Contract Agreement
 Obligations of contractor
• Contactor have to do survey, investigation, design, engineering, procurment,
construction and miantenance of the project
• Contactor will remedy all loss and demage to the project from the appointment
date to end of the construction period at the contactor,s cost
• Contactor comply with all aplicable law and permits
• Contactor will build temporaty road and maintain it for tunnel or adit approach.
• Contactor can not sub contact any work in more than 49 % of the total length.
• If volume of the sub contact work is more than 10 % of contract price than
contactor will communicate and information regarding sub contract with Authority
prior to entering into any such su-contract
• If contractor is hiring any foreign personnel then contractor should apply through
requisite authority for work permit and visa
• Project or any part of project should not be used of advertisment of commercial
product
• Contactor has to procure of all power, water and other services that is required for
project.
 Obligations of Authority
• Correctness of the scpe of the project, Project fecilities,
Specifications and standards and criteria for testing of the work
completed.
• Environmental clearances
• Right of way 90 % with in 30 days of date of appointment
• Authority has to pay damages for delaying in ROW in trem of time
extention or money

• If contractor given written request for support for procuring

Applicable permits then Authority has to support the contractor.
• For obtaining all necessary infrastructure Authority can assisst
contractor but rates should not be less that rates in industries
norms.
 Performance Security
• With in 10 days of date of agreement
• Value 5 % of contract price 2697x.05=134.87 cr
• Validity upto 180 days after completion date of defect
liability period
• Additional Performance security required if contract price is
less than 0.9x Estimated project cost.
• If contractor fail to pay PS within 10 days and seek
extension not more than 30 days then there will be fine on
daily basis 0.01* of contract price.
• If contactor pay performance security for two years and for
next year contractor has to submitt that security wirth in 2
months before expire of previous security and return
privious security with in 7 days after submitt new security.
 Release of Performance security
The Authority shall return the Performance
Security to the Contractor within 60 (sixty)days
of the later of the expiry of the Maintenance
Period or the Defects Liability Period under this
Agreement. Notwithstanding the aforesaid, the
Parties agree that the Authority shall not be
obliged to release the Performance Security
until all Defects identified during the Defects
Liability Period have been rectified.
 Retention Money
• Hold 6% of every payment of work as a
guarantee of performance during construction
period.
• Retention money should not exceed 5% of the
contract price.
 Right Of way
• That means giving rights to use the site for
construction and maintenance of project.
• Authorities repersentative and contactor will
make list of inventerory of site that means
vacant land unqcuire land and building
structures road trees or any immovable
property with in 30 days of date of agreement
