4. 民用航空保安管理辦法
Regulations on Safeguarding Civil Aviation Against Acts of Unlawful Interference
 第二條 本辦法用詞,定義如下:
Article 2 The following terms as used in this Regulations are defined as below:
非法干擾行為 (Acts of Unlawful Interference) 指危及民用航空及航空運輸安全
之下列行為或預備行為:
Acts of unlawful interference: means acts or attempted acts such as to jeopardize the
safety of civil aviation and air transport
( 一 ) 非法劫持飛航中之航空器。 ( 二 ) 非法劫持地面上之航空器
Unlawful seizure of aircraft in flight. Unlawful seizure of aircraft on the ground
( 三 ) 在航空器上或航空站內劫持人質。
Hostage-taking on board aircraft or on aerodromes
( 四 ) 強行侵入航空器、航空站或航空設施場所。
Forcible intrusion on board an aircraft, at an airport or on the premises of an aeronaut
ical facility
( 五 ) 為犯罪目的將危險物品或危安物品置入航空器或航空站內。
Introduction on board an aircraft or at an airport of dangerous goods or prohibited ite
ms intended for criminal purposes; and
( 六 ) 傳遞不實訊息致危及飛航中或停放地面之航空器、航空站或航空設施場所之
乘客、組員、地面工作人員或公眾之安全。
Communication of false information such as to jeopardize the safety of an aircraft in
flight or on the ground, of passengers, crew, ground personnel or the general public,
at an airport or on the premises of a civil aviation facility M1.5

 第六條 航空器所有人或使用人應監控航空器附近活動之人員及
車輛,並防止未經授權之人員進入航空器。
Article 6 The owner or operator of an aircraft shall ensure that the
movement of persons and vehicles near the aircraft is supervised and
prevent unauthorized access to the aircraft.
 第七條 航空器所有人或使用人於航空器未執行飛航任務且無人
於其內部作業時,應關閉艙門或空橋,並撤走登機梯及工作梯架。

Article 7 The owner or operator of an aircraft shall close the cabin


door or passenger boarding bridge when the aircraft is not carrying ou
t a flight duty and no person is working inside the aircraft, and shall a
lso remove the mobile staircases and service ladders.
航空器所有人或使用人於接獲非法干擾行為之情資或航警局通知
時,應派人監護其航空器,並對航空器停放之機坪及其周遭作詳
細檢查。
Upon receipt of information relating to an act of unlawful interferenc
e or notification from the APO, the owner or operator of an aircraft sh
all have the aircraft safeguarded and conduct a thorough search of the
apron where the aircraft is parked and its vicinity.

 第八條 航空器所有人或使用人應於航空器飛航前,實施
清艙檢查或保安搜查。
Article 8 The owner or operator of an aircraft shall conduct a
n aircraft security check or aircraft security search prior to the
departure of the aircraft.
航警局於下列情形或必要時,得對航空器實施清艙檢查或
保安搜查,並於實施前,通知航空器所有人或使用人:
The APO may conduct an aircraft security check or aircraft se
curity search and notify the owner or operator of the aircraft pr
ior to such check or search under any of the following situatio
ns or when it is necessary to do so:
一、接獲非法干擾行為之情資。
二、有其他治安或飛航安全之顧慮。
 It has obtained intelligence relating to an act of unlawful in
terference; and
 There is any other concern on public security or aviation se
curity.

 第九條 航警局應對經許可免受監護進入管制區之作業人員,
實施背景查核,並定期複查。
前項背景查核,應包括身分及犯罪紀錄之調查。
The APO shall ensure that background checks and periodic reviews are co
nducted on persons granted unescorted access to security restricted areas.
The background checks referred to in the preceding paragraph shall includ
e an investigation as to identification and criminal history.

 第十條 航空器所有人或使用人應於乘客辦理報到劃位時,核
對乘客身分證明文件及要求乘客個別辦理行李託運;於乘客登
機時,應對其搭機文件進行核對。但航空器所有人或使用人之
航空保安計畫另有規定者,不受個別辦理行李託運之限制。
The owner or operator of an aircraft shall verify passengers’ identity docu
ments during check-in and, upon boarding, shall verify passengers’ boardin
g documents. Passengers shall check in their baggage individually unless
otherwise provided for in the aviation security program of the owner or op
erator of the aircraft.

 第十一條 航空器所有人或使用人應防止託運行李於航警局
安全檢查後至航空器起飛前,被未經授權之人員接觸;如被
未經授權之人員接觸,航空器所有人或使用人應將該託運行
李交由航警局重新進行安全檢查。
Article 11 The owner or operator of an aircraft shall ensure that all hold
baggage to be carried on an aircraft is protected from unauthorized interf
erence from the point where it is subjected to screening by the APO until
the departure of the aircraft on which it is to be carried. If unauthorized
interference with the hold baggage is discovered, the owner or operator
of an aircraft shall pass the hold baggage to the APO for the purpose of a
dditional screening.

 第十二條 航空器所有人或使用人不得運送未登機乘客之託
運行李。未與乘客同機運送之行李,應再經航警局安全檢查
後,航空器所有人或使用人始得運送。
Article 12 The owner or operator of an aircraft shall not transport the
hold baggage of passengers who are not on board the aircraft. The owner
or operator of an aircraft shall not transport the unaccompanied baggage
unless it is subjected to additional screening by the APO. M1.9

 第十三條 航空器所有人或使用人應防止乘客下機時,將其個人
物品留置於客艙內。
Article 13 The owner or operator of an aircraft shall ensure passen
gers disembarking from the aircraft at any time do not leave their pers
onal items on board the aircraft.
 第十四條 航空器所有人或使用人發現於乘客管制區範圍內,已
通過及未通過安全檢查之乘客有混雜或接觸之情形時,應要求乘
客及其手提行李於登機前,再經航警局安全檢查。
Article 14 If the owner or operator of an aircraft discovers that mix
ing or contact does take place in the sterile area between screened pas
sengers and unscreened passengers, the passengers concerned and the
ir cabin baggage shall be subjected to additional screening by the AP
O before boarding an aircraft.
 第十五條 航空器所有人或使用人應防止任何人進入作業中之報
到櫃檯。航空器所有人或使用人對保管或作業中之機票、登機證
、行李條及乘客搭機文件,應隨時防止被盜用。
Article 15 The owner or operator of an aircraft shall prevent the ac
cess of any person to a check-in counter that is in operation. The own
er or operator of an aircraft shall at any time prevent the theft of any a
ir ticket, boarding pass, baggage tag or travel document of a passenge
r that is in its custody or being processed. M1.10

 第十六條 航空器所有人或使用人於接受武器託運時,應通知航
警局派員確認武器未裝填彈藥,並置於航空器飛航時無人可觸及
之處。
Article 16 Where the owner or operator of an aircraft accepts the carriage
of weapons, it shall notify the APO, which shall send dispatch an authorized a
nd duly qualified person to determine that the weapons are not loaded, and the
n stow them in a place inaccessible to any person during flight time
 第十七條 航空器所有人或使用人應防止貨物於收受後至航空器
起飛前,被未經授權之人員接觸。
Article 17 The owner or operator of an aircraft shall ensure that all cargo i
s protected from unauthorized interference from the point it is accepted into th
e care of the carrier until departure of the aircraft on which it is to be carried.
航空器所有人或使用人發現貨物被未經授權之人員接觸時,應即
通報航警局處理。
If the owner or operator of an aircraft discovers any unauthorized interference
with the cargo, it shall forthwith notify the APO.
 第十八條 航空器所有人或使用人、航空站地勤業及空廚業,應
確保空廚餐飲及侍應品於裝載航空器前已經保安控制,並於進入
管制區時,接受航警局檢查。
Article 18 The owner or operator of an aircraft, airport ground handling se
rvice and catering service shall ensure that catering supplies and stores have b
een subjected to security control prior to their loading onto the aircraft and hav
e been inspected by the APO upon entering the security restricted areas. M1.11

 第十九條 機關執行被戒護人解送作業 (DEPA) ,應填具被戒


護人解送作業通知單 ( 如附件一 ) ,並於搭乘航空器前二十四
小時送達航空器所有人或使用人。但經執行機關與航空器所
有人或使用人協調同意者,不受二十四小時之限制。
Article 19 In carrying out the transfer of any person under escort, a notice o
f transfer of the person under escort (as shown in Attachment 1) shall be compl
eted and delivered to the owner or operator of an aircraft by the authority conce
rned 24 hours prior to the boarding onto the aircraft; provided, however, that th
e 24 hours limitation will not apply where the enforcement authority and the o
wner or operator of the aircraft have agreed otherwise.

機關執行無人戒護之被戒護人遣送作業 (DEPU) ,應填具無人


戒護遣送作業通知單 ( 如附件二 ) ,並於搭乘航空器前二十四
小時送達航空器所有人或使用人。但經執行機關與航空器所
有人或使用人協調同意者,不受二十四小時之限制。
In carrying out the deportation of any unescorted deportee, a notice of deportati
on of unescorted deportee (as shown in Attachment 2) shall be completed and d
elivered to the owner or operator of an aircraft by the authority concerned 24 ho
urs prior to the boarding onto the aircraft; provided, however, that the 24 hours
limitation will not apply where the enforcement authority and the owner or oper
ator of the aircraft have agreed otherwise.

航空器所有人或使用人對前二項之解送及遣送作業,應
進行風險評估,認有風險者,得依下列規定辦理。但法律
另有規定者,依其規定。
一、拒絕運送。
二、限制每班機運送之被戒護人人數。
三、協調執行機關加派戒護人。

The owner or operator of an aircraft shall carry out a risk assess


ment as to the transfer and transportation referred to in the two
preceding paragraphs. Unless otherwise provided for by law, it
may carry out any of the following if it determines that there is
any risk:
1. Rejecting carriage;
2. Limiting the number of persons under escort or deportee
on board each aircraft; and
3. Coordinating with the enforcement authority to dispatch
more escorting officers

 第二十條 戒護人搭乘航空器時,應依下列規定辦理:
一、檢具執行機關證明文件辦理搭乘航空器手續。
二、不得攜帶武器進入航空器,如攜帶武器,應辦理託運。
Article 20 An escorting officer shall comply with the following provisions w
hen traveling by air:
1. Submitting supporting documents issued by the enforcement authority for
the purpose of following the procedures for taking the aircraft; and
2. Carriage of weapon is not allowed on board the aircraft and, if any weapo
n is to be carried, it shall be checked.
 第二十一條 航空器所有人或使用人應將戒護人及被戒護人之人
數及乘坐位置,通知機長及客艙組員。
組員不得提供酒精性飲料予戒護人及被戒護人,並不得提供金屬
餐具及各類刀具予被戒護人。
Article 21 The owner or operator of an aircraft shall ensure that the pilot-in-c
ommand and cabin crew members are notified of the number of escorting offi
cers, the number of persons under escort, and their seat location.
Crew members shall not provide alcoholic beverages to the escorting officer a
nd persons under escort, and shall not provide metal dining utensils or cutlery
of any sorts to the persons under escort.

 第三十五條 航警局、民用航空運輸業、普通航空業、航空貨
物集散站經營業、航空站地勤業、空廚業、其他與管制區相連
通並具獨立門禁與非管制區相連通之公民營機構及保安控管人
,應依其航空保安訓練計畫,對所屬人員實施保安訓練及考驗
,並應每二年實施複訓及考驗。
 未依限完成前項之訓練並經考驗及格之人員,不得從事與保
安控制有關之工作。
 訓練紀錄應保存三年以上,以備查核。

 Article 35 The APO, civil air transport enterprise, general aviation service
, air cargo entrepot, airport ground handling service, catering service and ot
her publicly and private owned institutions with operations at an airport co
nnected with a security restricted area of an airport that has an independent
ly guarded entrance connecting a non-security restricted area, as well as a
regulated agent, shall administer security training and tests on their person
nel and administer recurrent training and tests every 2 years based on its av
iation security training program.
 Any person who fails to complete the training and pass the tests described in th
e preceding paragraph shall not carry out any work related to security control.
 The record for the training shall be kept for a minimum of 3 years for the purpo
se of audit and review.

 第三十六條 民航局得派員查核、檢查、測試或評估航警
局、民用航空運輸業及普通航空業之航空保安措施及航空
保安業務。
航警局得派員查核、檢查及測試航空站內作業之各公民營
機構及保安控管人之航空保安措施及航空保安業務。
 Article 36 The CAA may dispatch its personnel to conduct audits, inspe
ctions, tests, or assessments in respect of the aviation security measures and
aviation security tasks of the APO, civil air transport enterprise and general
aviation service.
The APO may dispatch its personnel to conduct audits, inspections and tests
in respect of the aviation security measures and aviation security tasks of the
various publicly and privately owned institutions operating at an airport and
the regulated agent.

 第三十七條 任何人對航空保安資料,應予保密。
前項航空保安資料,包括下列事項:
一、國家民用航空保安計畫。
二、各航空站保安計畫。
三、民用航空運輸業、普通航空業、航空貨物集散站經營業、
航空站地勤業、空廚業、保安控管人及其他與管制區相連
通並具獨立門禁與非管制區相連通之公民營機構之航空保
安計畫。
四、其他國家所提供應保密之航空保安資訊。
 Article 37 Aviation security information shall be kept confidential by eve
ry person. The aviation security information referred to in the preceding p
aragraph shall include the following:
1. The national civil aviation security program;
2. The airport security programs;
3. The aviation security programs for a civil air transport enterprise, gene
ral aviation service, air cargo entrepot, airport ground handling service,
catering service, regulated agent, and other publicly and privately own
ed institutions with operations at an airport connected with a security r
estricted area of an airport that has an independently guarded entrance
connecting a non-security restricted area; and
4. Any and all confidential aviation security information provided by oth
