El Decreto 730 de 2004 del Presidente de la Republica de Colombia
reglamenta el Capitulo XI-2 (Código PBIP) del SOLAS,cuyo
Covenio fué aprobado mediante la Ley 8a de 1980, y será aplicado
en todo el territorio nacional donde existan instalaciones portuarias
dedicadas al comercio exterior y a los viajes internacionales, así
como a los buques de pasajeros y carga de transporte internacional
con arqueo bruto o superior a 500 GT, que recalen en las mismas, y
unidades móviles de perforación mar adentro.
La instalación portuaria que hace mención el Código PBIP para el
caso colombiano se refiere a los puertos y muelles de comercio
exterior y operados o no por sociedades portuarias. La Dirección
General Marítima (DIMAR) del Ministerio de Defensa Nacional será
la autoridad designada por el Gobierno Colombiano para
desempeñar las funciones de protección en relación con las
instalaciones portuarias y de los buques y de aprobar los planes de
protección diseñados para tal fin, vigilado y controlado por la
Superintendencia de Puertos y Transporte.

Esto significa que todo debe estar documentado a bordo del buque
incluyendo las respectivas pólizas. La “Compañía”,la cual se define
como el propietario del buque o cualquier otra persona como el fletador
a casco desnudo,que haya asumido la responsabilidad de la
explotación del buque.Este sistema dbe garantizar el cumplimiento de
todas las reglas obligatorias y que se tengan presentes los
códigos,directrices y normas recomendadas por la OMI y otras
organizaciones.
Los procedimientos prescritos por el Código han de consignarse en la
documentación pertinente,que se reunirá en un manual de la gestión
de la seguridad,del que llevará a bordo un ejemplar.

QUÉ ES EL ISM CODE
BENEFICIOS:
El éxito en la implementacion del código garantiza a la compañía que tenga
bajo control los riesgos de contaminacion ambiental y de seguridad. Entre
otros:
1-Asegurar el cumplimiento de todos los estándares internacionales y la
prevención de la ocurrencia de accidentes.
2-Asegurar los procedimientos en el sitio y el manejo de emergencias a
bordo.
3-Garantizar que existe una adecuada comunicación entre el buque y el
personal de tierra.
4-Asegurar que todos los individuos conocen sus roles y
responsabilidades, están adecuadamente entrenados y mantienen
recursos apropiados para el desarrollo de sus labores.
5-Asegurar que todas las actividades y operaciones son planeadas,
controladas y verificadas (PHVA).

Propósito:
El proposito de esta discusion es suministrar informacion a la luz de la
pérdida del tanquero “Prestige” sobre las ventajas y desventajas de los
tanqueros de casco sencillo y de casco doble (Single hull /double hull).
Discusión:
A partir del accidente del “Exxon Valdez” en los EE.UU nace el OPA 90
(Oil Pollution Act) y en consecuencia se genera la Regla 13 F del Anexo I
de MARPOL la cual obliga a que los buques tanqueros nuevos mayores
de 5000 GRT deben contar con un doble fondo y un doble costado con el
fin de reducir la contaminacion debido a encallamiento o colisión .
