POAST - conclusions

 The POAST activity has demonstrated that, in general, in


the visited countries a satisfactory and uniform
implementation of the regulations 1592/2002 and
1702/2003 (specifically Part 21 Subpart F and G) was
established.

 The POAST process confirmed the general understanding of


the applicable regulations. Some minor problem areas were
communicated to rulemaking.

 No specific issues with regard to POA - Regulation (EC)


n°1702/2003, Part 21 Subpart F and G - need to be
addressed to the attention of the Commission.

 As of today, more than 80% of findings have been


satisfactorily closed

MAST - main findings

 The status of former Soviet Aircraft, not complying with


airworthiness requirements (Part-21, Part-M, Part-145 and
to some extent Part-66), already mentioned in our 2005
report, is a pan-European issue which has not been solved
yet, a part the noticeable case of Poland (art. 10.5 of reg.
1592/2002).

 Directly related to the previous point is the case of aircraft


considered as Annex II by some competent authorities and
therefore excluded from the application of community
rules, whilst continuing to perform commercial activity.

MAST - main findings

 The lack of standardisation regarding Aircraft Maintenance


Licenses (Part-66) remains an open issue: conversion of
Licences is not properly achieved yet, although
considerable efforts were deployed by the Agency to bring
clarification (special survey, dedicated report,
standardisation meetings).

 It also appeared that Part-M was not properly implemented


in all States due to the novelty of its concept. Approval was
not always done on time or grandfathering from JAR-OPS
Subpart M was improperly applied. More recently, it also
came to light that many States were not systematically
implementing a fleet monitoring programme.

MAST – conclusions

 Uneven distribution of findings demonstrates a non-uniform


implementation of EC N˚ 2042/2003.

 As of today, more than half of the findings have been satisfactorily


closed.

 It was confirmed that certain countries do require deeper attention :


firstly, the Member States, which joined the EuropeaneUnion in 2004
and 2007; secondly, the Member States from previous c as enlargements,

Standardisation strategy

 2007 is allowing the new process to fully deploy; it is also


providing more time to prepare improvements that could
be introduced at the time of the arrival of Operations and
Flight Crew Licensing within the remit of the Agency.

 In 2007 more resources are allocated to the process,


allowing for tighter follow-up and more precise monitoring
of the findings closure.

 Special attention are paid to the involvement of NAAs and


to the due process of training and qualification of the
inspectors (Team Leaders and Team Members).

Standardisation strategy

 Involvement of inspectors of Member States will continue to be one


of the main strategic priorities in the process, in order to share the
technical outputs and to pro-actively achieve standardisation.

 A close coordination will remain necessary between Standardisation


and Rulemaking to bring the required clarifications to the various
parties which are implementing the Rules and to propose
amendments to the same when necessary.

 Close coordination between the Agency’s Standardisation


Department and the European Commission has been established and
remains necessary to effectively and consistently handle the results
of the standardisation activity.
