on the public highway (s54)

The 2004 TMA does not replace NRSWA
1991 – “It adds onto it”.

It tightens the regulatory framework under


1991 and gives new powers to Highway
Authorities.

OBJECTIVE:
“Reduce Congestion for all Road Users!”
• Streetworks Legislation
• Duty of street authorities to co-ordinate
all works on the highway
• Duty of work promoters to co-operate in
the process
• TMA – Network Management Duty
• Co-ordinating & planning works &
known events
• Ensuring Parity; applying same
standard or approach to Authority’s
own works as with Promoter works
• TMA is the overarching legislation and
each Authority will have its performance &
compliance monitored
• There are measures that an Authority can
use to control works that it believes could
cause serious traffic disruption
• Directions can affect when and where a
Works Promoter can carry out works in the
Street
• The Street Authority must respond within an
agreed time period if it intends to give a
direction
• The street authority can challenge the
proposed duration of works – “duration
challenge”
TMA states that a Highway Authority has a
duty to:
• Secure the expeditious movement of traffic
on the Authority’s road network

• Facilitating the expeditious movement of


traffic on road networks for which another
Authority is the Traffic Authority

“Enacted in – January 2005”


The Network Management Duty Guidance
states that:
• Parity is an important principle in exercising the
duty. Authorities MUST lead by example
applying the same standards & approaches to
their own activities as to those of others

Criteria also states that:
• Do the authority apply the same standards and
approaches to their own activities as they do to
those of others and do they provide evidence
of this, particularly in relation to utilities’ street
works & developers’ works”
FPN Objectives:
• to encourage accurate and timely notice data
• to improve the co-ordination of works
• to improve data quality for all works promoters
• to contribute to the aim of the Traffic Management Act
2004 - minimising disruption arising from road and street
works

FPN Applicability:
• Applicable only for offences committed after 12th May ‘08
• Sent within 91 calendar days of commission of offence
• Penalty is £120 or discounted to £80 if paid within 29 days
• Once paid no further action can be taken
• Once FPN given, no court action may be commenced until
payment period has expired
Use of FPNs is a sign of failure;
that Authorities & Promoters are • Excessive use of FPNs will lead to challenges, especially if

• FPNs are not a means of providing revenue and should not
be regarded as guarantee income stream, nor should
targets be set for their issue
• A work must always have a one-to-one relationship with a NSG Street
• Related works can be grouped using a project reference
• Notice Periods: The greater the disruption, the longer the Notice
Period required; Notice periods specified are minimum; Longer periods
of Notice should be given and notice information should be updated,
wherever possible
• Under ETON4 (Electronic Transfer of Notices), there is a definitive
format for all Notices
• Day means “working day”, any day except weekends and public &
bank holidays
• Working day is defined as 8:00AM – 4:30PM. Any notice received after
4:30PM is deemed to be given on the next working day
• The notice period starts when the notice is received by the Authority
• Public and personal safety
• Maintain and improve reputation
• Improving the network and reducing the demands on
the network
• Managing events that put further pressure on the
network such as planned road works and events;
emergencies such as accidents or poor weather
conditions
• Improving communications to road users i.e. public
perception on how street works are managed
• Improve internal and external communication

exception scenarios, etc
• Final Output to be evaluated in Module 4
• Information flow is essential between all
stakeholders
• Prompt & Accurate information is vital

• Any failure/inaction will result in severe
financial implications/penalties
