Biomedical Waste (Management and Handling) Rules, 1998 BUSINESS LAW

1. SHORT TITLE AND COMMENCEMENT

1. BMW Rules have been adopted & notified with the objective to stop the indiscriminate disposal of hospital waste/bio-medical waste and ensure that such waste is handled without any adverse effect on the human health & environment. 2. These rules may be called the Biomedical Waste (Management and Handling) Rules, 1998. 3. They shall come into force on the date of their publication in the official Gazette.

Application
Rules are applied to all persons who generate, collect, receive, store, transport, treat, dispose or handles the biomedical waste.

Duty Of Occupier Rule 4 The duty of the occupier is to take all steps to ensure that biomedical waste where ever he generates should be handled without any harm or any adverse effects to human health and environment

Treatment & Disposal Rule 5 1) The biomedical waste shall be treated & Disposed in accordance with Schedule no. I & in compliance with the standards of Schedule no. V of this rules. 2) The setup shall be made for disposal by every occupier with the time schedule as per schedule VI with all relevant facilities mentioned therewith.

Segregation, Packing, Transportation & Storage

Rule No. 6 The law gives details about the Segregation , Packing ,Transportation and storage of the bio medical waste.

Prescribed Authority
Rule No 7 The law gives the details about the prescribed authority. That is who is the authority for getting the authority for granting the authorization & implementing these rules.

Rule No. 8 In case of Occupier In case of Operator In case of Application

Advisory committee & Annual Report Rule no 9 Gives details about the advisory committee. Rule No 10 Provides the details about submission of annual reports.

Maintenance of Record, Accident Reporting & Appeal

Rule No 11 Provides the details about Maintenance of the record required. Rule No 12 Gives details about the reporting of the accident by authorized person in form No III to the authority. Rule No 13 Provides the details about the Appealing to the authority.

Waste sharps (needles, syringes, scalped, blade, glass etc. that may cause puncture & cuts. This includes both used & unused sharps.) Discarded medicines & Cytotoxic drugs. Waste comprising of outdated, contaminated and discarded medicines.) Soiled Waste (items contaminated with blood & body fluids including cotton, dressings, soiled plaster casts, lines, bedding, Other material contaminated with blood)

Yellow Bag
Category 1 - Human Anatomical Category 2 - Animal Waste Category 5 - Discarded medicines and Cytotoxic drugs Category 6 - Soiled Waste.

Red bag Category 3 - Microbiological Waste


Category 6 - Soiled Waste Category 7 - Solid Waste

Blue / white bags


Category 4 Waste Sharps Category 7 Plastic disposable Tubing's

Black Bags
Category 5 Discarded medicines Category 9 Incineration Ash Category 10 Chemical Waste

The Color Coding Notes The Color coding for selected treatment should comply as mentioned in schedule No. I Prohibition of Chlorinated plastic for waste collection No requirement of special bags for categories 8 to 10.

LABEL FOR BIO-MEDICAL WASTE CONTAINERS/BAGS

HANDLE WITH CARE All bags and containers for bio medical waste should be marked with Biohazard symbol & it should be non washable .

Schedule No. V - Reference - Rule No 5 & Schedule No. I Standards for Treatment of Bio Medical Waste Standards For Incinerator :-A. Operating Standards B. Emission Standards

Note:-- Suitably Designed Pollution Control Devices Should be installed with the incinerator to achieve the necessary limits

Standards For Autoclaving :-The Auto Clave shall be dedicated for the purpose of disinfecting & treating biomedical waste.
A. B. C. D. E. While using Gravity flow autoclave. While using Vacuum Autoclave. Details of Time & Temperature. Recording of operational parameters. Validation Test & Routine Test.

Standards for Liquid Waste:-Details of confirming limits for the effluent generated from hospital waste

Standards of Microwaving :-A. Treatment should not be hazardous. B. Microwave system shall comply with efficiency test . C. Microwave should kill bacteria.

Standards For Deep Burial A. Pit Size details B. Restrictions to animals C. Soil Layer details D. Supervision is must E. Impermeable site F. Distance of pit G. Location of Site H. Record keeping

Schedule For Waste Treatment Facilities Like Incinerator / Autoclave/ Microwave system:- Hospitals & Nursing homes for population of 30 lakhs & above Hospitals & Nursing homes for population of below 30 lakhs .
