ABSTRACT
This paper sets out to explore the legal impacts associated with digital currencies issued
by central banks, more commonly known as Central Bank Digital Currency (CBDC). In the
contemporary context, where technology plays an increasingly central role in our daily
lives, the need for faster and safer financial transactions has intensified. In recent years,
Brazil has witnessed a decline in the use of checks and the emergence of new means of
payment that prioritize speed and security.
CBDC has emerged as a response to these emerging demands, offering a number of
advantages. One of the main ones is the viability of smart contracts, which have the
potential to revolutionize the way we carry out transactions and execute commercial
agreements. The ability to automate and program contractual conditions through
technology promises to increase efficiency, reduce costs and minimize risks.
CBDC also has the potential to make access to financial services more inclusive, as it can
be made more easily available and accessible, especially in regions where traditional
banking infrastructure is limited. However, while offering advantages, the introduction of
CBDC brings with it significant challenges and legal implications.

In Brazil, the adoption of CBDC raises complex regulatory issues that must be carefully
analyzed. Aspects related to privacy, cyber security, money laundering and tax evasion
are just some of the aspects that need special attention from regulators and legislators.In
the current model, the only way in which people establish a direct monetary relationship
with the central bank is through the use of paper money. However, with the
implementation of Central Bank Digital Currencies (CBDCs), this dynamic could change
significantly. One possibility is that people could hold accounts directly with the central
bank, eliminating the need for intermediaries such as commercial banks. This
transformation has advantages, such as the possible absence of financial charges (fees)
and wider access to a bank account.
However, this change could also trigger complex problems. Currently, banks finance their
lending activities through the deposits made by their customers. In other words, the money
that people deposit in banks is lent to other people through loans, with associated interest
rates. In accounting terms, depositors are considered creditors of the bank, and the funds
deposited are treated as monetary equivalents. If the CBDC were to function as a direct
account with the central bank, this could have serious economic consequences.
The main concern is that this change could result in banks being less available to offer
loans. Since the funds that would normally be deposited in banks would be directed
directly to the central bank, the amount of money available for loans by commercial banks
would be reduced. This decrease in reserves could have a negative impact on banks'
ability to extend credit and finance economic activities.
This situation is especially relevant when we consider that bank loans are a crucial
component for boosting investment, consumption and economic growth.
If the CBDC were to result in a significant decrease in the supply of bank loans, this could
have negative ramifications for the economy as a whole, affecting business activity,
employment and economic development.

que motiva a análise minuciosa dos potenciais benefícios e desafios que essa interseção
pode trazer.
A adoção crescente das CBDCs por vários bancos centrais ao redor do mundo
demonstra a crescente aceitação e reconhecimento da necessidade de modernizar os
sistemas financeiros tradicionais. As CBDCs não apenas têm o potencial de aumentar a
eficiência e a transparência das transações, mas também de facilitar o acesso aos
serviços financeiros, especialmente em áreas onde a infraestrutura bancária é limitada.
No entanto, a implementação bem-sucedida das CBDCs exige uma compreensão
abrangente dos desafios regulatórios, tecnológicos e de privacidade.
Nesse contexto, os contratos inteligentes emergem como uma ferramenta
inovadora e transformadora que pode ser habilitada pelas CBDCs. A capacidade de
automatizar a execução de acordos comerciais por meio de programas de computador
autoexecutáveis pode reduzir significativamente os riscos, os custos e a necessidade de
intermediários nas transações. No entanto, a integração dos contratos inteligentes com as
CBDCs também traz à tona questões jurídicas e regulatórias, como a execução
automática de cláusulas contratuais e a proteção dos direitos das partes envolvidas.
A pesquisa sobre a relação entre as CBDCs e os contratos inteligentes é
crucial para informar os tomadores de decisão, legisladores e reguladores sobre as
implicações e possíveis direções futuras. A ausência de uma compreensão completa
desses temas pode resultar em regulamentações inadequadas ou na falta de
aproveitamento total do potencial dessas inovações. Além disso, a análise aprofundada
das CBDCs em conjunto com os contratos inteligentes pode fornecer insights valiosos
sobre como maximizar os benefícios para a sociedade, ao mesmo tempo que minimiza os
riscos.
Em suma, a justificativa para a investigação das CBDCs voltada aos contratos
inteligentes reside na necessidade de avaliar cuidadosamente como essas duas
inovações podem interagir e transformar os sistemas financeiros e as transações
comerciais. A compreensão abrangente dessas interações é crucial para informar
políticas e estratégias que promovam a eficiência, segurança e inclusão financeira na era
da digitalização e globalização dos mercados financeiros.

Metodologia
Para alcançar os objetivos propostos neste trabalho, será adotada uma abordagem
metodológica que combina pesquisa bibliográfica, análise documental e estudo fático . A
metodologia será conduzida em etapas distintas, permitindo uma abordagem abrangente
e detalhada da interação entre as Central Bank Digital Currencies (CBDCs) e os contratos
inteligentes. As etapas metodológicas são as seguintes:
1. Pesquisa Bibliográfica: Inicialmente, será realizada uma pesquisa bibliográfica
extensiva para coletar informações relevantes sobre as CBDCs, os contratos
inteligentes, bem como suas implicações legais e regulatórias. A literatura
acadêmica, artigos científicos, relatórios de organizações internacionais e materiais
de referência serão examinados para construir uma base sólida de conhecimento.
2. Análise das Características das CBDCs: Nesta etapa, serão analisadas as
principais características das CBDCs, incluindo seus objetivos, funcionalidades,
benefícios e desafios. Será investigado como as CBDCs são emitidas, distribuídas,
armazenadas e utilizadas, além de compreender suas implicações nas transações
financeiras e na economia como um todo.
3. Exploração dos Fundamentos dos Contratos Inteligentes: Serão explorados os
princípios fundamentais dos contratos inteligentes, compreendendo suas
características técnicas, funcionamento, programação e execução. A tecnologia
blockchain como base para os contratos inteligentes também será examinada,
destacando como ela garante a segurança, transparência e imutabilidade das
transações.
