Petitionerwasthendeclared'fitfordutyeffectiveon
thatdaypetitionerexecutedareleaseandquitclaim

hisemployersfromfurtherliability.
However,petitionerfiledacomplaintwiththe
laborarbitrationbranchoftheNLRCfor
disabilitybenefit,illness

expenses,damagesandattorney'sfees.
Butitwasdeniedbythelaborarbiterforthe
reasonbecausehewasdeclared'fitforduty
andexecuted a release and quitclaim infavor
ofhisemployersandalreadyreceivedhis
sicknessallowance.

righttoclaimdisabilitybenefitsunderthecontractual
provisionsofthePOEAStandardEmploymentContract
Thecourtheldthattheyrecognizelegitimatewaiversthat
representavoluntaryandreasonablesettlementofa
worker'sclaimwhichshouldberespectedasthelaw
betweenthepartiesmakingitvalidandbinding.
Thatthepetitionervoluntarilyenteredtoitandrepresents
areasonablesettlement,itisbindingonthepartiesand
maynotlaterbedisownedsimplybecauseofachangeof
mind,whereItwasmadewithfullunderstandingonthe
partofthepetitionerandtheconsiderationforthe
quitclaimiscredibleandreasonable,thetransactionmust
berecognizedasavalidandbindingundertaking

Privaterespondedfiletolaborarbiterunder
thegroundsoftheillegalsuspensionbutwas
laterdismissthecomplaint.Thenamotionto
reconsiderwasalsodenied.
ISSUE
whetherornotpublicrespondentNLRCacted
withgraveabuseofdiscretionamountingto
lackofjurisdictioninrenderingthe
aforementioneddecision.
HELD
IthasnotbeenshownthatrespondentNLRChas
unlawfullyneglectedtheperformanceofanactwhichthe
lawspecificallyenjoinsittoperformasadutyorhas
otherwiseunlawfullyexcludedpetitionerfromthe
exerciseofarighttowhichitisentitled
topetitioner'ssubmission,thegrievanceofemployeesis
notamatterwhichrequiresthepersonalactofMr.Abad
andthuscouldnotbedelegated.Petitionercouldatleast
haveassignedanofficer-in-chargetolookintothe
grievanceandpossiblymakehisrecommendationtoMr.
Abad
Underthepolicyofsocialjustice,thelaw
bendsoverbackwardtoaccommodatethe
interestsoftheworkingclassonthehumane
justificationthatthosewithlessprivilegesin
lifeshouldhavemoreprivilegesinlaw.
Theabsenceofmrabadmadeadireeffecton
thepartoftherepondentsanditwasclearof
injustice,Thus,privaterespondentsshould
notbefaultedforbelievingthattheeffectsof
theCBAintheirfavorhadalreadysteppedinto
thecontroversy.

HeisnotentitledforthereasonItbearsstressing
thatpetitioner did not only violate company disciplinary rules
and regulations. AsfoundbytheCourtofAppeals,he falsified
his employment application form by not stating therein that
he is the nephew of Mr. Danao, respondent Wyeths
Nutritional Territory Manager. Also,onFebruary2,1993,he
was suspended for falsifying a gasoline receipt. OnJune28,
1993, he was warned for submitting a false report of his trade
outlet calls. OnSeptember8,1993, he was found guilty of
unauthorized availment of sick, vacation and emergency
leaves. These infractions manifest his slack of moral
principle. In simple term, he is dishonest.
Itsisthewherethecourtstatethattothose
whoinvokesocialjusticemaydosoonlyif
theirhandarecleanandtheirmotives
blameless.Inthecaseatbarthepetitioner
failedtomeasureuptosuchrequirements.
