According to Sen (2009) early Indian legal theorists argued that it is important to avoid matsyanyaya (justice in the world of fish) that is where big fish freely feed on smaller fish. Such a perspective should never be allowed to invade the world of humans. This is an important idea because no matter how well organised and proper businesses might be (niti) if big fish can still eat smaller fish at will then what actually emerges in practice (nyaya) is still wrong. So it is important to distinguish between the rules/policies of business (niti) and the way business behaves (nyaya). This leads us to think about efficiency in business. When applied to business, it means weighing up the costs and benefits of decisions and actions what will cost the least and create the maximum benefits? This view takes as its main concern the creation of the greatest happiness for the greatest number of people. Immanuel Kant (1724 1804) offers a powerful account of duties and rights in which it is argued that people are rational, worthy of dignity and respect. In deontology it is a persons motive that counts what matters is that as autonomous (free) people, we should do the right thing because it is right, not for some other reason. To understand this we must refer to the Categorical Imperative. There are two things to remember about the categorical imperative: first is to act on principles that you can apply all the time without contradicting yourself and the second is to treat people as ends in themselves that is to act in such a way that you do not use other people. Do we have the right to whatever we want with the things we own providing we respect other peoples right to do the same? In a market economy people make voluntary exchanges of good and services and in doing so make everyone better off. Markets rule! What ways of life will create a good society? These are questions that make us think about the purpose (telos) of business.
