conversar com Guilherme Almeida,
especialista no tema do “Marco Civil da
Internet”, o projeto de lei,que é uma espécie
de constituição da internet, foi aprovado
pela Câmara dos deputados e agora vai ser
analisada pelo Senado. O Guilherme está
na linha com a gente, direto de Nova Iorque,
nos Estados Unidos. Boa tarde Guilherme!
Guilherme: Boa tarde!
Repórter em estúdio 2: O Guilherme foi
um dos que ajudou a concepção da
participação popular no projeto, é né, ele é
gestor público aí do Governo Federal.
Guilherme, eu queria que cê explicasse
para nós, os ouvintes, o que é o Marco Civil
e por que ele é importante para quem usa a
internet? Também é importante, se for
possível falar num breve espaço de tempo,
por que que é importante também o
processo de formulação desse projeto?
Guilherme: Bom, o Marco Civil é um projeto
que tem por objetivo dá algumas diretrizes
pra interpretação da internet, na luz do
direito. Tem muito...como a internet é um
assunto muito novo, muitas vezes os
tribunais, ou mesmo os agente públicos,
têm dificuldade de entender o que acontece
e faltam regras claras pra esse contexto.
Então, o que o projeto traz, é tentar trazer
é... um diálogo adequado entre o direito e a
internet, pra permitir que esses mundos
passem a conversar e se entender ao invés
de serem disparatados. Mas pra construir
esse processo, eu acho que essa é a parte
mais mágica disso tudo, a principal
ferramenta utilizada foi a internet. Ou seja, a
própria idéia de, que regulamentação a
gente precisa para internet, foi debatida e
construída pelos cidadãos, on line, por meio
de uma plataforma é.. gerenciada pelo
ministério da justiça que levou a
consolidação de lei que agora foi aprovado
na Câmara e tá no Senado.

Guilherme Almeida, an expert on the theme
of "Marco Civil da Internet," the bill which is
a kind of Internet constitution that was
approved by the Chamber of Deputies and
will now be considered by the Senate.
Guilherme is on the phone with us, live from
New York in the United States. Good
afternoon Guilherme!
Guilherme: Good afternoon!
Reporter in studio 2: Guilherme was one of
those who helped the conception of the
public participation, right…he is a public
officer from the federal government.
Guilherme, I wanted [if] you could explain to
us, the radio spectators, what is the Marco
Civil and why is it important to anyone who
uses the Internet? It is also important, if you
could talk briefly, why it is also important to
the process of formulating this project?
Guilherme: Well, the Civil Marco is a project
that aims to give some guidelines for
interpretation of the Internet in light of the
law. It has very...as the Internet is a very
new subject, often the courts or public
agents, have trouble understanding what
happens and lacks clear rules in this
context. So, what the project brings, is trying
to bring is, a proper dialogue between the
law and the Internet, to allow these worlds to
start to talk and understand each other
rather than being disparate. But to build this
process, I think this is the magic of it all, the
main tool used was the Internet. In other
words, the very idea that we need
regulations for the Internet was discussed
and built by citizens online through a
platform managed by the ministry of justice
which led the Consolidation Act and has
now been approved in the House and is now
in the Senate.

queria que você tentasse explicar assim de
forma prática, o que que vai mudar na vida
do internauta quando o projeto for
aprovado? E quais são os passos...os
próximos passos agora né, depois da
aprovação da Câmara?
Guilherme: Bom, o Marco Civil, ele tá
estruturado ao redor de três grandes eixos.
O primeiro diz respeito a privacidade, ele
tem as regras bem claras sobre é.., como
os...as empresas que atuam na internet
devem agir com relação a proteção da
privacidade dos cidadãos e ao tratamento
dos dados pessoais. Com isso, o usuário de
internet pode estar mais tranquilo sobre a
proteção dos seus dados, das suas
informações, da sua privacidade, das suas
fotos, disso tudo. O segundo ponto, diz
respeito a liberdade de expressão, é...o
Marco Civil ele busca garantir uma plenitude
da libertade de expressão na internet.
Então, ele traz de uma forma clara, que um
comentário, uma postagem, alguma coisa
que esteja na internet e alguém esteja
incomodado com aquilo, só pode ser
retirado por meio de uma ordem judicial, ou
seja, a pessoa, que hospeda isso, só
responderá por indenização, ou de outra
forma, né, se houver uma ordem judicial
determinando a retirada. Com algumas
exceções, que é o caso, já na legislação
atual da pornografia infantil, e numa última
alteração do projeto, com relação a aquelas
fotos de pessoas nuas postadas por
questão de vingança na internet. E o
terceiro grande ponto, do Marco Civil da
Internet, diz respeito a neutralidade da rede.
Que é justamente a ideia de que as
empresas que prestam serviço de internet,
não podem ou não devem poder,
discriminar um conteúdo no seu fluxo, quer
dizer é...a ideia é proteger o cidadão e o
usuário de internet, pra que ele tenha uma
internet que seja de verdade livre, e não
necessariamente submetida a filtragem e
contratos comerciais.
Reporter in Studio 1: Guilherme, I would
like you [to] try to explain, in a practical way,
what will change in the [everyday] lives of
Internet users when the bill passes? And
what are the steps...the next steps now,
right? After the approval of the House?
Guilherme: Well, the Civil Marco, it is
structured around three main pillars. The
first [is] the respect for privacy; it has clear
rules on how companies operating on the
Internet must act with respect to protection
of citizens' privacy and the processing of
personal data. Thus, the Internet user can
be more relaxed about the protection of their
data, their information, their privacy, their
photos, all that. The second point concerns
the freedom of expression, is...the Civil
Marco seeks to ensure a fullness of
expression on Internet liberty. Then, it brings
in a clear way that a comment, a post,
something that is on the Internet and
someone is bothered by that, it can only be
removed by a court order, in other words,
the person who hosts this only would be
accountable for indemnity or for any other
matter, you know, if there is a court order
determining [the comment] be taken off the
site. With a few exceptions, which is already
the case in the current legislation on child
pornography, and in a last change of the
project with respect to those pictures of
naked people posted as a matter of Internet
revenge. And the third major point of the
Civil Marco Internet concerns net neutrality.
That is precisely the idea in which
companies providing Internet service cannot
or should not be able to discriminate any
content in your stream, which means...the
idea is to protect the citizen and the Internet
user, for them to have an Internet that is
truly free, and not necessarily subjected to
filtering and commercial contracts.
