Asylum Benefits
Working
Being granted asylum comes with many benefits. First, asylees (those who are granted asylum) are
given work authorization. Work authorization means the United States government is giving you
permission to work and make money in the United States. The document which asylees are given is
called an Employment Authorization Document (EAD).
Social Security Card
Asylees may immediately apply for and receive unrestricted Social Security cards. A Social Security
card has a 9 digit number issued by the United States government. The primary purpose of this card
is to track individuals for their social security and other benefits. You will also need the card
number when opening bank accounts, applying for loans, purchasing a car, or purchasing a house. It
is the most important personal identification number for those living in the United States.
Green Card
12 months after you are granted asylum, you are eligible to apply for a green card (permanent
residence status). Greed card holders can generally do everything citizens can do except vote in
elections and hold public office. Having a green card gives the card holder a real sense of security.
The United States government allows card holders to live, study, and work freely in the United
States with almost no restrictions. Green card holders may apply for U.S. citizenship after having a
green card for 5 years (the first year as an asylee counts toward the 5 years).
Travel
Asylees can obtain a proper travel document from the USCIS and travel outside of the United
States. Upon return to the United States, asylees must show their travel document to reenter freely.
This means that as an asylee, you do not need to obtain an American Visa to reenter the United
States.
Asylum Process
Generally, the asylum law process is laid out in a compilation of laws, regulations and case law. The
Immigration and Nationality Act (INA) is the main source of law. Specifically, Section 208 of the INA
describes the basics of asylum law. In addition to the laws, there are agency regulations on asylum
which can be found in 8 CFR 208.
Applying for asylum is fairly straight forward if done correctly by an asylum expert. Below are the
general steps in the asylum process:
Using the help and expertise of an asylum lawyer, prepare your four part asylum application
package (Asylum form, declaration, corroborating evidence, country conditions/human rights
reports). Once complete, your lawyer will mail out the entire package to the correct USCIS address.
After about 1-2 weeks, you will receive a Notice of Receipt letter from the USCIS.
After another 1-2 weeks, USCIS will send you your asylum interview date and time notice.
Generally, about 2 weeks later, you will attend your asylum interview.
One week after your interview is complete, the asylum office will mail the decision to your address
or you will be required to pick it up at the asylum office.
If your asylum application is approved, you will receive work authorization along with other
benefits. You may be eligible to apply for a green card after 12 months on continuous stay in the
United States.
Denials: If you are in the United States on a valid visa and in valid status (your I-94 has not expired)
then you will receive a Notice of Intent to Deny in the mail. This is a letter from the asylum office
stating why they intend to deny your asylum application. The asylum office will give you an
opportunity to file a response and try to alleviates all of their objections.

Asylum Interview
The asylum interview can be the most important part of the
asylum application process. It is your opportunity to tell
your story in your own way. It is very important that you
dress appropriately for the interview. For men, a nice dress
shirt and nice pants will do. For women, a semi-formal
outfit will work just fine. Both men and women should not
wear jewelry or anything distracting to the interview. Cell
phones should be off and you should tell your friends and
family that you could be in the interview from 15 minutes
to a few hours. Do not forget to take your Asylum Interview
Notice with you to your interview. The front desk will ask
you for your Asylum Interview Notice. They will hand you a
document with a number. When the number is called, it
will be your turn for the interview.
