I. Basic Principles and Policies

PRESCRIBING THE INTERIM PROCEDURES IN THE
PROCESSING AND APPROVAL OF APPLICATIONS FOR
THE DEVELOPMENT OR UTILIZATION OF
FORESTLANDS AND/OR FOREST RESOURCES
Sec. 4. Until Congress otherwise provides, the
Secretary of the Department of Environment and Natural
Resources is hereby authorized to negotiate and enter
into, for and in behalf of the Government, joint venture,
co-production, or production-sharing agreements for the
development or utilization of forestlands and/or forest
resources with any Filipino citizen, or corporation, or
association, at least sixty percentum (60%) of whose
capital is owned by Filipino citizens. Such agreements
may be for a period not exceeding twenty-five years,
renewable for not more than twenty-five years, and shall
conform with and include the minimum terms and
conditions prescribed in Section 5 hereof.

PRESCRIBING THE INTERIM PROCEDURES IN THE
PROCESSING AND APPROVAL OF APPLICATIONS FOR
THE DEVELOPMENT OR UTILIZATION OF
FORESTLANDS AND/OR FOREST RESOURCES
Sec. 5. Unless Congress otherwise provides, the following minimum terms and
conditions shall be incorporated in the co-production, joint venture, or productionsharing agreement:
(a) A provision that the agreement-holder shall furnish the necessary management,
technology, and financial services when required, as determined by the Secretary of
Environment and Natural Resources;
(b) A stipulated share of revenues and the manner of payment thereof;
(c) Provision on consultation and arbitration with respect to the interpretation of the
agreement;
(d) A provision for anti-pollution and environmental protection measures;
(e) A provision for the restoration and protection of the forest;
(f) A provision for an effective monitoring scheme to be implemented by the
Department which shall include, but shall not be limited to the periodic inspection of
all records and books of account of the agreement-holder;
(g) A commitment to community development; and
(h) The submission of a management and development plan to be approved by the
Secretary of Environment and Natural Resources.

periods, if the value of the thing stolen is more than 12,000
pesos but does not exceed 22,000 pesos, but if the value of
the thing stolen exceeds the latter amount the penalty shall
be the maximum period of the one prescribed in this
paragraph, and one year for each additional ten thousand
pesos, but the total of the penalty which may be imposed shall
not exceed twenty years. In such cases, and in connection
with the accessory penalties which may be imposed and for
the purpose of the other provisions of this Code, the penalty

310 of the Revised Penal Code

The crime of theft shall be punished by the penalties next higher


by two degrees than those respectively specified in the next
preceding article, if committed by a domestic servant, or with
grave abuse of confidence, or if the property stolen is motor
vehicle, mail matter or large cattle or consists of coconuts
taken from the premises of the plantation or fish taken from a
fishpond or fishery, or if property is taken on the occasion of
fire, earthquake, typhoon, volcanic eruption, or any other
calamity, vehicular accident or civil disturbance. (As amended

An ordinary citizen or a juridical entity, PO, NGO or
any public interest group can file a petition to the
Supreme Court or Stations of the Court of Appeals
that his/her right for a balance or healthful ecology
is being violated or threatened with the violation
of the law or omission or a public official or
employee or private individual entity involving
environmental damage with magnitude as to
prejudice the life, health or property of inhabitants
covering two or more cities or provinces.

Ownership is not an essential element of the offense (illegal


logging). The failure of the information to allege the true
owner of the forest products is not material; it was sufficient
that it alleged that the taking was without any authority or
license from the government.

Section 2. Moratorium on the Cutting and Harvesting


of Timber in the Natural Forests A moratorium on the
cutting and harvesting of timber in the natural and residual
forests of the entire country is hereby declared unless
lifted after the effectivity of this Executive Order.

2.1 The DENR is x x x prohibited from issuing logging


contracts/agreements x x x such as IFMA, SIFMA, CBFMA and other
agreements/contracts with logging components in natural and
residual forests;
2.2 The DENR is likewise prohibited from issuing/renewing tree cutting
permits in all natural and residual forests nationwide, except for
clearing of road right of way by the DPWH, site preparation for tree
plantations, silvicultural treatment and similar activities, provided
that all logs derived from the said cutting permits shall be turned
over to the DENR for proper disposal. Tree cutting associated with
cultural practices pursuant to the indigenous Peoples Right Act

Greening Program shall plant some 1.5
Billion trees covering about 1.5 Million
hectares for a period of six (6) years from
2011 to 2016, in the following lands of the
public domain:

Forestlands
Mangrove and protected areas
Ancestral domains
Civil and military reservations
Urban areas under the greening plan of the LGUs
Inactive and abandoned mine sites; and
Other suitable lands

3.1.1 All students, identified by the DepEd and
CHED and all government employees shall be
individually required to plant a minimum of ten
(10) seedlings per year in areas determined by
the Convergence Initiative. Private sectors and
civil society groups shall likewise be
encouraged to participate in the NGP.
