Construction Occupational Safety and Health

Course (Legislation)
General Objectives
• Increase the number of competent OSH personnel qualified
to carry-out the provisions of the Occupational Safety and
Health Standards (OSHS),

• thereby promote and maintain safe and healthy workplaces
in different industries.
Specific Objectives
After successful completion of the course:
1. Participants shall have better understanding of the
scope and mission of their safety function

2. Participants shall have a working knowledge about


the Occupational Safety and Health Standards

3. Participants will be able to recognize, identify and
evaluate occupational hazards and recommend a
systematic approach for its prevention and control.

program for their organizations

for recognition as Safety Officer under Department
Order No. 16 of the Department of Labor and
Employment.

• Personnel involved in OSH implementation and other related
OSH activities and programs and any individual desiring to
practice OSH in the country.

Training Requirement
• Completion of the BOSHC
• is required for appointment as Safety Officer* in the
place of employment
• is one of minimum requirements for accreditation as

Safety Practitioner* issued by the Bureau of Working
Conditions (BWC) of the Department of Labor of
Labor and Employment.

Authorization to Conduct BOSH

• The Occupational Safety Health Course (40 Hours in 5


days) is prescribed by the Bureau of Working Conditions
pursuant to Rule 1030 of the OSHS

• Atlantic Safety is duly accredited by the Occupational
Safety and Health Center, Department of Labor and
Employment to conduct COSH Training
Certificate of Completion
1. A pre/post examination/written test shall be required for all
the participants
2. Attendance to all sessions.

Upon completion of above requirements, a DOLE - BWC and


internationally recognized Atlantic Safety Certificate of

Completion will be awarded to the participant
Those who do not complete above requirements will get only a
Certificate of Attendance.

SESSION OBJECTIVES
• Participants shall be able to:
• state the legal basis, purpose and coverage of the OSH
Standards;
• articulate on the responsibilities of management and
workers in maintaining a safe and healthy working
environment;
• state the administrative Rules of the Standards;
• discuss how OSH laws, policies, rules and regulations
are administered and enforced;
• express appreciation and understanding on the
importance of COMPLYING with OSHS.

• The Secretary of Labor shall by appropriate
order set and enforce Mandatory OSH
Standards to eliminate or reduce OSH
hazards in all workplaces and institute new

cities may be allowed to conduct technical

Philosophy of Accident Prevention


• Society as a whole has a moral responsibility to prevent
needless destruction of life and health, particularly in the
workplace

• The employer is primarily responsible for ensuring a safe,


healthy work environment

• Employees are held accountable for following prescribed


safety standards and guidelines.

• Rule 1001 – Purpose and Scope
• To protect every workingman against the dangers of injury, sickness or death
through safe and healthful working conditions,
• thereby assuring the conservation of valuable manpower resources and the
prevention of loss or damage to lives and properties,
• consistent with national development goals and with the State’s commitment
for the total development of every worker as a complete human being.

Rule 1020 - Registration
• Every employer shall register his/her business with the
Regional Labor Office or authorized representative to
provide the DOLE with information as guide in its
enforcement activities.

Rule 1030 - Training and Accreditation of
Personnel in OSH
• The BWC either directly or through accredited
organizations, shall conduct continuing training programs
to increase the supply and competence of personnel
qualified to carry out the provision of this Standards.
• Employer to appoint a safety officer on a full-time or part-
time basis depending on the type of workplace (whether
hazardous or non-hazardous) and number of worker in the
workplace.

Rule 1030 - Training and Accreditation of


Personnel in OSH
• Duties of Safety Officer (also Rule 1047)
• Advice the employer, supervisors and workers on OSH
• Investigate accidents
• Coordinate safety training program
• Conduct safety and health inspection
• Maintain accident records system
• Provide assistance to government agencies in the conduct of health and
safety inspection, accident investigation or any other related programs.

Personnel in OSH
• A full-time safety officer must be a Safety Practitioner
duly accredited by the BWC.

Note: The employment of a full-time safety officer may not be


required if the employer enters into a written contract with a
qualified consultant or consulting organization whose duties
and responsibilities shall be the duties of a safety practitioner
as stated in these Rule. The employment of a consultant,
however, will not excuse the employer from the required
training of his supervisors or technical personnel.

RULE 1045 – Duties of Employer


• Establishes and adopts in writing administrative policies on
safety and health
• Report to the enforcing authority the policies adopted and
required report requirements
• Act on recommended measures of health and safety
committee and in case of non-adoption, to inform the
committee of the reason.

RULE 1046 – Duties of Workers


• Work in accordance with accepted safety principles
• Reports unsafe conditions and practices to the Supervisor
• Serves as member of the Health & Safety Committee
• Cooperates actively with the Health & Safety Committee

inspections.

RULE 1050 - Notification & Keeping of Accident


and/or Occupational Illnesses

• 1053.01: Notification - All work accidents or occupational


illnesses, resulting in disabling conditions or dangerous
occurrences shall be reported by the employer to the
Regional Labor Office
• If Major work accidents results in death or permanent total
disability, employer shall initially notify the Regional Labor
Office within 24 hours
• 1054: Keeping of Records - The employer shall maintain and
keep an accident or illness record which shall be open at all
times for inspection to authorized personnel.

Rule 1060 - Premises of Establishments
• Shall have adequate fire, emergency or danger signs and safety
instructions of standard colors and sizes, visible at all times
• Visible signs for driver of motorized vehicles such as “STOP”, “YIELD”, and
“DO NOT ENTER”
• Facilities and convenient movement of handicapped employees
• Good housekeeping shall be maintained at all times
• Personal facilities: adequate comfort rooms and lavatories separate for
male and female workers. Adequate dressing facilities for female
workers and locker rooms for male workers shall be provided, in
accordance with Article 132, Chapter 1, Title 111, Book 111 of the Labor
Code. Comfort facilities to conform with DOH.

Rule 1070 - Occupational Health and Environmental Control
• The employer shall exert efforts to maintain and control the working
environment in comfortable and healthy conditions for the purpose of
promoting and maintaining the health of his workers
• The employer shall carry out the Work Environment Monitoring (WEM)
where hazardous work is performed and shall keep a record of such
measurement which shall be made available to the enforcing authority
• WEM shall include temperature, humidity, pressure, illumination, ventilation, concentration of
substances in the air and noise levels
• The WEM shall be performed periodically as may be necessary but not
longer than annually.

RULE 1960 - Occupational Health Services

• Emergency Hospital – An employer need not put up an


emergency hospital or dental clinic if there is a hospital or
dental clinic which is not more than five(5) kilometers away
in urban areas and 25 minutes travel in rural areas provided
contracts are entered into with the said hospital or dental
clinic and that the employer provides transportation
facilities.
• PHYSICIAN/DENTIST shall be subject to call at any time in
other shifts during emergencies.

RULE 1960 - Occupational Health Services
• Health Program – The physician engaged by the employer, in
addition to providing medical services in cases of emergency,
must also perform the following:
• Conduct pre-employment medical examination, free of
charge, for the proper selection of workers
• Conduct free of charge annual physical examination of the
workers
• Collaborate with safety and technical personnel in the
selection and placement of workers, including
investigation of work related accidents due to exposure to
health hazards
• Develop and implement a comprehensive health program
for the employees.

ENFORCEMENT OF OSHS

FREQUENCY OF INSPECTION

• Every establishments or place of employment


shall be inspected at least once a year.
• Special inspection visit however, may be
authorized by the Regional Office to investigate
accident, dangerous occurrences, to conduct
survey.
