«By a “movement” I mean a “project” in just the sense I described above – a goal-oriented
practical activity of a loosely identifiable group carried out in light of an analysis contained in a literature
of shifting content. The people in the cls were overwhelmingly legal academics; the goals were constested
within the group, but my version was that we were trying to create a left legal academic intelligentsia as a
new social grouping that would influence both its own workplaces and the general political culture. […]
Cls was a movement rather than just a project because the ideas of “change”, “growth”, and “opposition”

«Cls as a school of thought is like the movement in that it is a project, but it is the strictly
academic project of developing a network of writers and teachers who share a set of ideas, rather than the
academic/political project of transforming society by transforming legal education. The members of the
school share the goal of expanding its membership and influence, and they critique mainstream legal
scholarship more or less aggressively, but they do so without trying to challenge the rules of the game or
the balance of power in their institutions. […] The school, unlike the movement, is institutionalized at a
small number of law faculties and continues to reproduce itself socially and to develop intellectually over

Da crítica ao objectivismo resulta uma “visão programática da sociedade”, pensada, não em
termos revolucionários, mas antes como uma revolutionary reform, e a exigir uma reforma institucional.
A projecção prática da proposta construção do pensamento jurídico – a deviationist doctrine – encontrar-
se-ia, assim, num experimentalismo democrático, enquanto reformulação macroscopicamente
perspectivada da sociedade. UNGER é acusado, por vários autores, de tentar reduzir o direito à política. É
o caso de CHRISTODOULIDIS que, por outro lado, reconhece no projecto de UNGER um objectivismo da
mesma índole do que critica, o que o colocaria em auto-contradição (self-contradiction). Kevin WALTON,
quanto àquela primeira crítica, entende que UNGER não faz tal redução, e, quanto à segunda, que este
criticismo reside numa incompreensão. Todavia, WALTON também tenta objectar às propostas
substantivas de UNGER, preferindo uma consideração pluralista de valor. – Vide Kevin WALTON, “A

desvelar do sentido que a definição atribuída pela teoria tradicional permitiu ocultar,
com vista a uma interpretação do mesmo num sentido de emancipação, capaz de
uma utilização ideológica que permita a denúncia e destruição das hierarquias54. O
segundo momento desta prática analítica, o criticism, designa a versão revista do
pensamento jurídico que implica a denúncia do conflito ideológico subjacente. A sua
função é explorar a relação entre as organizações institucionais da sociedade tal
como representadas no direito, e os ideais professados ou os programas que essas
organizações frustram e realizam. O mapping requer o redimensionamento radical
do quadro social, em geral, e do direito, em particular, partindo do ponto de vista do
criticism. O mapping serve o propósito do criticism, é uma análise que exibe as
instituições formativas da sociedade como uma estrutura distinta e, acima de tudo,
como uma estrutura que pode ser revista por sectores. Uma das tarefas das práticas
combinadas de mapping e criticism seria contribuir para o desenvolvimento de
trajectórias alternativas de mudança política e institucional55.
A primeira tarefa – a do momento de diagnóstico-mapping – é compreender a
situação institucional existente como a estrutura complexa e contraditória que ela
realmente constitui. O núcleo do mapping é a tentativa de construir um quadro das
instituições – governo, economia, família – fora do domínio do direito e da
dogmática jurídica. A perspectiva orientadora é a que serve os propósitos do
segundo momento desta prática analítica, o momento de criticism; quando se coloca
a tónica nas desarmonias do direito e no modo como as concepções ideais, expressas
em policies and principles, ou o grupo de interesses representado por programas e
estratégias, ficam truncados no seu preenchimento e empobrecidos no seu
significado e nas suas formas institucionais admitidas.
Mapping e criticism são indissolúveis, são aspectos ou momentos da mesma
prática. Quando o mapping fornece materiais ao criticism, isso já é feito tendo em
mente os interesses do criticism. A “legal analisys as institutional imagination”,
através da prática de “mapping”, revela a diversidade de rules and principles e,
assim, alarga o objectivo do pensamento jurídico para lá do que é praticado pelas
escolas que perfilham a “rationalizing legal analysis”. “Mapping” é a tentativa de
descrever em detalhe a micro-estrutura institucional da sociedade juridicamente
definida, em relação com os seus ideais juridicamente articulados 56. Trata-se da
recuperação dos contra-princípios previamente ignorados, salientando o conflito que
existente no núcleo substancial do direito. O movimento crucial consiste em
conectar esta desunião com a política. Para UNGER, isto seria o “criticism”: o
“criticism” explora a interacção entre as organizações da sociedade tal como
