Enquadramento Com vista a estabelecer de forma clara os limites na actuao da Administrao Tributria (AT) em sede do Procedimento de Fiscalizao Tributria (PFT), bem como as garantias dos contribuintes decorrentes da inspeco, foi aprovado o Decreto n 19/2005, de 22 de Junho: Regulamento do Procedimento de Fiscalizao Tributria (RPFT) . O RPFT estabelece de forma clara os limites de verificao das realidades tributrias dos Sujeitos Passivos (SP), nomeadamente no tocante ao cumprimento das suas obrigaes tributrias e preveno de infraces tributrias, bem como as garantias estabelecidas por lei para o efeito. Assim, com o presente texto pretendemos abordar os limites e deveres impostos AT na sua actuao bem como os direitos que assistem aos SP em sede do PFT. 2. O Incio do Procedimento de Fiscalizao Tributria (PFT) Segundo o Professor Joaquim Freitas da Rocha, na sua obra em sede do PFT a AT dever observar aos princpios da legalidade, da verdade material, da proporcionalidade, do contraditrio e da cooperao, compreendendo na sua actuao, entre outras, as seguintes constataes: (i) confirmao dos elementos declarados pelos SP, (ii) indagao de factos tributrios no declarados pelos SP, (iii) inventariao e avaliao de bens, mveis ou imveis, e (iv) realizao de percias ou exames tcnicos quando necessrio. Nos termos do n 1 do art. 44 do RPFT, o incio do PFT deve ser notificado ao SP com uma antecedncia mnima de 2 (dois) dias e mxima de 5 (cinco) dias. A notificao para incio do PFT efectua-se por carta-aviso, fazendo- se meno identificao do SP, o mbito e extenso do PFT, indicao por remisso dos normativos prevendo os direitos, deveres e garantias dos SP. Excepcionalmente, h lugar dispensa de notificao prvia para a realizao do PFT (cfr o n 1 do art. 45 do RPFT) quando existam razes que justifiquem e a notificao antecipada do incio do procedimento de fiscalizao for, por qualquer motivo, susceptvel de comprometer o seu xito ou o procedimento tiver por finalidade apenas a consulta, recolha ou cruzamento de documentos/dados. Do Procedimento deFiscalizao Tributria Ebrahim Bhikha * CAPITAL Magazi ne MAIO 2013 49 |C|||| ||C|.|||||C||| Do Procedimento deFiscalizao Tributria (I) Pese embora as excepes acima referidas, legtima a oposio pelos SP aos actos de fiscalizao com fundamento na falta de credenciao dos funcionrios incumbidos da sua execuo, conforme previso legal do art. 42 do RPFT. O PFT realizado no horrio normal de funcionamento da actividade do SP, porm mediante acordo com este ltimo, e em casos excepcionais, poder ser praticado fora do horrio normal. 3. Consequncias do Procedimento Inspectivo Uma vez concluda a prtica de actos de recolha de informao sobre o SP, este deve ser notificado atravs da emisso da respectiva Nota de Constataes (NC), com a identificao desses actos e a sua fundamentao (cfr. art. 54 do RPFT). A NC dever fixar um prazo entre 8 (oito) a 15 (quinze) dias para que o SP se pronuncie, podendo o SP prescindir da resposta escrita, e optar por prestar verbalmente as suas declaraes, que sero reduzidas a termo pela AT. Findo o pronunciamento do SP, e num prazo de prazo de 5 (cinco) dias aps o conhecimento pela AT das declaraes ou resposta do SP, ser elaborado o relatrio final definitivo (cfr. n 4 do art. 54 do RPFT). As concluses do relatrio do PFT que alterem a situao tributria do SP devem ser notificadas ao mesmo no prazo de 10 (dez) dias aps a elaborao do referido relatrio, com vista identificao e sistematizao dos factos detectados e sua qualificao jurdico tributria. Do relatrio definitivo pode-se concluir que: (i) que h lugar, apenas, ao pagamento do imposto adicional, (ii) houve cometimento de alguma infraco tributria, podendo haver, igualmente, lugar ao pagamento do imposto adicional, ou (iii) no h lugar nem a infraco tributria e nem sequer a pagamento de imposto adicional. Neste ltimo caso, o PFT arquivado pela AT no tendo qualquer seguimento, ao contrrio do que sucede nos casos em (i) e (ii) que sero objecto de uma abordagem no prximo texto. 4. Nota final Em regra, o PFT deve ser visto de uma perspectiva educacional, com vista educao do SP no cumprimento das suas obrigaes tributrias e organizao da sua escrita em conformidade com a lei. Porm, e em determinadas situaes, quando existam indcios claros de que a situao apurada no vai ao encontro do previsto na legislao, a AT pode impor multas pelo incumprimento, como forma de persuadir o SP a evitar situaes desta natureza no futuro. Pelo acima exposto e dado que o PFT tem um carcter intrusivo na vida da actividade comercial do SP inspecionado, consubstanciando em determinadas situaes verdadeiros momentos interruptivos da sua actividade, dada a necessidade de acompanhamento, prestao de informaes e disponibilizao de documentos AT, torna-se importante que o SP saiba de antemo quais os seus direitos e deveres decorrentes do PFT estabelecidos pela lei. Context In order to clarify the limits of the Tax Administration (TA) on the actions within the procedure of the Tax Inspection (TIP), as well as the guarantees for the taxpayers arising from the inspection, the Decree No. 19/ 2005 of June 22: Regulation of Tax Inspection Procedure (RTIP) was approved. The RTIP clearly establishes the limits of verification of the realities of the Citizens Tax Liabilities (Taxpayers), particularly with regard to the fulfilment of their tax obligations and the prevention of tax offenses, as well as the guarantees established by law for this purpose. Thus, this text is intended to address the limits and duties imposed on the TA concerning its action and the rights of the taxpayers with regard to TIP. 2. Introduction of the Tax Inspection Procedure (TIP) According to Professor Joaquim Freitas da Rocha, in his book in TIP, TA should observe the principles of legality, material truth, proportionality, adversarial and cooperation, including in its action , among others, the following findings: (i) confirmation of the elements declared by the taxpayers, (ii) tax investigation of facts not reported by the taxpayers, (iii) inventory and assessment of movable or immovable property, and (iv) conducting skills or technical examinations whenever necessary. Pursuant to paragraph 1 of Article 44 of RTIP, the introduction of TIP should be notified to the taxpayers with a minimum of two (2) days and a maximum of five (5) days. The notification for the introduction of TIP shall be by letter of warning, mentioning the identity of the taxpayers, the scope and extent of TIP, the indication by remission of the normative establishing the rights, obligations and guarantees of the taxpayers. Exceptionally, there is a room for waiving notice to perform the TIP (cf. paragraph 1 of Art. 45 of RTIP) when there are reasons that justify it and if advancing the notification concerning the introduction of the inspection procedure is, for whatever reason, likely to compromise its success or if the procedure is only for reference, collection or crossing documents/ data. Tax Inspection Procedure Ebrahim Bhikha * |C|Y ||C|.|||||C||| Tax Inspection Procedure (I) Despite the above exceptions, the opposition of taxpayers to the inspection acts is legitimate on grounds of lack of accreditation of the officials responsible for its implementation, pursuant to the legal provisions of Art. 42 of RTIP. Note that the TIP is conducted during normal operating activity of the taxpayers by agreement with the latter, and in exceptional cases, it may be done outside normal working hours. 3. Consequences of the Inspection Procedure Once the collection of information regarding the taxpayers is concluded, they should be notified through the issue of the Findings Note (FN), with the identification of such acts and their reasons (cf. art. 54 of RTIP). The FN should set a deadline of 8 (eight) to 15 (fifteen) days for the taxpayers to react, or may even waive the written answer, and choose to verbally provide statements, which will be reduced under the terms of the TA. After the pronouncement of the taxpayers and within a period of five (5) days after the TA has been informed about the statements or answers provided by the taxpayers, the final report shall be prepared (see paragraph 4 of art.54 of RTIP). Taxpayers should be notified of the conclusions of the TIP report affecting their tax status within ten (10) days after the preparation of the report, for the identification and systematization of the facts that were found and their tax legal qualification. From the final report it can be concluded that: (i) there is room only for the payment of additional tax, (ii) there was some tax offense, and there may also be a room for the payment of additional tax, or (iii) there is no place both for tax offense and the payment of additional tax. In the latter case, the TIP is terminated by the TA with no follow-up, unlike what happens in the cases in (i) and (ii) which will be discussed in the next text. 4. Final note As a rule, the TIP should be seen from an education perspective, with a view to educating the taxpayers to comply with their tax obligations and organize their accounting records in accordance with the law. However, in certain situations, when there are clear indications that the situation found does not meet what is required by law, the TA may impose fines for non-compliance as a way of persuading the taxpayers to avoid such situations in the future. For the above and given that the TIP has an intrusive character in the commercial activity of the taxpayers that have been inspected, in certain situations leading to the interruption of their activity, given the need for monitoring, reporting and provision of documents to the TA, it is important for the taxpayers to know in advance their rights and obligations arising from the TIP established by law.
