DIGITAL SIGNATURE ACT 1997
• What the Act is about?
- Provides for regulation of public key
infrastructure.
- Make digital signature legally valid and
enforceable as traditional signature.

• Why the Act exist:


- Increases transactions conducted via internet.
- Identities and messages can be falsified
- Removing doubt and possibility of fraud
COMMUNICATIONS AND
MULTIMEDIA ACT 1998
• What the Act is about?
- Restructures of converged ICT industry.
- Create and define a new system of licenses.
- Provide communication and multimedia services.
- Provide the existence of the Communication and
Multimedia Commission.
• Why the Act exist:
- Convergence of technologies is driving convergence of
telecommunication, broadcasting, computing and
content.
TELEMEDICINE ACT 1997
REVOKED/CANCELLED

• What the Act is about?


- Provides that any registered doctor may practice
“telemedicine” but other healthcare providers must first
obtain a license to do so.
• Why the Act exists:
- Healthcare systems and providers around the world are
becoming interconnected.
- Unclear quality healthcare advice and consultation from
specialist because doesn’t have truth value
- To regulate practice of teleconsultations in medical
profession.
COMPUTER CRIMES ACT 1997
• What the Act is about?
- Penalizes who:
* Enter or attempt into computers and computer systems
without authorization.
* Damage or alter data/information in computers or
computer systems by planting viruses.
• Why the Act exists:
- To ensure misuse of computers is an offense.
ELECTRONIC GOVERNMENT LAWS
• DATA PROTECTION BILL 2008/THE PRIVATE
DATA PROTECTION BILL
- The Bill seeks to protect the privacy of personal and
private information of individuals.
• ELECTRONIC GOVERNMENT ACTIVITIES
BILL 2007
- Proposed to enable functions or transactions between
the various government agencies and the citizenry to be
undertaken electronically
- Allows the Government to set down rules on the
manner of electronic dealings from and to the public.
ELECTRONIC GOVERNMENT LAWS
ELECTRONIC TRANSACTION BILL
- Aim: To give legal recognition to electronic
communications and facilitate electronic commerce.
- Primary Focus: All forms of online commercial
activity which are undertaken by companies,
individuals or the Government.

• INFORMATION TECHNOLOGY ACT 2000


- Provides legal recognition for transactions carried
out by means of electronic data interchange.
CONCLUSION
• The existing Cyber Laws created the necessary
impact but constant review is necessary.

• Cyber law controls technology innovations,


business innovations, “criminal” innovations,
globalisation.

• Malaysia is quite advanced in terms of its


legislative and regulatory framework to prepare
ourselves towards the new economy.
