was in fact only 1 charge remaining to foreclose
[there is nothing to consolidate]

o Varying the chargees priority (enhances
chargees priority)
Where tacking takes place, the tacking chargee
gains priority, not only in respect of the original
sum, but also in respect of a further advance over
subsequent charges

S. 246(1) If any tacking is authorized, any chargee
(whether 1st, 2nd/subsequent chargee) may tack
S. 246(2) tacking is permitted (despite subsequent
chargee giving written notice of the registration of
his charge to 1st chargee) in 2 circumstances:
(a) the making of the advance(s) is expressly
authorised by prior charge; or purpose of charge is
to secure the balance from time to time due to the
chargee under current/ continuing account; OR
(b) advance(s) made with the consent of
subsequent chargee
