This is an ordinance enacting the Mandaluyong city
CODE OF PARENTAL RESPONSIBILITY FOR THE
PROTECTION OF CHILDREN’S RIGHTS.
The Mandaluyong City government has on-going efforts
to ensure the safety and well-being of its children.
It is the policy of the Mandaluyong City
Government to protect the interest of child from reckless, careless and negligent parents and to shield them from dangerous or predatory situations arising from such irresponsibility. Layunin nitong lalong mabigyang kaganapan ang tungkulin ng mga magulang na patnubayan and kanilang mga anak para mailayo sa masasamang bisyo at upang managot sa kamalian ng kanilang mga anak bunga ng kanilang kapabayaan sa pagkalinga at sa pagpapalaki sa mga ito. Sila ang mga taong may edad na mas mababa sa 18, o kahit na mas mataas pa sa 18 ngunit di naman kayang pangalagaan at bigyang proteksyon ang sarili laban sa pang-aabuso bunga ng pisikal o mental nilang kundisyon. Mananagot ang ama at ng ina ng bata o kung wala nang magulang ay ang legal na taga- pangalinga (legal guardian) na itinalaga ng Family Code. SECTION 6. SPECIAL PARENTAL AUTHORITY
- The school, its administrators and teachers, or
the individual, entity or institution engaged in child shall have special parental authority and responsibility over the minor child while under their supervision, instruction or custody. Authority and responsibility shall apply to all authorized activities whether inside or outside the premises of the school, entity or institution. States that, criminal liability shall attach to any parent having the parental authority and responsibility who:
#5. Fails to monitor the child’s attendance and
performance in school, and to attend, without justifiable grounds, parent-teacher conferences when required by the school.
#10. Permits the child to possess or use intoxicating
drinks, narcotic drugs, cigarettes and to engage in gambling and other vices or harmful practices. States that, criminal liability shall attach to any parent having the parental authority and responsibility who:
16. Allows his or her child to join gangs,
fraternities or sororities inside or outside school, and who allows to head join, or, in any other manner, participate in hazing and other forms of initiation rites under the R.A. No.8049 Ang ama at ina ay parehong isasakdal, maliban kung ang isa sa mga ito ay “absent” o wala na sa tahanan o namatay o pumanaw na.
Isasakdal lamang ang magulang kung
mapapatunayang sila ay may kapabayaan ayon sa mga itinakdang probisyon ng Ordinansa. SEKSYON 12. KAPABAYAAN SA MGA ANAK O KABATAAN. ANG PANANAGUTAN SA BATAS AY IPAPATAW SA MGA MAGULANG NA MAY TUWIRANG KAPANGYARIHAN AT OBLIGASYON SA MGA ANAK O BATA.
Dahil iisa lamang ang paglabag, isang Ördinance Violation Receipt
(OVR)” din lang ang ii-isyu sa mga magulang.
Kung mag-a-avail ang mga magulang ng “No Contest Provision”,
isang multa lamang ang kanilang babayaran at isang “community service” din ang puwedeng ipataw sa kanila na pwede nilang paghatian ang pagtupad. Section 13. TORTS– Parents shall be civilly liable for the injuries and damages caused by the acts or omissions of their unemancipated children living in their company and under their parental authority subject to the appropriate defenses provided by the law. Section 14. PENALTIES – The acts mentioned hereof shall be punishable as follows:
a.) FIRST OFFENSE – a fine of P1,000.000 or three (3)
months imprisonment, or both, at the discretion of the court; a.) SECOND OFFENSE – a fine of P3,000.000 or six (6) months imprisonment, or both, at the discretion of the court; a.) FIRST OFFENSE – maximum penalty of a fine of P5,000.000 or one (1) year imprisonment, or both, at the discretion of the court; Section 16. ATTENDANCE IN PARENT EFFECTIVENESS SERVICE SESSIONS MANDATORY
In all cases of violations under this Ordinance, the
parents concerned shall always undergo Parent Effectiveness Service Sessions to be conducted in their respective barangays in addition to the penalty imposed. Article VIII – Program for Treatment and Rehabilitation of Drug Dependents
Section 73. Liability of a Parent, Spouse, or Guardian Who Refuses to
Cooperate with the Board or any Concerned Agency.
– Any parent, spouse or guardian who, without valid
reason, refuses to cooperate with the board or any concerned agency in the treatment and rehabilitation of a drug dependent who is a minor, or in any manner, prevents or delays the after-care, follow-up or other programs for the welfare of the accused drug dependent, whether under voluntary submission program or compulsory submission program, may be cited for contempt by the court. Article IV – Participation of the Family, Students, Teachers, and School Authorities in the Enforcement of this act.
Section 44. Heads, Supervisors, and Teachers of Schools – All school
heads, supervisors and teachers shall be deemed persons in authority and, as such, are hereby empowered to apprehend, arrest or cause the apprehension or arrest of any person who violates. They shall be deemed persons in authority if they are in the school or within its immediate vicinity, or even beyond such immediate vicinity if they are in attendance at any school or class function in their official capacity as school heads, supervisors and teachers. Article IV – Participation of the Family, Students, Teachers, and School Authorities in the Enforcement of this act.
Section 44. Heads, Supervisors, and Teachers of Schools – Any teacher
or school employee, who discovers or finds that any person in the school or within its immediate vicinity is liable for violating any of said provisions, shall have the duty to report the same to the school head or immediate superior who shall, in return, report the matter to the proper authorities.
Failure to do so in either case, within a reasonable period from the
time of discovery of the violation shall, after due hearing, constitute sufficient cause for disciplinary action by the school authorities. Article IV – Participation of the Family, Students, Teachers, and School Authorities in the Enforcement of this act.
Section 41. Pagiging Kabahagi ng Pamilya– Ang pamilya bilang bahagi
ng lipunang Filipino ay siyang may pangunahing responsibilidad na tumulong sa pagtuturo, pagmumulat at pagpapalaganap sa kasapi ng pamilya patungkol sa masasamang epekto ng ipinagbabawal na droga at pagbabantay sa miyembro ng pamilya na maaaring malulong sa ipinagbabawal na droga.
