2 a) É possível à administração pública da circunscrição do pleito e dentro do período a que se refere o art.
43, inc. VIII, da Resolução
TSE 21.610, promover a recomposição das perdas remuneratórias dos seus servidores, relativas aos últimos 2 anos anteriores ao
ano da eleição, por não ter, no ano anterior ao pleito, promovido a respectiva recomposição dessas perdas?
b) Para a categoria de servidores públicos cuja data base seja anterior ao prazo a que se refere o art. 43, VIII, da Resolução TSE
21.610, é possível à administração pública da circunscrição do pleito promover a recomposição salarial retroativa à data base,
mesmo quando já ultrapassado o prazo limite acima previsto pela legislação eleitoral?
O SENHOR MINISTRO LUIZ CARLOS MADEIRA (relator): Sr. Presidente, o art. 73, VIII, da Lei n2 9.504/97 impõe limites claros à
vedação nele expressa: a revisão remuneratória só transpõe a seara da licitude, se exceder"[...] a recomposição da perda de seu
poder aquisitivo ao longo do ano da eleição [...]", a partir da escolha dos candidatos até a posse dos eleitos. Conheço da consulta.

Após o julgamento, foi fixada a seguinte tese de repercussão geral: “O não encaminhamento de projeto de lei de revisão anual
dos vencimentos dos servidores públicos, previsto no inciso 10 do artigo 37 da Constituição Federal de 1988, não gera direito
subjetivo a indenização. Deve o Poder Executivo, no entanto, se pronunciar, de forma fundamentada, acerca das razões pelas
