RESUMO
De forma primária, este artigo tem como principal objetivo a pesquisa das principais e
relevantes causas, atuais, da lentidão do judiciário brasileiro juntamente com seus
principais desafios e falácias citados e, assim, buscar as soluções possíveis para resolver
a maior problemática do acesso à justiça no Brasil. Outrossim, objetiva também ampliar
o debate acerca do tema, em especificidade as razões da origem do presente problema, a
fim não só de solucioná-lo como também de prevenir casos parecidos no nosso
judiciário e no sistema de justiça ao redor do mundo, por fim, tem como objetivo final a
análise de como uma tentativa de alcançar o pleno acesso à justiça, com a constituição
apelidada de cidadã, a de 1988, foi posteriormente a principal causa para o agravamento
e manutenção do problema a qual tentava solucionar. No mais, foi-se usado como
metodologia duas abordagens, a quantitativa para identificar os principais obstáculos e
áreas congestionadas, considerada apropriada para o presente caso, tendo em vista o
amplo tema em questão, uma vez que será analisado todo o sistema jurídico brasileiro, o
qual conta com 2.682 comarcas. Já a qualitativa, sendo esta a mais proeminente, a fim
de minuciar e questionar as melhores soluções, fora feito revisões e comparações de
textos, artigos e autores relevantes ao tema, bem como análise das resoluções do CNJ e
do Congresso Nacional sobre o assunto. De forma a concluir, destacou-se como
prováveis soluções para a problemática apresentada a necessidade premente de
modernização para promover eficiência e agilidade, uniformizações de práticas e
procedimentos em todas os estados jurisdicionais e a capacitação dos profissionais,
aliada à modernização.
ABSTRACT
Primarily, this article's main objective is to research the main and relevant current causes
of the slowness of the Brazilian judiciary along with its main challenges and fallacies
mentioned and, thus, seek possible solutions to resolve the biggest problem of access to
justice in Brazil. Furthermore, it also aims to expand the debate on the topic, specifically
the reasons for the origin of this problem, in order not only to solve it but also to prevent
similar cases in our judiciary and in the justice system around the world, finally , has as
its final objective the analysis of how an attempt to achieve full access to justice, with
the so-called citizen constitution, that of 1988, was subsequently the main cause for the
worsening and maintenance of the problem it was trying to solve. Furthermore, two
approaches were used as methodology, the quantitative one to identify the main
obstacles and congested areas, considered appropriate for the present case, in view of
the broad theme in question, since the entire Brazilian legal system will be analyzed,
which has 2,682 districts. As for the qualitative, in order to detail and question the best
solutions, reviews and comparisons of texts, articles and authors relevant to the topic
were carried out, as well as analysis of the resolutions of the CNJ and the National
Congress on the subject. In conclusion, the pressing need for modernization to promote
efficiency and agility, standardization of practices and procedures in all jurisdictional
states and the training of professionals, combined with modernization, stood out as
likely solutions to the problem presented.
