Anti-Bullying Act

The Republic Act 10627 or the Anti-Bullying Act of 2013 was


signed into law by Former President Benigno Aquino III on
September 6, 2013. The law requires all elementary and secondary
schools in the country to adopt an anti-bullying policy. According to a
study conducted in 2008 by the Britain-based Plan International, 50
percent of school children in the Philippines experienced bullying
either by their teachers or their peers.

AN ACT REQUIRING ALL ELEMENTARY AND SECONDARY SCHOOLS
TO ADOPT POLICIES TO PREVENT AND ADDRESS THE ACTS OF
BULLYING IN THEIR INSTITUTIONS
Be it enacted by the Senate and House of Representatives of the
Philippines in Congress assembled:
SECTION 1. Short Title. – This Act shall be known as the “Anti-Bullying Act
of 2013”.
Purposes of this Act
SEC. 2. Acts of Bullying. – For purposes of this Act, “bullying” shall refer to
any severe or repeated use by one or more students of a written, verbal or
electronic expression, or a physical act or gesture, or any combination
thereof, directed at another student that has the effect of actually causing or
placing the latter in reasonable fear of physical or emotional harm or
damage to his property; creating a hostile environment at school for the
other student; infringing on the rights of the other student at school; or
materially and substantially disrupting the education process or the orderly
operation of a school; such as, but not limited to, the following:
a. Any unwanted physical contact between the bully and the
victim like punching, pushing, shoving, kicking, slapping,
tickling, headlocks, inflicting school pranks, teasing, fighting and
the use of available objects as weapons;
b. Any act that causes damage to a victim’s psyche and/or
emotional well-being;
c. Any slanderous statement or accusation that causes the
victim undue emotional distress like directing foul language or
profanity at the target, name-calling, tormenting and
commenting negatively on victim’s looks, clothes and body; and
d. Cyber-bullying or any bullying done through the use of
technology or any electronic means.

Ayun sa Batas
Septyembre 12, 2013 nuong naaprubahan atnaging “trending” kaagad ang Anti- Bullying Law. Umani agad ito ng
maraming reaksyon , kuro- kuro, at samot saring opinyon. Subalit, upang mas malinaw sa lahat at ito ay mas lalong
maintindihan nararapat lamang ang masusing pag aaral at pag intindi nito ayun sa itinakda ng Batas. Nuong Desyembre
13, 2013, nilagdaan ni Br. Armin A. Luistro, Kalihim ng Departamento ng Edukasyon, ang “Implementing Rules and
Regulations (IRR)” ng R.A. 10627, o Ang Anti- Bullying Act of 2013. Nararapat lamang na masuri ang Batas na ito
ayun sa IRR para ito ay mas lalong maintindihan ng karamihan. Una, ayun sa IRR, ang saklaw ng Batas na ito ay lahat ng
pampubliko at pribadong kindergarten, elementarya, sekondarya at ang mga tinaguriang “Learning Centers.” (Section 2,
IRR). Isa sa pinaka kritikal na parte ng Batas ay kung ano ang ibig sabihin o paano masabi na a ng isang gawa ay
“Bullying”. Ayun sa Batas at ng IRR nito, ang saklaw ng Bullying ay, ang sobra o paulit–ulit na pag gamit ng isa o higit
pang mga estudyante ng nakasulat, panalita, o “electronic” na pagpapahayag, o ang pisikal na gawa o pag-galaw, o kahit
na ano mang kumbinasyon nito, sa isang estudyante na maka apekto o maglagay sa kanya sa resonabling pagkatakot,
pisikal o emosyonal,o pagkasira sa kanyang ari- arian; pagresulta sa mapang hamong kapaligiran sa estudyante;
paglababag sa karapatan ng isa sa paaralan; o pag sagabal sa proseso ng edukasyon or sa pag papatakbo nito; katulad ng
mga sumusunod:
1.)Hindi kanais nais na pisikal na tagpo sa “Bully at sa biktima tulad ng,panununtok, panunulak, paninipa, pananampal,
pangingiliti, pangu- ngutos, pagsasagawa ng nakakatawang sitwasyon sa paaralan, pagbibiro,pangangaway,at pag gamit ng
mga bagay bilang sandata.
