Case Facts Case Analysis with three Questions:

Q1. Discrimination involved in Kaiser Aluminum

Plant.
Q2. Q3.

Judgment for the problem & Policies recommended. Moral Principles & Qualifications considering training program. for

Initially, the plant has partitioned Racism. Kaiser Aluminum Plant has only relatively few Black Workers.[(i.e.) only 4.7% of Blacks]. After that Federal Agencies pressured Kaiser to increase the number black workers in better paying skilled jobs and also US steelworkers union was pressing him for the training program for its own workers. Then Kaiser agrees to recruit atleast 50% of black workers for the training program. During the first year of the program, 13 people were selected (i.e.) 7 Blacks & 6 Whites.

In 1974, Brian Weber, a white man was not selected for training program. Even though he had more seniority than two successful black candidates. Later he found that 43 other White workers had also rejected had even more seniority than he did. Kaiser gave 3 reasons for adopting this program: (1) pressure from federal contract compliance officers, (2) fear of litigation by blacks, and (3) a belief that such programs advanced national policy.

Yes, Kaiser was practicing discrimination. At the beginning, Kaiser hired only 4.7% of Blacks. Suddenly he plans to increase the number of blacks to 39%, due to pressure from Federal Agencies, litigation by blacks & National policy. But he didnt think about the experienced white people. Yes, Kaiser management is morally responsible for the situation in its plant. Because they initially they gave preference to white people suddenly they tries to change the situation by starting the preferential treatment training program. This creates problem.

Yes, the Kaiser Management acted rightly when it implemented its preferential training program. Because they gave preference to bottom level black workers. Also in order to follow rules of federal agencies and to solve the problem of blacks. The policy that I recommend for Kaiser is to follow

strong considerations of equity.

Though initially we may think that Weber was treated unfairly. But it is not so. Because there is no any grievance between the company and Weber. Also 43 other white men had also rejected in order to give more preference to Blacks. My judgment on the basis the moral principles are;

the Kaiser plan did not absolutely bar the admission of whites and Also that the training plan was a temporary one, operating only

until blacks in craft jobs at Kaiser reflected the ratio of blacks in the local work force. So, Kaiser didnt had nothing wrong in their treatment.

Yes seniority serve as a basis for deciding who gets trained first. The Qualifications that can be considered;

Experience;

Relative Job Skills & Knowledge;

Avoid Racial Differences; Performance in the past . Effectiveness in completing their job; Employees potentiality.
