Workmen’s compensation act


A promissory note is an instrument in writing
containing an unconditional undertaking signed
by the maker, to pay a certain sum of money only
to, or order of s certain person, or to the bearer
of the instrument.
Essential elements:
The instrument must be writing
The instrument must be signed by the maker
The instrument must contain a promise to
pay
The promise to pay must be unconditional
The maker of the instrument must be certain
and definite
The sum of money to be paid must be certain
The money must be payable to a definite person
or according to his order
The promissory note may be payable on
demand or after certain definite period of time
A bill of exchange is an instrument in writing
containing an unconditional order, signed by
the maker, directing a certain person to pay a
certain sum of money only to, or to the order
of a certain person or to the bearer of the
instrument
Essential elements of a bill of exchange:
The instrument must be in writing
The instrument must be signed by the drawn
The instrument must contain an order to pay,
which is express and unconditional
The drawer, drawee and the payee must be
certain and definite individuals
The amount of money to be paid must be
certain

Essential feature of cheque:
1.fulfill all the essential requirements of a bill

Dependent:
Section 2 (1-d) gives a list of person who come within
the category of “dependent “ of workman . The
following relation are dependants –
Widow, unmarried, a widow mother etc.

Minor:
A person who has not attained the age of 18 years.
Employer: Employer includes the following
 Anybody of person, whether incorporated or not
 Any managing agent of an employer
 The legal representatives of a dead employer

Partial disablement :
Partial disablement means such disablement as
reduces the earning capacity of a work man in any
employment .
A schedule to see the percentage loss of earning
capacity which is to be presumed in each such case.

 Total disablement:
A temporary or permanent nature, as incapacities of a
workman for all work.

Wages include any privilege or benefit which is
capable of being estimated in monthly. Wages
include all payment which can
be calculated in term of money
Ordinary wages
Extra payment for overtime
Bonus
Free meals
Clothing
Free or chap housing etc.
Monthly Wages: “Monthly” wages means the
amount of wages demand to be payable for
month’s service.
Wages shall be one twelfth of the total wages
due for the last twelve month of the period.
Monthly wages shall be the average monthly
amount which during the twelve month.
In other cases, including cause in which it is not
possible for want of necessary information to
calculate the monthly wages.
Workman: A man who performs manual or
industrial labor wages is called workman.
Workman in any employed to do any manual,
unskilled, skilled, operational etc.

Generally speaking causal work is one which is not
regular or continuous. A person doing odd jobs was
employed by the was of a casual nature. A person
who does service which is illegal and void cannot be
a workman and cannot claim compensation.
When is employer liable to pay compensation?
The employer is liable when
a) Injury is caused to a workman by accident and
b) The accident arise out of and in course of
employment.
An accident as “an unlooked for mishap or
untoward event which is not expected or
designed.

personal injury is not necessary confined to
physical or bodily injury. Injury includes
psychological and physiological injury such as
nervous shock, insanity etc.

With the knowledge and permission of the
employer lives at some distance

Persons employed in certain occupation's are
liable to be attacked by certain diseases. For
example, a person engaged an employment
involving exposure to dust containing silica is
liable to contract silicosis.

b) In respect of any injury not resulting in
death caused by an accident

The amount of compensation:
The act provides for compensation for
1. Death
2. Permanent total disablement
3. Permanent partial disablement
4. Temporary disablement
5. Rules regarding half monthly payment

a) Compensation for death & disability must
deposited with the commissioner.
b) Any other some amounting to not less than
tk.10 which is payable as a compensation.
c) The receipt is recommended as a proof.
d) If owner want to see the list of expenses, the
commissioner must show this.
e) Any worker give to the commissioner false
description, he must be penalty.
f) If any accident occur out side of the company
then the commissioner not give the
compensation.
g) If any worker has not right to the
compensation, the commissioner spend to
the other side for actual worker.
h) Injured parsons must send to the notice.
a) compensation shall be paid as soon as it fall
down.
b) if fail to pay with in one month commissioner
will pay simple interest at 6%.
c) if the commissioner think that there is no
justification for delay way of penalty, he pay
compensation not exceeding than 50%.

information that a workman has died as a
result of an accident and in course of his
employment then he can take necessary
steps for information
1) The circumstances attending the death of
the workman
2) He is liable or not to deposit compensation
on accident of the death
3) The commissioner offer such enquiry as he
inform any of the dependents of the dead

1) Offer to have him examined free of change by a
qualified medical practitioner
2) Half-monthly payment may also be required to
submit for examination from time to time

rules farmed for the purpose

Appointment of commissioner

Powers of commissioners:
a) right to take statement
b) compelling the witness to present for giving
statement
c) compelling to show the required paper
Procedures of commissioners:
1) A commissioner is signified as a court.
2) Right to visit the accident's place and collect
information

Appeal against the order of a commissioner:


1) An order awarding as compensation a lump
sum or half monthly payment.
2) Refusing to allow redemption of a half-monthly
payment.
3) Providing the compensation of dead
workman.
4) Allowing or disallowing any claim for the
payment.
5) Refusing to register a memorandum of
agreement
