One may qualify for this visa when applying outside


Australia, if you have met your sponsor and your
relationship is genuine, the fianc visa allows the principal
applicant and its dependent to come to Australia to live
with his/her prospective fiance and later get married within
9 months period upon entry to Australia and later switch
this visa to remain in Australia indefinitely- if the
relationship as married couple continues and if they able to
qualify to apply for the partner/spouse visa under this
category. The Fiance Visa in Australia is a temporary visa
on which the sponsor (fianc) and the applicant outside
Australia should meet certain eligibility criteria to qualify.

The processing of this fianc visa in Australia may vary


accordingly, if you are an eligible passport holder of an
Electronic Travel Authority (ETA), the applicant may expect
to receive the decision within 5 months from the date the
embassys received your complete application and 12
months if you are not an eligible member of the ETA.
Knowing exactly the eligibility criteria to qualify and
supplying proof of evidence as to determine the existing
relationship is genuine, increases the chance for your
fianc visa approval.
What if my sponsor has a record of registrable
offence in Australia?
If the sponsor engages, commits, charges with a registrable
offence, he/she may not able to get the approval for the
sponsorship unless, the charge of such offence/s has
been withdrawn, or dismissed or, been disposed without
any record of conviction.

What if my sponsor has been convicted with


registered offence?
If the sponsor has a record of conviction, the
sponsorship may be refused. But it may consider
still approving, if the sponsors conviction has been
withdrawn or dissolved or quashed. Also, as to that
of the conviction, if the sponsor is able to served or
completed the sentence imposed on him of such
offence, and more than 5 years have passed,
without any existing charge or offence from the
day he/she completed the sentence, prior to the
submission of sponsorship application, still he/she
may get the approval of his sponsorship and or if
there are compelling reasons affecting the sponsor
and applicant.

How to submit an application?


This could be done via online application through creating an
ImmiAccount at Department of Immigration and Border
Protection website or via post to the Australian embassy office
to your country or resident.
If you apply for a paper based application:
- Complete the notice of intended Marriage
- Complete 47SP (for the principal applicant)
-Complete form 40SP for sponsor
-Complete Form 888 2 copies (from Australian Citizen or
PR/Friends who have known the relationship (fiance).
- Complete Form 80 Character assessment for Principal
applicant
- Provide statutory declaration (regarding the relationship and
intended marriage in Australia).
- Complete 47a (if there is child or other dependent in
included in the application)

How to submit an application?


This could be done via online application through creating an
ImmiAccount at Department of Immigration and Border
Protection website or via post to the Australian embassy office
to your country or resident.

List of documents you must have

This may differ according to individual circumstances but for the


list, may consider the following:
1. Payment receipt of visa application fee
2. Certified copies of passport for the applicant, sponsor and
dependent/s
3. Certified copies of Birth Certificates of the sponsor, applicant,
and its dependent/s
4. Government/ Valid IDS for both the sponsor and applicant
and dependant in included in the application (if applicable)
5. 4 most recent passport size photographs of the applicant and
2 most recent photographs of the sponsor
6. Certificate of no marriage for the principal applicant and
divorce papers or annulment or death certificate for the sponsor
or applicant (if applicable) to attest that they are both legally
free to marry
7. NBI Certificate (police certificate) for the sponsor and principal
applicant
8. Certificate of employment for the sponsor and or last 2
years income tax assessment notice
9. A statement from the sponsor in case, he or she has
previously sponsored a spouse, partner or fianc (if applicable)

Medical examination certificate and medical & travel insurance


for the principal applicant and for the dependent included in the
application (if applicable)
Proof of accommodation

Love letter history statement from principal applicant and the


sponsor (how they met, where they first met, how relationship has
developed, any significant event in the relationship, joint activities
and your future plan as husband and wife in Australia
11.2 statements from friends or relatives about the relationship and
intended marriage and family life to build in Australia
11.3 Photos together, travel together
11.4 A letter from the person that will solemnized their intended
marriage in Australia
11.5 Other evidences of your relationship that that will establish the
relationship is genuine and subsisting and intend to live as husband
and wife in Australia

Evidence

of your relationship
There are 4 broad categories of evidence that you need to provide:
financial aspects- this could be transmittal receipt e.g bank or western
union (sharing), property, investment, income or join account or any
material evidence as both parties are involve financially.
the nature of the householdThis is the living arrangement e.g,
contract of lease, or joint utility accounts, or how you both delegate the
household chores, or any correspondences that address either your name
or sponsor's name or both
social context of the relationship - social gatherings together publicly
known by relative or friends, or any organisation or membership which
both of you are involve to such, or activities in social gathering, sports,
cultural, religion or social activities and the like
The nature of your commitment to each other- knowledge about each's
others personal circumstances, background of family and situation, that
could be established during the interview. Phone conversation, or FB
communication or Skype during the time when someone is a part.
