ABSTRACT
Just War Theory: ethico-juridical and politico-philosophical aspects of
the laws of war
The paper conjectures about the Just War Theory, its political-
philosophical roots and ethico-legal implications on the modern warfare.
Firstly, it contextualises the legal and political history of the International Law
of the use of Force, passing through the founding fathers of the theory, as
Bartolomé de las Casas, Juan Ginés de Sepúlveda, Francisco de Victoria,
Hugo Grotius, Samuel Pufendorf and Emmer de Vattel. Secondly, it mentions
the dual elements of Just War Theory: the Jus ad Bellum and the Jus in Bello.
Thirdly, it argues about the principle of proportionality, its indetermination and
openness. Lastly, it summarises the main ideas arguing that it has an intrinsic
connection between colonialism and the ethico-legal dispositions on the use of
force in international relations.

5.CONSIDERAÇÕES FINAIS
A Teoria da Guerra Justa apresenta-se, em seu próprio auto-retrato,
como uma tentativa de ponderação, determinando as motivações para o
emprego da violênciainstitucionalizada e os procedimentos e técnicas para tal
prática. Se o seu propósito de regular a guerra pode ser interpretado como
nobre e mesmo idealista, as críticas à concepção da Doutrina da Guerra
Justa são arrasadoras.
