
for respect and acceptance in the locker room.
In the game of football, its like a war out there, Kearse told the site. Once
you get out on the eld, all that stuff is to the side. Youre on my side. I played in
the NFL for 11 years, Im sure there were at least one or two guys along the line
that were gay.
Though several players have come out in retirement, the NFL has never had an
openly gay player.
Univ. of Penn to offset tax burden on gay couples
PHILADELPHIA University of Pennsylvania will join employers like Google,
Apple and Microsoft in providing to employees an offset for the additional tax
burden federal and state law imposes on same-sex spousal benets.
The university announced this week, through its human resources site, that it
will provide up to $125 a month to offset the taxes that employees must pay on
benets for same-sex spouses that are not imposed on benets for opposite-sex
spouses. Penn joins colleges like Yale and Bowdoin in implementing this practice
to compensate for the tax law.
Polls show growing acceptance of marriage
NEW YORK Despite fears that the presidents backing of extending marriage
rights to same-sex couples would produce a backlash, recent polls are showing no
slow-down in the growth in acceptance of the nuptials.
An NBC/Wall Street Journal poll shows that the presidents announcement does
not affect the vote of 62 percent of respondents, however, 17 percent say they are
more likely to vote for him, as opposed to 20 percent who say they are less. Meanwhile
54 percent would back a marriage law in their state for same-sex couples.
The NBC/Wall Street Journal poll is supported by a similar poll this week
released by ABC/Washington Post that showed the greatest gap between those
who support same-sex marriage (53 percent) and those who support banning
nuptials (47 percent).
Ravi guilty of bias crime in
webcam spying incident

A New Jersey judge Monday handed
down a sentence of 30 days in jail for
the former Rutgers University student
convicted of committing a bias crime for
using a webcam to spy on a dorm room
tryst between his gay roommate Tyler
Clementi and Clementis boyfriend.
Clementi took his own life days later
by jumping off the George Washington
Bridge in September 2010, creating an
uproar among gay activists and attracting
international media attention over the
issue of anti-gay bullying and harassment.
Some claimed the action by defendant
Dharun Ravi, 20, was responsible for
Clementis suicide. But Ravis attorney
argued during the trial in March and
Middlesex County, N.J., Superior Court
Judge Glenn Berman said in court on
Monday that Ravi should not be held
responsible for Clementis death.
I do not believe he hated Tyler
Clementi, Berman said in explaining
his sentence. He had no reason to, but
I do believe he acted out of colossal
insensitivity.
Berman said the bias crime to which
Ravi was convicted is not the same as a
hate crime. He called the sentence he
imposed measured and balanced.
He said he will recommend to U.S.
immigration authorities that Ravi not be
deported upon the completion of his jail
sentence, but said immigration ofcials
rather than he would make the nal
decision on that issue.
Ravi, who was born in India, came to the
U.S. as a child. His mother told the court he
no longer speaks his native language and
was raised as an American. Ravi obtained
permanent resident status but is not a U.S.
citizen. Under U.S. immigration law, he is
subject to deportation for a felony conviction.
A jury convicted Ravi on several felony
counts, including invasion of privacy,
bias intimidation, witness tampering and
hindering efforts by police to investigate
the case. He faced a possible sentence of
10 years in prison.
Middlesex County prosecutor Julia
McClure told the judge Ravi has shown
no remorse since his conviction. She said
all of Ravis actions toward Clementi were
planned, they were purposeful and they
were malicious, disputing claims by the
defense that Ravi had merely committed
a youthful prank.
In addition to 30 days in a county jail,
Berman sentenced Ravi to three years
of probation, 300 hours of community
service, and a total of $11,900 in nes
and assessments. He also ordered Ravi to
undergo counseling for cyber bullying and
education on alternate lifestyles.
The sentence came at the end of a
two-hour hearing that included emotional
statements from Clementis mother, father,
and brother and both parents of Ravi, all of
whom struggled to hold back tears.
Jane Clementi, Tylers mother, told
the court Ravi appeared uninterested
in becoming friends with her son from
the time she met him when she and her
husband helped Tyler move into his
Rutgers dorm room. She said she believed
Ravi chose not to be more welcoming to
her son in the ensuing weeks because he
learned her son was gay.
Ravis mother told the judge her son isnt
a hater and has never hated anyone,
saying he has suffered immensely in the
time since his 2010 arrest in connection
with the case.
In the months leading up to Mondays
sentencing hearing, some gay activists
and gay bloggers joined Indian-American
groups in speaking out for leniency for
Ravi, saying a sentence as long as 10 years
would be an injustice.
New York gay attorney Bill Dobbs, who
has argued that hate crimes laws violate
First Amendment rights of free speech,
was among those who called for a less
severe sentence for Ravi.
Bermans sentence of 30 days came as
a surprise to some court observers, who
noted that the judge spoke harshly of
Ravis action in a statement immediately
prior to delivering the sentence.

Advocates decry
move; White House
threatens veto

The U.S. House last week passed major
defense budget legislation aimed at
authorizing funds for the Pentagon that was
inclusive of language restricting LGBT rights.
By a vote of 299-120, the Republican-
controlled House approved its version of
the scal year 2013 defense authorization
bill. The $642 billion package aims to
provide funding for military programs and
pay for service members, but includes
anti-gay provisions that were adopted by
the House Armed Services Committee
during its markup of the legislation.
One provision in the bill, the conscience
protections, is for military personnel and
chaplains who object to homosexuality.
Under the language, service members
could harass gay colleagues and chaplains
could discriminate against service
members by religion, gender, sexual
orientation or race.
Aubrey Sarvis, executive director of the
Servicemembers Legal Defense Network,
said hes disappointed the language
was included in the legislation passed by
the House.
The fact of the matter is, there are
already in place adequate protections
for chaplains and service members in this
area, Sarvis said. This language weakens
implementation of Dont Ask, Dont Tell
repeal, which Americans support and
which our nations military leaders have
said is being implemented smoothly.
Another provision in the bill would
prohibit same-sex couples from holding
marriage ceremonies on Defense
Department property. The Pentagon has
previously issued guidance saying such
facilities should be available on a sexual
orientation neutral basis.
Sarvis also objected to this language in
the legislation.
This is yet another attempt by a few
opponents of military equality who are
looking to turn the clock back on progress
and relegate gay and lesbian service
members to second-class status, Sarvis said.
The White House Ofce of Management &
Budget issued a Statement of Administration
Policy earlier this week objecting to the anti-
gay provisions, calling language barring
same-sex couples from marrying on military
bases potentially unconstitutional. The
White House issued a veto threat on the
legislation based on certain provisions in
the bill, included provisions related to the
detention of detainees, but stopped short
of explicitly stating the anti-gay language
merited a veto.
The Senate has yet to take action on its
version of defense authorization legislation
for the upcoming scal year. Next week,
the Senate Armed Forces Committee will
begin its markup. Differences between
the House and Senate versions will be
addressed in conference committee later
this year.
Similar anti-gay language was included
last year in the previous House version
of the defense authorization bill. The
language was ultimately removed in
conference committee before each
chamber voted again to approve the nal
version of the legislation.

The Justice Department made nal a
rule last week to prevent sexual abuse in
federal prisons that included provisions
aimed at providing better protection for
LGBT inmates.
The rule, the rst-ever federal effort
to set standards at all jail facilities, is
in accordance with the Prison Rape
Elimination Act of 2003. It was rst
proposed last year.
According to a statement from the
Justice Department, the standards
require, among other things, that facilities
try to prevent sexual violence in prison by
incorporating the unique vulnerabilities
of LGBT people as well as intersex and
gender nonconforming inmates into
training and screening protocols.
Sexual violence, against any victim, is
an assault on human dignity and an affront
to American values, President Obama
wrote in a memorandum accompanying
the announcement. The Prison Rape
Elimination Act of 2003 (PREA) was
enacted with bipartisan support and
established a zero tolerance standard for
rape in prisons in the United States.
The standards include specialized
training for prison staff and screenings
in detention settings to determine if
LGBT inmates are at higher risk for being
targeted for sexual abuse. The new rule
has particular impact on transgender
inmates. Agencies must train security staff
on respectful searches of transgender
inmates; transgender people cant be
assigned to a male or female facility based
solely on their anatomy; and transgender
inmates will be given the opportunity to
shower separately from other inmates.
LGBT advocates hailed the codication
of the rule for extending new protections
for LGBT inmates who are seen as being
more vulnerable to sexual violence while
in prison. According to the National
Center for Transgender Equality, one in
three former transgender inmates reports
being sexually abused.
Rea Carey, executive director of the
National Gay & Lesbian Task Force, said
no one and I mean no one should be
subjected to the pain and indignity of rape
even individuals who are incarcerated.
By adopting these national standards to
prevent, detect and respond to prison rape,
the federal government put its foot down
and said no more, Carey said. Lives
are literally on the line, and these historic
standards will help combat this terrible
epidemic and lift our common humanity.
Mara Keisling, executive director of the
National Center for Transgender Equality, also
called the nalization of the rule signicant.
We have an obligation as civilized
people to protect the people we
incarcerate, Keisling said. That has
always been an American promise, but
one we have barely tried to keep. These
new standards, if fully implemented, have
the potential to help us keep that promise
at least in terms of sexual assault.
The memorandum says the rule applies
to facilities administered by agencies
other than the Justice Department.
Such facilities would likely include
immigration detention facilities run by
private companies or the Department
of Homeland Security. Agencies with
federal connement facilities not subject
to the Justice Departments nal rule
must propose within 120 days any rules
or procedures necessary to satisfy the
requirements of the law, and make nal
any such rules or procedures within 240
days of their proposal.
Peter Boogard, a DHS spokesperson,
said his department fully embraces the
law and looks forward to implementing
the provisions under the new rule.
The regulations will build on the substantial
improvements we have made to agency
policy and procedures to prevent, detect
and respond to sexual abuse in immigration
detention, Boogard said. DHS will move
swiftly to promulgate these regulations and
will work with the attorney general and others
to ensure that the regulations satisfy the
requirements of the statute.
Mary Meg McCarthy, executive director
of Heartland Alliances National Immigrant
Justice Center, urged the Obama
administration to monitor DHS closely to
ensure the department implements the
rule in a timely manner.
The U.S. government has nally
acknowledged that immigrant detainees
must be protected from sexual violence
while in immigration custody, said
McCarthy said. We wish the regulations
applied to immigration detention facilities
immediately. Instead, DHS has another year to
implement a law that has been on the books
for nearly a decade. Some of the individual
provisions announced today are evidence of
the Obama administrations commitment to
protecting immigrants from abuse, particularly
those who are vulnerable because of their
sexual orientation or sexual identity.

Resolution comes after
lawmakers rejected gay
prosecutor for judgeship

The Virginia Young Democrats on
Tuesday announced that its Executive
Committee passed a resolution in
support of marriage rights for same-sex
couples.
The statement refers to marriage as a
powerful and important afrmation of
love and commitment and a source
of social support and recognition that
provides invaluable legal protections
to Virginia families. The resolution also
specically refers to the U.S. Supreme
Courts 1967 Loving v. Virginia decision
that struck down the ban on interracial
marriages.
It also calls upon the state Democratic
Party to add marriage rights for same-sex
couples to its 2012 platform.
We should not live in a country
or commonwealth that discriminates
against someone or limits their rights
because of who they are. said VAYD
President Isaac Sarver.
Gay state Sen. Adam Ebbin
(D-Arlington) welcomed the groups
support of marriage rights for same-sex
couples.
Im glad that it is on their radar, he
told the Blade.
The VAYD announced its support of
marriage rights for same-sex couples
three days after the National Association
for the Advancement of Colored Peoples
National Board of Directors issued a
similar endorsement during its quarterly
meeting in Miami. Sarver told the Blade
that his organizations position follows
what he described as the leadership
that President Barack Obama and Vice
President Joe Biden showed when they
publicly endorsed nuptials for gays and
lesbians earlier this month.
He further stressed that the resolution
could bolster efforts to overturn the
constitutional amendment that denes
marriage as between a man and a woman
that Virginia voters approved in 2006.
As more and more millennials
are aging and starting to vote more
frequently, the opinion is shifting, said
Sarver. Our generation has stronger
views on marriage equality than
preceding generations so I do think this
will be the start of a political shift.
The VAYD resolution also comes
against the backdrop of the ongoing
controversy over the House of Delegates
rejection of gay Richmond prosecutor
Tracy Thorne-Beglands nomination to
the General District Court. Delegate Bob
Marshall (R-Prince William County) said
the former Navy pilot misrepresented
himself by not disclosing his sexual
orientation when he enlisted in 1992the
year before then-President Bill Clinton
signed Dont Ask, Dont Tell into law.
The Richmond Times-Dispatch
reported on Tuesday that the six
Richmond Circuit Court judges could
move to appoint Thorne-Begland on
an interim basis because lawmakers did
not ll the vacancy. State Sen. A. Donald
McEachin (D-Henrico,) who sponsored
Thorne-Beglands nomination in the state
Senate, told the Blade on Monday that the
former Equality Virginia board member
continues to decline to comment on the
vote and the subsequent fallout.
When asked about whether the
controversy played a role in the resolution,
VAYD spokesperson Jason Lewis accused
Marshall of essentially using Thorne-
Beglands military service against him to
keep the prosecutor off the bench.
He [Thorne-Begland] was in a position
where he wasnt ruling on signicant
constitutional matters, he said.

More than 40 people attended a
fundraiser for gay presumptive New York
City Council candidate Corey Johnson in
Washington, D.C., on Tuesday night.
Gay Reps. Barney Frank (D-Mass.)
and Jared Polis (D-Colo.) co-chaired the
event that took place at gay Democratic
lobbyist Steve Elmendorfs home. Virginia
state Sen. Adam Ebbin (D-Arlington) and
columnist and Democratic strategist Karl
Frisch were among those who attended.
It was a real moving show of support
for me from friends and allies down here
in the District that Ive been able to work
with over the years, Johnson, 30, told the
Blade on Wednesday.
Elmendorf praised the likely candidate.
Corey is a close personal friend and I
offered to help him because I admire the
guts he showed when he rst came out as
a high school quarterback; the dedication
he has shown to the LGBT community and
his passion for public service, he said in
an e-mail. I have met a lot of candidates
during my time in politics and government
and he is one of the best.
The former Gay and Lesbian Alliance
Against Defamation staffer has not
ofcially declared his candidacy, but
he launched an exploratory committee
in early April. Three of Johnsons likely
challengers in the 2013 Democratic
primarylawyer Yetta Kurland Manhattan
Community Board 2 Chair Brad Hoylman
and Andrew Bermanare gay.
He would succeed lesbian New York City
Council Speaker Christine Quinn if elected.
It says a lot on how far weve come,
said Johnson when asked about the fact
that all three of his likely opponents are
gay. In many places in this country there
arent LGBT elected ofcials. ... In New
York City things have progressed to such
a point that I believe in certain parts of
the city, voters no longer look at what a
persons sexual orientation is, they look
at their history, their track record, their
biography and what their vision is for the
district. I believe all of us will be judged
on that, so I think it shows tremendous
progress that weve gotten to that point.
Johnson, who has chaired Manhattans
Community Board 4 since last July,
attended the D.C. fundraiser three days
after Quinn married her long-time partner
Kim Catullo.
He acknowledged that he does not
always agree with the likely 2013 mayoral
candidate, but Johnson said that she and
her predecessor, gay New York State Sen.
Tom Duane (D-Manhattan) are well known
outside the district. He also pointed
out that he has publicly disagreed with
Mayor Michael Bloomberg over the New
York Police Departments controversial
stop and frisk policy, a law that requires
contractors that receive at least $1 million
in tax breaks and low-interest nancing to
pay their employees at $10 an hour and
a measure that would provide paid sick
leave to New Yorkers who dont already
receive it from their employers.
Johnson also described Bloombergs
decision to appeal a New York State
Supreme Court judges 2005 decision that
struck down a ban on nuptials for gays and
lesbians as disappointing. The mayor has
subsequently backed marriage rights for
same-sex couples.
Im always happy to welcome anyone
that wants to come to our side and help
ght for our rights, said Johnson. The
mayor has done that most recently and
hes someone that we should use as an ally
as we move forward.
Johnson rst rose to prominence
in 2000 when the New York Times
published a story about him playing on
his Massachusetts high schools football
team. He worked as former New York City
Public Advocate Mark Greens political
director during his unsuccessful 2006 state
attorney general campaign. Johnson has
also written for the gay blog Towleroad.
Since I was 17 years old, Ive always
been engaged and involved in political
advocacy and working for non-prots to try
to affect real change in the world, he said.
Johnson said he does not have any
higher political aspirations if elected to
the City Council.
My goal is just to be on the City
Council, he said. My sole focus is to be
elected to the City Council and be the best
Council member possible in the West Side
of Manhattan with all the neighborhoods
that encompass this district.

N.Y. ofcial not likely to

All eyes will be on one of the nations
largest publicly traded companies next
week when shareholders will vote on
whether the company should make
LGBT protections part of its formal non-
discrimination policy.
At a meeting set for May 30 in Dallas,
shareholders for the ExxonMobil Corp.
will vote on a resolution to include sexual
orientation and gender identity in the
equal employment opportunity policy for
its estimated 82,000 workers a change
the company has resisted.
The resolution is being put before
shareholders by New York State
Comptroller Thomas DiNapoli. Hes
trustee of the New York State Common
Retirement Fund, which owns more than
16 million shares of ExxonMobil at an
estimated market value of $1.3 billion.
In an interview with the Washington
Blade, DiNapoli said he introduced the
resolution because of the large investment
the New York State Common Retirement
Fund has in ExxonMobil. In the past three
years, DiNapoli has reached agreements
with 27 companies to adopt new non-
discrimination policies.
By ExxonMobil not having a clear policy
based on sexual orientation and gender
identity, it really leaves the corporation to
not getting access to the best talent thats
available, DiNapoli said. Were looking
at it very much from the point of view of
shareholding and wanting our companies
to do very well, and we think that this lack of
addressing this issue of discrimination is an
impediment to ExxonMobil getting the best
performance that will benet our shares.
ExxonMobil hasnt included protections
for LGBT workers in its equal employment
opportunity policy nor has it offered
domestic partnership benets for
employees with same-sex partners since
the company was created as a result of the
merger between Exxon and Mobil in 1999.
Mobil protected employees on the basis
of sexual orientation and offered domestic
partner benets prior to the merger, but
Exxon didnt. Once the companies joined,
the sexual orientation protections were
rescinded and new employees were barred
from receiving domestic partner benets.
A vote on reinstating domestic partner
benets within the company wont
take place on May 30 because no such
resolution has been proposed.
LGBT advocates are pushing for
ExxonMobil shareholders to adopt a more
LGBT-friendly policy at the shareholders
meeting next week.
Tico Almeida, president of Freedom to
Work, called on all private companies like
ExxonMobil to adopt LGBT-inclusive non-
discrimination policies because theyre
morally right and good for business.
Non-discrimination policies improve
worker productivity, worker retention,
worker recruitment and increase prots
and thats why a vast majority of Fortune
500 companies have adopted LGBT
non-discrimination rules, and thats why
its so jarring that ExxonMobil continues
to be such an outlier with such outdated
policies, Almeida said.
Almeida discounted the importance of
having a shareholder vote on whether to
adopt the policy and said the board should
skip the vote and on its own accord make
LGBT protections part of the companys
equal employment opportunity policy.
One of the chief advocates of
an executive order barring federal
contractors from discriminating against
LGBT workers, Almeida said the situation
with ExxonMobil also speaks to the need
for the Obama administration to pursue
administrative action against workplace
discrimination. The White House
announced last month it wouldnt at this
time take such action.
As taxpayers, we have a right to
demand that companies that prot from
our taxpayer money do not discriminate
against LGBT Americans, Almeida said.
It is our money as American citizens, and
we should exercise that right because
LGBT discrimination is not only morally
wrong, its inefcient.
According to Freedom to Work,
ExxonMobil has raked in more than $1 billion
in federal contracts over the course of the last
decade. In the last scal year, ExxonMobil
won $158 million in federal contracts.
But Almeida is taking the matter a
step further and saying the White House
should call on ExxonMobil to adopt the
LGBT protections as part of its policy.
Almeida said hes had conversations with
White House staff on this matter.
As evidence that the administration has
promised to educate companies on the
need for non-discrimination protections,
Almeida pointed to a news conference on
the day after the White House announced
it wouldnt issue the executive order for
federal contractors.
During the brieng, White House
press secretary Jay Carney said the
administration was committed to directly
engaging with and educating all sectors
of the business community from major
corporations to contractors to small
business and raising public awareness
about the human and nancial costs of
discrimination in the work force.
Almeida said, We are urging them to
take a strong stand in the next week or
two to push ExxonMobil to accept the
New York State shareholder resolution,
which is a promise that Jay Carney made
at that press brieng.
The White House didnt respond to
a request for comment on the call for
ExxonMobil to add non-discrimination
protections as part of its policy.
Additionally, Freedom to Work set
up an online petition at Change.org to
encourage ExxonMobil to update its
policy. As of early Tuesday, the petition
had 200 signatures.
The corporation ExxonMobil takes
millions of dollars in American taxpayers
hard-earned dollars every year through
federal contracts, but Exxons corporate
bosses refuse to follow American values
like judging their employees based on
their talent and hard work rather than
whom they love, the petition letter states.
Cece Cox, CEO of Resource Center
Dallas, a local LGBT and HIV/AIDS
organization, said she wants to see the
Dallas-based company change its policy
because the company operates in close
proximity of her organization.
Its the only remaining Fortune 10
company that doesnt have an inclusive
policy of sexual orientation, and theyre
right here in our backyard, Cox said. As
our neighbors, we would like to encourage
and be in conversation with ExxonMobil
about this issue.
Cox said the Resource Center has
contacted ExxonMobils vice president
of human resources, M.A. Farrant, to
encourage the company to adopt an
LGBT-inclusive policy and sent a letter to
Marilyn Carlson Nelson, an ExxonMobil
board member and CEO of Carlson
Companies whom they think may be
amendable to the resolution because she
wrote an op-ed against the proposed anti-
gay amendment in Minnesota.
The company has sought to block the
vote on adopting an LGBT-inclusive non-
discrimination policy from taking place.
The companys board had asked the
Securities & Exchange Commission to
block the resolution from coming before
shareholders, but the agency rejected the
request in March.
According to ExxonMobil, the company
already has protections for LGBT workers.
An ExxonMobil spokesperson referred to
protections based on sexual orientation and
gender identity that are already included in
the employment policies and practices page
on the companys website, which specically
states the company has a zero-tolerance
policy for discrimination based on sexual
orientation or gender identity.
A letter dated Jan. 20, from James
Parsons, ExxonMobils coordinator
for corporate securities and nance,
suggests this policy statement is sufcient
protection for LGBT employees.

the following year. He noted that Mildred
Loving herself spoke out in support of
extending marriage rights to same-sex
couples before she died.
We want to be on the record that the
NAACP now rmly opposes all efforts to
restrict marriage equality, said Jealous.
We will oppose threats to the Fourteenth
Amendment guarantee of equal rights
under the law in any state where this issue
is raised.
Jealous dismissed reports that at least
two board members voted against the
marriage resolution. Roslyn Brock, chair of
the NAACP National Board of Directors,
said members had an open, honest and
candid conversation about the issue
during executive sessions.
The conversation was dispassionate,
it was respectful and it embraced and
respected the views of all the members
who sat around the table, she said.
This is not a religious issue or a moral
issue for the NAACP. That is not the role
of the NAACP. On the constitutionality of
the issue, the NAACPs National Board
of Directors voted overwhelmingly to
support this issue.
Brock conceded that there are board
members and other NAACP members whose
positions on marriage continue to evolve.
This conversation is one, as President
Jealous has stated, is taking place or has
taken place across the nation, she said.
We will work together with our units and
with our board to have the courageous
conversations that are necessary around
this issue.
A small group of black pastors
denounced the NAACPs move.
The NAACP has abandoned its
historic responsibility to speak for and
safeguard the civil rights movement, said
William Owens, president of the Coalition
of African-American Pastors. We who
marched with Rev. King did not march one
inch or one mile to promote same-sex
marriage.
The NAACPs endorsement of marriage
rights for same-sex couples comes less
than two weeks after North Carolina voters
approved a constitutional amendment
that denes marriage as between a
man and a woman. Dr. William Barber II,
president of the North Carolina NAACP,
was among those who spoke out against
the ballot measure before it passed by a
61-39 percent margin.
President Barack Obama on May 9
publicly backed the issue for the rst time
during a White House interview with ABC
News.
For the black community, the president
of the United States is as close to Martin
Luther King in terms of moral leadership,
said Sharon Lettman-Hicks, executive
director of the National Black Justice
Coalition, in response to a question about
whether Obamas support of marriage
rights for same-sex couples prompted the
NAACPs position. Its not just amazing
that we have a black president but that
he exemplies exceptional leadership.
From a space of cultural connection
more than anything else, the president
stood up beyond popularity, beyond the
norm, beyond status quo and took the
courageous step on behalf of the LGBT
community that many would have seen as
a political risk. I see it as nothing less than
courageous leadership.
Maryland Gov. Martin OMalley in
March signed a bill that would allow same-
sex couples to marry, but state voters will
likely face a November ballot referendum
that would overturn the law that is slated
to take effect on Jan. 1.
Fifty-two percent of respondents who
participated in a Marylanders for Marriage
Equality poll in March said they would
vote to preserve the marriage law in the
likely ballot measure.
Jealous stressed during the news
conference that civil rights organizations
remain united against the Maryland
referendum and other similar measures
across the country.
Ballot measures like that on the ballot
here in Maryland are intended to encode
discrimination, codify discrimination into
law and therefore stand apart from our
nations recent decades and decades
and decades and decades of using
its constitution to expand rights to
people, he said. This is a cynical attempt
to use a state constitution to restrict rights
and we will oppose it as we have said in
our statement.
Gerald Stansbury, president of the
Maryland State Conference NAACP, told
the Blade after the news conference that
his afliate has not had much discussion
yet on the likely referendum. He
suggested, however, that the civil rights
organizations endorsement of marriage
rights for same-sex couples will help
black voters better understand the ballot
measure and its potential impact on LGBT
Marylanders.
Were hoping that Maryland will
understand that any person has a right to be
protected under the law, said Stansbury.
This is basically where were coming
from. Were supporting the national ofce
and the national NAACP and taking the
position that they have this weekend.
Maryland Del. Mary Washington
(D-Baltimore City) also welcomed the
NAACPs position.
As a lifelong member, I am encouraged
by this historic decision of national
NAACP to transform their position which
opposed efforts to ban civil recognition of
same-sex unions to one which honors and
is inclusive of our black LGBT community
by supporting the struggle for full
marriage equality for same gender loving
couples, she told the Blade. For those
African-American people who were on the
fence about the issue, the support of the
NAACP and our president will help move
the conversation forward.
Washington categorized the
endorsement as an important step
that bolsters the efforts of those ghting
against the likely referendum. Lettman-
Hicks stressed that the NAACP could play
a crucial role in organizing opposition

North Carolina.
The same energy that we saw in North
Carolina would be monumental to the
state of Maryland, she said. I hope that
the leadership the NAACP showed on the
national level will manifest at the same
magnitude in Maryland especially since
theyre headquartered there.
Washington conceded these efforts
would not have much of an impact among
white protestants and Roman Catholics
who oppose marriage rights for same-sex
couples.
Our work in those communities should
continue more vigorously now than ever
before, she said.

campaign as of late last year.
Because the president already had a
strong record of accomplishment on LGBT
issues, many of those who donated in
2008 ... had already given (in many cases,
the maximum amount) by the time of the
presidents announcement, Jennings said.
But I did see a number of new donors jump
in one who told me he gave online with
tears running down his face as well as
folks who had not yet given the maximum,
but had given something, add to what they
had already given.
Individuals can donate a maximum of
$5,000 to a presidential campaign, which
can be split between the primary and
the general election. But donors can also
contribute $30,800 a year to any given
national committee and up to $10,000
a year to the federal account of state
party committees.
Bruce Bastian, a gay Orem, Utah-based
philanthropist known for giving to LGBT
causes, said he couldnt donate any more
money to the Obama campaign after
the president came out in support of
same-sex marriage. Bastian was among
the attendees at a $35,800-a-plate LGBT
fundraiser for Obama that took place in
D.C. in February and raised $1.4 million
for the president.
I have already contributed to Obamas
campaign as much as I can, Bastian said.
I am very excited and pleased that the
president came out in clear support of
marriage equality for all Americans, but it
didnt change my mind in how I support
him or to what extent I will support him.
I think it is extremely important for the
LGBT community to do everything we can
to get Obama re-elected.
The Obama campaign didnt respond
to a request for comment on how
Obamas support for same-sex marriage
affected LGBT donations, but two weeks
after the announcement on Wednesday,
the campaign unveiled a new initiative,
titled Obama Pride: LGBT Americans for
Obama, which aims to integrate LGBT
supporters into the campaign as Pride
month approaches.
Obama Pride: LGBT Americans for
Obama is set to launch with trainings,
phone banks and house parties in a
number of states including Pennsylvania,
Colorado, Nevada and Michigan which
are seen as battleground states in the
general election. As part of the effort,
the campaign launched the website lgbt.
barackobama.com.
Additionally, the White House is set to
host a reception celebrating Pride month
on June 15. The Obama administration
has held Pride celebrations in each of the
previous three years of his term. Obama
traditionally speaks to attendees at the
event, and will likely capitalize on his
announcement in support of marriage
equality as he addresses LGBT attendees.
While many major donors may have
maxed out their contributions to the
Obama campaign, anecdotal evidence
suggests that Obamas announcement
in favor of same-sex marriage prompted
individuals who tend to make smaller
donations to open their wallets.
Tommy Rossman, a gay 39-year-old
D.C. resident and human resources
management systems coordinator,
said he donated $100 to the Obama
campaign after the president made the
announcement, and had donated $300 to
the campaign before Obama came out in
support of same-sex marriage.
Basically, I was just excited that he
nally did it, and I wanted to make sure
that since he took a risk politically to do it,
that Im doing my part to help him out as
well, Rossman said. There are so many
people especially with progressives
and with gays in general that have
really screamed loudly for him to do it and,
again, I just want them to jump on board.
Dan Ingram, 22, a gay Madison, Wis.,
health care software specialist, said
he donated $30 one week after the
announcement because he thought the
move was politically courageous in the wake
of the passage of a constitutional same-sex
marriage ban in North Carolina and the
failure of civil unions legislation in Colorado.
It seems like the politically smart thing
to do would have been to stick with his
evolution thing that he was pitching for a
while, which, I think, a lot of liberal people
took as code that hes going to come out
for it, but hes waiting to get re-elected,
Ingram said. With how those votes that
might have still been the politically safer
bet to make, so, for me, it was a really
principled move by him to say that.
Ingram said hed donated multiple
times to the presidents 2008 campaign,
but his donation this month marks the rst
time he gave to Obamas re-election bid.
David Wells, a gay 47-year-old D.C.
resident and a self-employed software
consultant, said he donated $100 to
the president about 10 minutes after he
endorsed same-sex marriage.
Over the course of his rst term, I kind
of felt like he wasnt doing anything, and
lately hes been coming back around to
the LGBT community, Wells said. When
he nally came out for this, I was like, OK,
Im back in.
Other LGBT supporters of Obama have
launched larger efforts to encourage other
LGBT donors to give to the campaign.
Lane Hudson, a gay D.C. Democratic
activist, set up a page on the Obama
campaigns website and made an initial
contribution of $500. The page had raised
$10,000 within 24 hours of the presidents
announcement. As of Wednesday, the
page had raised $13,088 for the campaign.
For me, it was a game changer
because people like me have spent the
last three-and-a-half years and also the
year before during the campaign to
make the case that it was important for our
political leaders to court full civil equality,
Hudson said. Thats what happened
when he made this announcement. It
really completed an evolution to a position
that we need to get all people in all public
ofce to hold.

Polis haunted by beating in area McDonalds
Chrissy Lee Polis, the 22-year-old transgender woman who was beaten in a
Baltimore County McDonalds last spring, continues to be haunted by the event.
According to an article in the Baltimore Sun, Polis remains troubled by the incident
that took place on April 18, 2011. The attack was caught on video that went viral.
She became the unwitting face of the battle for equal rights based on gender
identity. Suddenly, shes catapulted and shes an icon, Dana Beyer, executive
director of Gender Rights Maryland, told the Sun. Chrissy had no clue; shes had
no training, no experience and suddenly this fame came pouring down on her
and she had no idea what to do with it.
Although she was offered help from people around the country, Polis feels she
was being exploited and could only rely on a few friends. Everybodys not out for
your best interest, Polis said.
Since the attack, legislation that provides legal protections based on gender
identity passed in Baltimore and Howard counties but a statewide bill died in the
Maryland Senate. Sharon Brackett, board chair of Gender Rights Maryland said
the media overstated Polis role in the passage of this legislation.
Yet Polis attorney Mark Scurti told the Sun, A lot of groups wanted to highlight
the abuse that has impacted the trans community. Without the human stories, its very
difcult for a legislator or a Council person to pass laws to protect a group of folks.
Brackett provided nancial assistance and advice to Polis but the friendship
later ended when Polis believed Brackett was trying to run her life.
She doesnt have a hard life because shes trans, Brackett said. She has a
hard life because she has a hard life. And being trans makes it harder.
Marriage supporters to talk referendum strategy
A meeting to highlight the strategy to retain marriage equality rights in the
state will be held Wednesday from 7-8:30 p.m. at the Owen Brown Interfaith
Center, 7246 Cradlerock Way in Columbia. The meeting will be hosted by several
local PFLAG chapters.
Its purpose is to delineate a strategy that will help defeat an expected
November ballot referendum to overturn the law that allows same-sex couples
to marry in Maryland. Opponents are two-thirds of the way toward gathering the
required number of signatures for the referendum.
On hand will be state legislators, leadership from Marylanders for Marriage
Equality and Equality Maryland.
Pastor praises Obamas marriage announcement
With reports that some black church leaders are helping to gather signatures for
a referendum to repeal the states marriage equality law, one Northwest Baltimore
pastor publically applauded President Obama for his stance on the issue.
Rev. Brad Braxton, an ordained Baptist minister and founding Senior Pastor
of The Open Church, penned an op-ed in the Washington Post praising the
president. In his piece, Rev. Braxton wrote, Same-sex couples should enjoy the
privileges and bear the responsibilities of committed, covenant relationships
just like heterosexual couples. Additionally, Christian congregations should
bless same-sex marriages as a fulllment of the churchs pastoral task and an
endorsement of Gods eternal devotion to abundant life and holy love.

Obama has done more for
LGBT cause than any other
elected ofcial in history

The elected president of the United
States of America made history this month
by becoming the rst sitting president to in-
dicate that he supports same-sex marriage.
Of course, this is a controversial proclama-
tion, just as it was for the greatest Repub-
lican President, Abraham Lincoln, to advo-
cate the abolishment of slavery.
Theres another word for taking a stand
in order to right a long supported wrong.
Its called leadership. It takes courage to be
bold. The easy route would have been to wait
until after the November election. In stating
this now though, Obama, who in three years
has done more for the LGBT cause than any
elected ofcial in the history of our nation, has
taken the next step. It truly is the next step
toward making equality more than just an
ideal. Greatness is rarely accomplished by
taking measured baby steps, even when they
are in the correct direction.
Although nobody wants to admit it, our
founding fathers were not always correct in
their viewpoints. Their genius, though, was
in leaving a system in place that allows for
corrections. Thankfully, although most of
the founders were slave owners, that wrong
was rectied. Although women were not
among the equal citizens with the right
to vote, that too was eventually resolved.
Those are but a couple of errors that have
been taken care of over our still short ex-
istence. Looking back, an overwhelming
majority of Americans would say that those
changes were good and perhaps even over-
due. As hard as it is to believe today, neither
move was entirely popular with many in the
country. How fortunate were we that there
were people determined to be on the cor-
rect side of history?
I am so glad that our current president
has made a bold move. There will come a
time, I hope not decades away, when peo-
ple will hear that gays and lesbians were
not given the equal rights that the founding
fathers promised our citizenry, and theyll
be appalled. We arent there yet. We arent
even to the point where that wrong has
been corrected. North Carolina demon-
strated that their desire to be on the wrong
side of history will not be limited to the Civil
War. How appropriate to sneak a bill into
a primary election, rather than wait until a
general election in November to bring such
an important issue to the electorate. After
such a miscarriage occurs in a swing state, it
would have seemed to be a dangerous time
for President Obama to reiterate his opposi-
tion. Of course, someone with courage and
strong will might. So he did.
His presumptive opponent holds tight
to the viewpoint that he not only opposes
same-sex marriage, but civil unions as well.
(He holds on tighter in fact, than to any other
of his wishy-washy convictions.) The line
has been drawn in the sand. The difference
is not evolving anymore.
Certain moments in history have brought
shame on our country in retrospect. Hind-
sight, as they say is 20-20. But its rare that
we cant look back and say, that was the
right thing to do. Thats true, as long as we
have time to absorb the signicance. There
will always be those that wish for the good
old days. You know who Im talking about.
Those that want to revert to what the found-
ing fathers had in mind. Those were the days
of yore, when every land-owning white male
had the right to vote.
Yes, changes have been made, and the
hearts and minds of thinking individuals of
all races continue to evolve. When we look
back at those who were against the aboli-
tion of slavery, we think of those people
as ignorant, and correctly so. The same is
true of those opposed to giving women
the right to vote, less than a century ago.
It almost seems preposterous that there
are many alive today who were alive when
women couldnt even vote. That is because
we know, not think, but know, that this was
shameful. But, hey, thats the way the found-
ers wanted it, right?
Its time to bring another group into the sun-
light. There is no excuse for someone to have
to stay in a closet for fear of losing their rights,
or worst of all their dignity. More and more
members of the LGBT community are coming
out of the closet daily, but there remain some
who want to hold them back. Those are the
same people that soon well be looking back
on as ignorant. Dont let those that would deny
my kids the right to marry hide in their dark of-
ces. Come to think of it, maybe we should
push them toward the darkness, like we have
every group that ends up on the wrong side of
history. Or like the vampires of history, we bring
them into the light to expose themselves for
who they really are, cowards.
Thank God, (and yes, I believe in him or
her), we have a president who is now clear
he isnt one of them.
Its about marriages
being recognized in
every respect

The Maryland Court of Appeal, Mary-
lands highest court, issued a decision last
Friday requiring a Prince Georges County
circuit judge to grant a divorce to two wom-
en who were married in California. On its
face, this looks like a simple case of allowing
same-sex couples to divorce in Maryland,
even though Maryland does not yet allow
such couples to marry IN Maryland.
However, if one reads the case more care-
fully, the full impact of the Court of Appeal de-
cision in Port v. Cowan, becomes clear. Mary-
land must rst recognize a marriage between
a same-sex couple in order to grant a divorce
to the couple. Recognize is the operative
word here. This decision means that Maryland
must RECOGNIZE marriages for same-sex
couples when the marriages are valid in the
jurisdiction where they were performed. So,
for example, Maryland residents who come to
the District of Columbia or other jurisdictions
to be married, are now married, in every way,
in Maryland. This case is not just about divorce,
it is about our marriages being recognized in
every respect in the state.
Some of the rights that go with marriage in
Maryland are the right to inherit from a spouse,
exemption from inheritance and estate tax at
death, and ability to sue for a wrongful death
of a spouse. A summary of these rights and
responsibilities, called Marriage Inequality in
Maryland, can be found at equalitymaryland.
org, which commissioned the study. That pub-
lication was written in 2006, and how much has
changed since then!
Of course, Maryland has passed mar-
riage equality, but it appears that law will
be subject to a referendum in November,
as the law does not take effect until January
2013. In Maryland, laws passed by the legis-
lature may be overturned by a referendum.
However, unlike California, decisions by
Maryland courts may not be reconsidered
in a referendum. Only the legislature may
reverse a decision by Maryland courts. So,
the Court of Appeal decision can only be re-
jected by the legislature, and given that the
legislature just passed marriage equality, we
can expect that the Port case will remain the
law of Maryland.
Even though we now clearly have mar-
riage recognition in Maryland, many of the
issues of marriage recognition will continue
to play out. I expect that like elsewhere, there
will be many bumps in obtaining all of our
marriage rights. Some questions immediate-
ly coming to mind include whether children
of a marriage will be considered the legal
children of both parents; whether spouses
may put each other on employer provided
health insurance; what will happen in a con-
tested divorce when the parties were togeth-
er a long time then got married, then sepa-
rated; how will marital rights in Maryland be
dealt with when issues involve other states
laws; how will companies that do business
in Maryland but are incorporated elsewhere
treat our marriages? Situations and ques-
tions like these will have to be addressed for
some time before all of the dust settles.
Also, the fact that Maryland now rec-
ognizes our marriages does not change
anything on the federal level. Although the
federal government says it will no longer en-
force the Defense of Marriage Act (DOMA),
federal law in almost all respects still does
not recognize our marriages. Married Mary-
land residents who are federal employees
still are unable to put their spouses on their
health insurance and are unable to elect a
spousal benet for a pension, among other
marriage benets. No married same-sex
couple has access to each others Social Se-
curity benets. There is litigation around the
country challenging many of these policies,
so this chapter in our ght for equal rights
continues to be written.
All in all though, Port v. Cowan is a very
signicant step forward for marriage equal-
ity in Maryland. Of course, we all hope that
Marylanders will conrm that marriage
equality means that same-sex couples may
marry IN Maryland, their home state. Thats
an important message of acceptance into a
basic societal right. But for now, if Maryland
residents cross the line into the District and
get married, theyll be married at home too.

while city holds line on
increasing taxes
Maryland and D.C. were in sharp con-
trast last week when approving tax policies
and budgets for their respective upcoming
scal year.
Marylands General Assembly passed a
broad ve to 10 percent state income tax
hike proposed by Gov. Martin OMalley
on wage earners now dubbed thousan-
daires while the usually spendthrift D.C.
Council adopted a budget with no tax
increases at the urging of Mayor Vincent
Gray and Council chair Kwame Brown.
The unpopular and retroactive Maryland
income tax increase will fund nearly $1 bil-
lion in additional spending and resulting
state budget decit. D.C. chose instead
to continue utilizing spending cuts as the
primary tool in closing its own $172 million
projected budget gap.
Included among additional Maryland
fee increases is one that gives new mean-
ing to the phrase death and taxes the
state doubled the price of a death certi-
cate to $24.
D.C. Council members, however, devel-
oped a wish list of a quarter-of-a-billion
dollars in additional spending should rev-
enue exceed projections for the scal year
beginning Oct. 1. The legendary local re-
ex to tax and spend is a long-ingrained
habit not easily weaned.
Reducing the Districts business tax
rates, the second highest in the country, or
the tax burden on residents, fourth highest
nationwide, occurs to a lonely few among
those with an ofce in the John A. Wilson
Building.
Approval of OMalleys tax hike required
a special legislative session to wrestle pas-
sage, with some Democrats in the state-
house majority refusing to support the
increase. It affects 16 percent of taxpay-
ers and initiates on those earning only
$100,000 or couples ling jointly earning
only $150,000 combined.
Hard hit will be small business owners
throughout the state reporting net busi-
ness revenue as personal income.
These new low-threshold denitions of
Marylands wealthy will affect approxi-
mately one-fourth of taxpayers neighbor-
ing the District in Montgomery County,
where 40 percent of increased income tax
revenue will originate among only 18 per-
cent of the states population.
Meanwhile, having agreed on revi-
sions to Mayor Grays budget proposal in
advance and with his approval, the D.C.
Council quickly dispatched without rancor
and with unusual unanimous agreement a
no-tax-increase budget package in the rst
of two votes. Final approval is scheduled
for June 5.
The D.C. budget compromise includes
a partial implementation of Mayor Grays
proposed one-hour extension in the maxi-
mum allowable alcohol service period
at the citys restaurants, bars and hotels
to generate additional sales tax revenue
and assist in budget balancing. Chairman
Browns substitute plan allowing later bar
hours on 19 dates until 4 a.m. on the night
before all 11 federal and D.C. holidays as
well as Friday through Sunday preceding
Memorial Day and Labor Day and when
New Years Eve and July 4th fall on a Mon-
day was approved by voice vote.
Presumably hoping to deect the iso-
lated ire of some citizens groups and Ad-
visory Neighborhood Commission (ANC)
members opposing later bar hours, the
Council deferred what many consider the
inevitable expansion of alcohol service
hours in a city evolving toward a world-class
24-hour economy.
D.C. Council member Jim Graham
found himself alone in voicing objection to
the alcohol service extension option. Coun-
cil disfavor of instead raising the alcohol ex-
cise tax proved so pervasive that Graham
did not introduce his idea to nearly qua-
druple the rate opposed by hospitality
businesses, alcohol retailers, local alcohol
brewers and distillers and alcoholic bever-
age distributors.
D.C. elected ofcials relished the com-
parison between the two jurisdictions.
D.C. Council member Jack Evans, chair
of the Committee on Finance and Rev-
enue, publicly exclaimed following an ini-
tial round of Maryland tax hike debates,
Thank God Maryland keeps raising their
taxes, one of these days theyre going
to catch up to us. D.C. Council Chair
Kwame Brown reminded local TV news
viewers on the day of the Council vote, if
youve noticed, Maryland is raising taxes
theyre raising income taxes and com-
mercial taxes.
Maryland House Minority Leader An-
thony ODonnell had previously responded
to Evans comments in an interview with a
Washington reporter, Much to my chagrin,
Id have to agree with Councilman Evans.
He further lamented, Maryland is increas-
ingly perceived as a state thats hostile to
business. When you have D.C. of all places
poking fun at you, its pretty bad here.

Times critic Claiborne
began groundbreaking
work 50 years ago
Recently, with friends, I feasted on burri-
tos, salsa, chips, nachos and other culinary
delights at a Mexican restaurant to celebrate
our pals birthdays. The meal was as essen-
tial to the festivities as much of a gift
as our friendship and birthday cards. We
savored the coconut ice cream (delicious
but not overly sweet). The chips are good
here, one friend said. Theyre baked.
Sipping my pina colada, I thought of the
late Craig Claiborne, the gay writer and critic
who taught Americans from sophisticated
Manhattanites to small-town merchants and
homemakers to appreciate food. Fifty years
ago this month, Claiborne, who died in 2000
at age 79, began writing restaurant reviews
for the New York Times.
Today, nearly everyone from foodies to
baseball fans, takes pleasure in, ingests in-
formation about and critiques food, restau-
rants and all things culinary. My brother, who
is straight and a great cook, is a Food Net-
work devotee. Even I, never to be mistaken
for Americas Top Chef, avidly read restau-
rant reviews.
But until Claiborne began writing for
the Times, food wasnt taken seriously
as a cultural phenomenon worthy of
the same type of criticism as art, music,
literature or the theater. Newspapers
dismissively placed writing about food in
the society or womens pages. Res-
taurants werent reviewed as we think of
reviewing now. Then, if you reviewed a
restaurant, your meal was usually paid for
by the eating establishment, and often the
review was merely a puff piece extolling
the eaterys virtues.
He believed himself to be a critic on a par
with the papers critics of books, art, music and
drama, and he was determined to bring to his
work a rigor and gravity equal to theirs, writes
Thomas McNamee, author of The Man Who
Changed the Way We Eat: Craig Claiborne
and the American Food Renaissance, a just
released biography of Claiborne.
Today, many publications have restaurant
critics and all aspects of food from the
latest info on nutrition to the hottest trends
in donuts to the best food trucks are hot
topics on social media. I cant wait to check
out the Big Gay Ice Cream Truck, which,
I just read in the Times, offered wedding
guests milk shakes after Christine C. Quinn,
speaker of the New York City Council wed
her partner Kim M. Catullo.
Unfortunately, Claiborne, who en-
hanced dining for so many and appre-
ciated the pleasures of both esteemed
French restaurants and Chock Full o
Nuts, came of age when it wasnt at all
easy to be gay. He grew up poor in the
Mississippi Delta and had a difcult re-
lationship with his mother (he didnt go
to her funeral). In his memoir, Claiborne
alludes to having had a sexual relation-
ship with his father, according to McNa-
mee. Though, he was the papers restau-
rant critic and food critic, the Times was
homophobic during much of his tenure
there, especially during the 1960s.
Claiborne didnt write in The Times or
speak to anyone outside the paper of his
friendships (sexual or platonic) with gay
men, according to McNamee. That isola-
tion would change as the times changed,
but in the early 1960s, the gay world even
in New York, except in certain elds, such as
dance, fashion and the stage, remained a
world apart, he writes.
One reason he was able to accept Clai-
bornes sexuality, former New York Times
managing editor Arthur Gelb told McNa-
mee, was that my wife, Barbara, was the
daughter of S. N. Behrman, the playwright ...
but at the Times it was still a big deal.
In 1980, Claiborne met the love of his life,
the late Jim Dinneen, a married, retired phy-
sician. Though they traveled together for
years, the lovers never lived together. (He
couldnt get Dinneen to leave his wife and
children for him.)
As Pride season approaches, lets raise
a glass to Claiborne, who despite personal
sadness, enriched our lives.

Houses from the 30s
and 40s often need
work but can be
worthwhile investments

In April, we talked about the potential
benets and savings in buying an ugly
duckling house like a 1950s rambler or
ranch style home, which at rst blush can
be unattractive and outdated, but can be
transformed into a beautiful swan with
your own personal touches and style.
Now lets take a look at the 1930s and
1940s colonial home, which is found in
nearly all the neighborhoods of North-
west Washington and throughout the
close-in Metro area. Some of the typical
problems with this style of house from
that period include low ceilings, small,
non-insulated windows, utilitarian-look-
ing brick exteriors and closet-sized kitch-
ens and baths.
The good news is there are solutions
for all of the problems generally faced
with this style of house. You can paint the
wall and ceiling colors the same white
or off-white shades to trick the eye and
create the illusion of higher ceilings. You
will probably want to replace the old,
non-thermo pane windows, which is an
investment, but you can save a consider-
able amount of money by having the re-
placement windows made to t into the
existing sash openings. Keep the window
treatments to a minimum to enhance the
light and size of the window openings.
A harsh brick exterior can be softened
and made more personalized by adding
wooden shutters and making sure the
trim and shutter paint colors complement
the grout color.
Landscaping is to a house what make-
up is to a face, so use it to enhance what
the house already has going for it. You can
also accentuate the stately appearance of
the colonial-style house by adding deco-
rative fencing on both sides of the house
up to the garage or side lot lines. If you
have the space, add a decorative garden
trellis over the fence gate. Adding a small
porch roof with brackets or columns over
the front door will make the house look
better dressed and more welcoming, as
well as provide shelter from the rain when
your guests come to call.
You can make up for the lack of a fam-
ily room and an adequate master bath
with a single, well-placed two-story ad-
dition on the back of the house. The
original kitchen should be located at the
back of the house for this plan to work.
Instead of paying too much for a lot of
square footage, opt for less space that is
well designed and has good ow, stor-
age space and ample natural light. An
addition can also provide the space to
add convenience and functionality to the
house at the same time.
For example, if the house is missing a
rst oor powder room and a coat closet,
include them in the new addition. Make
the best use of space by opening the
kitchen to the family room and separat-
ing the two with a well-designed island
that can double as cooking space and a
counter for seating. This will probably be-
come the central gathering area in your
home, whether its being used for every-
day use, or when it becomes the bar and
entertainment area for a party.
On the second oor of the addition,
incorporate one of the existing small
bedrooms to become the new walk-in
closet and part of the master bath for the
new master suite. Remember, when you
are considering spending money on im-
proving your home, the kitchen and the
master suite are the two places that will
bring you the best return on your reno-
vating dollars. While you may want to
splurge on a xture or appliance, they
have to be appropriate in terms of size.
You dont want to choose an oversized
tub or refrigerator that will ruin the de-
sign and feel of the new spaces.
This sounds like a lot of work, but its
worth doing. Remember that location is
the key word in real estate investments,
and if the price is right, it will be worth
taking the money you saved by buying
the ugly duckling on the block, and turn-
ing it into your very own dream house.
