Code of Conduct and


Ethical Standards for
Public Officials and
Employees

It is an act establishing a code of conduct
and ethical standards for public officials
and employees, to uphold the time
honored principle of public office being a
public trust granting incentives and
rewards for exemplary service,
enumerating prohibited acts and
transactions and providing penalties for
violations thereof for other purposes.

Duties of Public Officials and


Employees
1. ACT PROMPTLY ON LETTERS
AND REQUEST
- Public official/employee shall within
15 working days from receipt
respond to letters, requests; reply
must contain the actions taken on
the request

2. SUBMIT ANNUAL
PERFORMANCE REPORTS
- Within 45 working days from the
end of the year, render a
performance report of the agency

3. PROCESS DOCUMENTS AND
PAPERS EXPEDITIOUSLY
- Must be completed within a reasonable
amount of time
- 3 signatories therein;
- In the absence of a duly authorized signatory,
the next in rank shall sign

4. ACT IMMEDIATELY ON THE


PUBLICS PERSONAL
TRANSACTIONS
- Attend to anyone who wants to avail
services of the office
- Promptly and expeditiously

ACCESSIBLE TO THE PUBLIC
- Readily available for the
inspection of the public within
reasonable working hours

1. FINANCIAL AND MATERIAL

Public Official/Employee shall not directly


or indirectly have any financial or
material interest in a any transaction
requiring approval of their office

2. OUTSIDE EMPLOYMENT AND OTHER
ACTIVITIES RELATED THERETO
- Public Official/Employee shall not:
a) own, control, manage or accept employment as officer, employee,
consultant, counsel, broker, agent, trustee or nominee in any private
enterprise regulated, supervised or licensed by their office unless
expressly allowed by law
b) Engage in private practice of their profession unless authorized by the
constitution (provided that their practice will not conflict with their official
function)
c) Recommend any person to any position in a private enterprise which
has a regular pending official transaction with their office

3. DISCLOSURE AND OR
MISUSE OF CONFIDENTIAL
INFORMATION
- Shall not use or divulge confidential or classified
information officially known to them by reason of their
office and not made available to public

4. SOLICITATION OR
ACCEPTANCE OF GIFTS
- Shall not solicit or accept directly or
indirectly any gift, gratuity, favor,
entertainment, loan or anything of
monetary value from any person in the
course of their official function

- Public official or employee
shall avoid conflict of
interest at all time

- The transfer of title or disposal of interest in property
by voluntarily, completely and actually depriving or
dispossessing oneself of right or title to it in favor of
a person/s other than his spouse and relatives

- When conflict of interest arises; he shall resign from
his position in any private business enterprise within
30 days from his assumption to office and or divest
himself of his shareholdings or interest within 60 days
from assumption
- Same rule apply if the public official/employee is a
partner in a partnership
- The requirement of divestment shall not apply to
those who serve the Govt in honorary capacity,
laborers, casual or temporary workers

PENALTIES
Any Public Official/Employee (whether
casual, temporary, holdover, permanent or
regular capacity) committing any violation
of this act shall be punished:
1. Fine not exceeding 6 months salary equivalent or suspension
not exceeding 1 year, or removal depending on the gravity of
offense after due notice and hearing by the appropriate body or
agency
2. Violations under Prohibited Acts and Transactions, Statement
and Disclosure and Divestment shall be punishable with
imprisonment not exceeding 5 years, a fine not exceeding
P5000 or both and disqualification to hold office

PENALTIES
2. Any violation proven in a proper administrative
proceeding shall be sufficient cause for
removal or dismissal of a Public O/E
3. Private individuals who participate in
conspiracy as co-principals, accomplices or
accessories, with public officials or employees
shall be subject to same penal liabilities as the
Public O/E and shall be tried jointly with them

4. Used of report contrary to morals
or public policy or for commercial
purpose other than by news and
commercials for dissemination in
general public shall be imposed with
a penalty not to exceed P25,000.00
