Apresentao
O comrcio exterior de servios no Brasil tem apresentado historicamente dficits crescentes na conta de servios do balano de pagamentos. Entre 2007 e 2011, o dficit brasileiro na conta de servios cresceu 202%, e, diferentemente do comrcio exterior de bens e mercadorias, caracteriza-se pela carncia de informaes detalhadas, o que compromete a visibilidade econmica do setor, a consecuo de polticas pblicas efetivas (nos campos comercial, tributrio, cambial, de garantias e financiamento), as negociaes internacionais em servios e a disponibilidade de inteligncia mercadolgica para os empreendedores. Essa carncia de informaes acuradas dificulta, ainda, a aferio dos resultados das polticas pblicas voltadas para o setor tercirio. Consciente dessa realidade, a Secretaria de Comrcio e Servios (SCS), do Ministrio do Desenvolvimento, Indstria e Comrcio Exterior (MDIC), tem trabalhado ativamente para ampliar as fontes de informaes sobre o comrcio exterior de servios brasileiro e com isso contribuir para o processo de tomada de decises do governo e do setor privado. Uma iniciativa importante a publicao anual pela SCS/MDIC, com o apoio do Banco Central do Brasil, do Panorama do Comrcio Internacional de Servios. O Panorama disponibiliza dados sobre a Balana Brasileira de Comrcio Exterior de Servios e suas variaes anuais; sobre as exportaes e importaes das empresas por porte; sobre as principais regies blocos e pases das exportaes e importaes brasileiras, por setor CNAE; alm de uma viso geral sobre o setor tercirio no Brasil. No ano de 2011, o setor tercirio respondeu por 67,0% do PIB, um pequeno acrscimo em relao a 2010, quando o setor contribuiu com 66,6% no valor adicionado ao PIB (conforme dados revisados do IBGE). O setor tercirio, incluindo empregos do setor pblico, participa com 78,4% dos empregos formais do pas, segundo dados da RAIS 2010, do Ministrio do Trabalho. Em 2011, o comrcio exterior de servios brasileiro apresentou dficit da ordem de US$ 36,7 bilhes, com variao de 23,8% em relao a 2010. Cabe destacar que as exportaes de servios do Pas tiveram um acrscimo de 21% de 2010 para 2011, enquanto as exportaes mundiais cresceram 7,8% no mesmo perodo, o que representou o 23 maior crescimento do mundo e posicionou o Brasil na 30 posio dos maiores exportadores mundiais. No mesmo perodo, as importaes tambm aumentaram. Enquanto as importaes do mundo cresceram 4,0%, as importaes brasileiras de servios avanaram 22,4% (19 maior crescimento do mundo, enquanto em 2010 o pas ocupou a 7 posio). Esses dados demonstram que o pas tem aumentado sua participao no comrcio exterior de servios. Dentre os pases dos BRICS, em 2011, o Brasil apresentou US$ 36 bilhes de dficit no comrcio exterior de servios, a Rssia apresentou igualmente US$ 36 bilhes de dficit, a ndia apresentou US$ 18 bilhes de supervit, a China US$ 54 bilhes de dficit (maior dficit do mundo) e a frica do Sul US$ 8 bilhes de dficit. Analisando o Mercosul, a Argentina apresentou US$ 6 bilhes de dficit, o Uruguai US$ 2 bilhes de supervit, e o Paraguai no disponibilizou ainda os dados de 2011 para a Organizao Mundial do Comrcio. O Sistema Integrado de Comrcio Exterior de Servios, Intangveis e Outras Operaes que Produzam Variaes no Patrimnio (Siscoserv) e a Nomenclatura Brasileira de Servios, Intangveis e Outras Operaes que Produzam Variaes no Patrimnio (NBS) so outras
iniciativas da SCS/MDIC para disponibilizar informaes sobre o comrcio exterior de servios e com isso aperfeioar a consecuo, a gesto e o monitoramento das polticas pblicas do setor. A Lei n 12.546, de 14 de dezembro de 2011, instituiu a obrigao de prestar informaes para fins econmico-comerciais ao MDIC relativas s transaes entre residentes ou domiciliados no Pas e residentes ou domiciliados no exterior que compreendam servios, intangveis e outras operaes que produzam variaes no patrimnio das pessoas fsicas, das pessoas jurdicas ou dos entes despersonalizados. A lei previu ainda que essas informaes devero ser utilizadas no auxlio gesto e ao acompanhamento dos mecanismos de apoio ao comrcio exterior de servios, intangveis e s demais operaes, institudos no mbito da administrao pblica. A Portaria MDIC n 113, de 17 de maio de 2012, definiu os prazos, limites e condies do registro da prestao de informaes, estabelecendo que a Secretaria de Comrcio e Servios o rgo responsvel na estrutura do MDIC para o tratamento dessas informaes. A Portaria Conjunta RFB/SCS n 1.908, de 19 de julho de 2012, instituiu o Siscoserv, para prestao das informaes relativas ao registro das operaes de comrcio exterior de servios e de intangveis do Brasil, para auxlio a gesto dos mecanismos de apoio ao comrcio exterior de servios e intangveis, assim como para a divulgao de estatsticas tempestivas e apuradas sobre esse comrcio. A Portaria Conjunta RFB/SCS n 1.965, de 31 de julho de 2012 aprova os Manuais Informatizados dos Mdulos Venda e Aquisio do Siscoserv. Os manuais so os documentos de carter normativo que auxiliam o usurio na prestao das informaes no Siscoserv. A NBS e suas Notas Explicativas (NEBS), instituda pelo Decreto Presidencial n 7.708, de 02 de abril de 2012, disponibilizou no Brasil uma classificao harmonizada para a formulao de polticas pblicas de comrcio e servios, tanto nos campos comercial, tributrio, cambial, de garantias e financiamento. Com a NBS, passa a ser possvel classificar os servios e intangveis como produtos, como j ocorria com os bens e mercadorias por meio da Nomenclatura Comum do Mercosul, o que possibilita uma maior calibragem pelo Governo Federal das polticas pblicas voltadas para o fomento deste setor. A SCS acredita que o Panorama do Comrcio Internacional de Servios, o Siscoserv, a NBS, alm de outras medidas que esto sendo adotadas no mbito do Plano Brasil Maior, contribuem para o aperfeioamento da produo de estatsticas do comrcio exterior de servios do Pas. A disponibilidade de informaes imprescindvel para apoiar as empresas brasileiras do setor de servios na superao de desafios em seu processo de internacionalizao e para a orientao das polticas pblicas para esse setor.
Presentation
The foreign trade in services in Brazil has presented growing deficits in the balance of payments services account. Between 2007 and 2011, the Brazilian deficit in the services account increased by 202%.Unlike the foreign trade of goods and merchandises, the foreign trade in services is characterized by the lack of detailed information, which impairs the sectors economic visibility, the design of effective public policies, international negotiations on services and availability of market intelligence for entrepreneurs. This lack of accurate information also hampers the measurement of results of public policies for the tertiary sector. Aware of this reality, the Secretariat of Commerce and Services (SCS), of the Ministry of Development, Industry and Foreign Trade (MDIC), has been actively working to expand the sources of information about the Brazilian foreign trade in services and, thus, contribute to the decision-making process of the government and the private sector. An important initiative is the annual publication, by the SCS/MDIC, with the support of the Central Bank of Brazil, of the Overview of the International Trade in Services. This Overview provides data on the Brazilian Balance of Trade in Services and its annual variations; on imports and exports of enterprises by size; leading countries, blocks and countries in which concerns Brazilian exports and imports, by ISIC sector; as well as provides an overview of the tertiary sector in Brazil. In 2011, the tertiary sector accounted for 67.0% of Brazilian GDP, a slight increase compared to 2010, when the sector contributed to 66.6% of the GDP (according to revised data from IBGE). The tertiary sector, including public sector jobs, contributes with 78.4% of countrys formal employment, according to the RAIS 2010 data, from the Ministry of Labour. In 2011, the Brazilian foreign trade in services registered a deficit of US$ 36.7 billion, growth of 23.8% compared to 2010. From 2010 to 2011, while Brazilian services exports of services grew 21%, world exports grew 7.8%, which placed Brazil in the 30th position of the largest exporters of services in the world. In the same period, it is also noticed an increase of services imports. While world imports grew 4.0%, Brazilian imports of services advanced 22.4% (19th biggest growth in the world, from 7th position in 2010). These data demonstrate that the country has increased its participation in foreign trade in services. Among BRICS countries, in 2011, Brazil registered a deficit of US$ 36 billion in the foreign trade in services; Russia also registered a deficit of US$ 36 billion, India registered a surplus of US$ 18 billion; China a deficit of US $ 54 billion (largest deficit in the world) and South Africa a deficit of US$ 8 billion. Analyzing MERCOSUR, Argentina registered a deficit of US$ 6 billion; Uruguay a surplus of US$ 2 billion, and Paraguay did not provide yet data concerning 2011 for the World Trade Organization. Other initiatives of the SCS/MDIC to provide information on foreign trade in services are the Integrated System of Foreign Trade in Services and Intangibles (Siscoserv) and the Brazilian Nomenclature of Services and Intangibles (NBS). These initiatives will positively impact the formulation, management and monitoring of public policies for the tertiary sector. The Law 12546 of December 14th, 2011, foresees the obligation to provide information for economic and commercial purposes to the MDIC relating to transactions between residents or domiciled in the Country and resident or domiciled abroad, which include services and intangibles. The law also established that such information should be used to assist the management and
monitoring of mechanisms for supporting foreign trade in services and intangibles, within the public administration. The MDIC Act nr. 113 of May 17, 2012, defined the terms, limits and conditions for registering the information, establishing that the Secretariat of Commerce and Services is responsible in the structure of the MDIC for the treatment of such information. The Joint Act RFB / SCS nr. 1908 of July 19, 2012, instituted the Siscoserv to provide information regarding the registration of Brazils foreign trade operations of services and intangibles, to assist the management of mechanisms that supports foreign trade in services and intangibles, as well as for the dissemination of timely and accurate statistics on this trade. The Joint Act RFB / SCS nr. 1965 of July 31, 2012 approves the user manuals of the Sale and Acquisition Modules. The manual are legal documents that help the users as guidelines on registration. The NBS and its Explanatory Notes (NEBS), established by Presidential Decree 7.708 of April 2nd, 2012, released in Brazil a harmonized classification for the formulation of public policies on trade and services, both in the subjects of trade, taxation, foreign exchange, guarantees and financing. With the NBS, it becomes possible to classify the services and intangibles such as products, similar to what occurrs with goods and commodities through the MERCOSUR Common Nomenclature, which enables a higher grading, by the Federal Government, of the public policies designed to promote the tertiary sector. The SCS believes that the Overview of the International Trade in Services, the Siscoserv, the NBS, as well as other measures being adopted under the Brasil Maior Plan, contribute to improve the production statistics of foreign trade in services in the Country. The availability of information is essential to support Brazilian companies of the services sector to overcome challenges in their internationalization process and to the orientation of public policies for this sector.

1) Os referidos dados foram obtidos das receitas e/ou despesas da Conta de Servios do Balano de Pagamento excludos os dados da Conta de Servios Governamentais, conforme definido pelo Manual de Estatsticas do Comrcio Internacional de Servios. O referido Manual organizado pela OMC, OCDE, ONU, FMI, UNCTAD e Comunidades Europeias. (http://www.wto.org/english/res_e/statis_e/its_manual_e.htm) 2) As informaes disponibilizadas pelo Banco Central do Brasil, contidas neste Panorama do Comrcio Internacional de Servios, tm por origem os dados obtidos a partir das receitas e despesas da Conta de Servios do Balano de Pagamentos, excludos os Servios Governamentais. Explanatory Notes
1) The referred data were obtained from the Revenues and/or Expenditures Categories of the Balance of Payments Services Account (with the exclusion of the data from the Government Services Account), as defined by the Manual on Statistics of International Trade in Services.The Manual has been developed and published by the WTO, the OECD, the United Nations, the IMF, UNCTAD and the European Communities. (http://www.wto.org/english/res_e/statis_e/its_manual_e.htm) 2) The information presented in this Overview of International Trade in Services and provided by the Central Bank of Brazil was based on revenues and expenditures data of the Balance of Payments Services Account, not included Governmental Services. These data show differences from the results for Brazilian services exports and imports by State, by Countries of Acquisition of Exports and Countries of Payments of Imports of Brazilian Services, and by company size, due to the following methodological criteria adopted: - The Services Account takes into consideration the revenues and expenditures related to Transport, Insurance, International Travel and Governmental Services; - However, the data on Federation Units and on Countries of Acquisition of Brazilian Exports of Services and on Countries of Destination of Payments for Brazilian Imports of Services do not take into account the revenues and expenditures related to Transport, Insurance, International Travel and Governmental Services. For these data, group codes 45 and 48 were considered, according to the Brazilian Regulation on Foreign Exchange Market and International Capitals. 3) For further information on the definitions of the National Classification of Economic Activities (CNAE 2.0), please visit http://www.cnae.ibge.gov.br/. 4) The CNAE classifies the category Information Services as comprehending information technology security services, information database for research and analysis, telecommunication services, special cartographic information services, and tourism assistance services (http://www.cnae.ibge.gov.br/pesquisa.asp). 5) According to IBGE, value added refers to the value that the activity adds to goods and services consumed in the productive process. It is the contribution to the GDP by the several economic activities, calculated by the difference between the production value and the intermediate consumption in all these activities. 6) The data refer to selected countries and do not constitute a ranking. 7) The parameters for sorting by company size are shown in the table below. According to the methodology adopted, the result obtained for the larger size prevails.

World Trade Organization (WTO) (http://statwto.org/StatisticalProgram/WSDBStatProgramHome.aspx?Language=e) 3. Annual Survey on Services (PAS), developed and published by the Brazilian Institute of Geography and Statistics (IBGE) (http://www.ibge.gov.br/home/estatistica/populacao/trabalhoerendimento/pnad2008/default.shtm) 4. RAIS 2010 Annual Listing of Social Information, published by the Ministry of Labor and Employment. The differences in the results are attributed to distinct methodologies adopted by sources mentioned in (1) and (2) above for the measurement of the Brazilian foreign trade in services.
Siscoserv e NBS
Em 1 de agosto de 2012, o Governo Federal implantou o Sistema Integrado de Comrcio Exterior de Servios, Intangveis e Outras Operaes que Produzam Variaes no Patrimnio - Siscoserv, uma ferramenta utilizada para o aprimoramento das aes de estmulo, formulao, acompanhamento e aferio das polticas pblicas relacionadas a servios e intangveis bem como para a orientao de estratgias empresariais de comrcio exterior de servios e intangveis. Maiores informaes: http://www.mdic.gov.br/sitio/interna/interna.php?area=4&menu=2234 Esse Sistema guarda conformidade com as diretrizes do Acordo Geral sobre Comrcio de Servios (GATS) da Organizao Mundial do Comrcio (OMC), aprovado pelo Decreto Legislativo n 30, de 15 de dezembro de 1994, e promulgado pelo Decreto no 1.355, de 30 de dezembro de 1994. O pblico alvo do Siscoserv so os residentes e domiciliados no Brasil que realizam operaes de comercializao de servios, intangveis e outras operaes que produzem variaes no patrimnio das entidades, com residentes ou domiciliados no exterior, dentre as quais as operaes de exportao e importao de servios. O Siscoserv conta com dois Mdulos: Venda e Aquisio. Mdulo Venda: so registradas as operaes de venda de servios, intangveis e outras operaes que produzam variaes no patrimnio, por residentes ou domiciliados no Pas a residentes ou domiciliados no exterior. Este mdulo abrange tambm o registro das operaes realizadas por meio de presena comercial no exterior. Mdulo Aquisio: so registrados os servios, intangveis e outras operaes que produzam variaes no patrimnio, adquiridos por residentes ou domiciliados no Pas de residentes ou domiciliados no exterior. A legislao relativa ao Siscoserv e os manuais informatizados dos Mdulos Venda e Aquisio, contendo orientaes sobre o registro esto disponveis em http://www.mdic.gov.br/sitio/interna/index.php?area=4 Para fins de registro no Siscoserv e para possibilitar um melhor direcionamento das polticas pblicas neste setor, os servios, os intangveis e as demais operaes sero classificados com base na Nomenclatura Brasileira de Servios, Intangveis e outras Operaes que Produzam Variaes no Patrimnio (NBS), possuindo como elemento subsidirio para a sua interpretao as Notas Explicativas da Nomenclatura Brasileira de Servios, Intangveis e Outras Operaes que Produzam Variaes no Patrimnio (NEBS). Maiores informaes: http://www.mdic.gov.br/ sitio/interna/interna.php?area=4&menu=3412 A NBS e as Notas Explicativas tiveram sua instituio autorizada pelo artigo 24 da Lei n 12.546/2011 e foram institudas pelo Decreto n 7.708, de 02 de abril de 2012. Sua elaborao teve por base a Central Product Classification (CPC 2.0), classificador utilizado em todos os acordos comerciais firmados e em negociao pelo Brasil e tambm pelos Pases Membros da OMC.
Siscoserv and NBS

On August 1st, 2012, the Federal Government of Brazil putted into production the Integrated System of Foreign Trade in Services and Intangibles (Siscoserv), a tool used for the improvement of the actions related to the stimulus, formulation, supervision and measurement of public politics related to services and intangibles, as well as to the orientation of business strategies of foreign trade in services and intangibles. More information is available at: http://www.mdic.gov.br/sitio/interna/interna.php?area=4&menu=2234 This system complies with the guidelines of the General Agreement on Trade in Services (GATS) of the World Trade Organization (WTO), incorporated to Brazillian Law by the Legislative Decree n. 30 dated December 15 th, 1994 and promulgated by Decree No. 1355, dated December 30 th, 1994. The target audience of the SISCOSERV are natural and juridical persons resident and domiciled in Brazil that perform operations involving services and intangibles with natural and juridical persons resident or domiciled abroad, among which the operations of services and intangibles exports and imports. The Siscoserv have two modules: Sale and Purchase. Sale Module: register operations of services sales, intagibles, by residents or domiciled in the country to residents or domiciled abroad. This module also covers the registration of transactions through commercial presence abroad. Purchase Module: register services and intangibles, acquired by residents or domiciled in the country from resident or domiciled abroad. The legislation related to the Siscoserv and the user manuals of the Sale and Acquisition Modules, containing the guidelines on registration, are available at: http://www.mdic.gov.br/sitio/interna/index.php?area=4 For registration purposes in the Siscoserv and to enable better targeting of public policies in this sector, all services and intangibles will be classified using the Brazilian Nomenclature of Services and Intangibles (NBS) (Nomenclatura Brasileira de Servios, Intangveis e outras Operaes que Produzam Variaes no Patrimnio), having as subsidiary element for its interpretation the Explanatory Notes of the Brazilian Nomenclature of Services and Intangibles (NEBS) (Notas Explicativas da Nomenclatura Brasileira de Servios, Intangveis e Outras Operaes que Produzam Variaes no Patrimnio).
