The legal health record is generally the information used by the patient care team
to make decisions about the treatment of a patient, the designated record set
contains protected health information along with business information unrelated
to patient care.
Therefore HIPAA does not play as much of a part in the legal health record as the
designated record set.
CRITICAL THINKING
1. What is the official purpose of the legal health record?
2. Does the legal health record contain medical and billing records,
payment, claims, and the health plan for the patient?
3. What does the legal health record contain?
4. Does the legal health record require individual HIPPA right of
access?
5. Explain the difference between the legal health record and the
designated record set?
