2. Inclusão de produto técnico em produto formulado
Caso I: Solicitação de inclusão de nova fonte fabril no registro de Produto Técnico que é
base do registro do produto Formulado.
• Quando uma nova fonte for incluída no produto técnico, seguindo os procedimentos legais
de inclusão, a inclusão desta fonte no produto formulado a base desse produto técnico será
automática.
• Após a publicação no DOU da aprovação da inclusão do novo fabricante de produto
técnico, a registrante deverá proceder com a alteração dos rótulos e bulas do(s) produto(s)
formulado(s) à base deste produto técnico.

• A inclusão de outro Produto Técnico em produto formulado somente poderá ser avaliada
mediante a apresentação do Certificado de Registro do PT.
• Não será aceita a solicitação de inclusão de um produto técnico ainda não registrado.
• Os pleitos em tramitação com solicitação de inclusão de produto técnico ainda não
registrado serão indeferidos.
a) Documentos a serem apresentados pela empresa requerente juntamente com a
solicitação (MAPA, IBAMA e ANVISA):
I. Certificado de registro do produto técnico a ser incluído na formulação. II. Carta de
acesso aos dados do produto técnico a ser incluído na formulação (caso o produto
técnico seja de titularidade de empresa distinta da requerente).
b) Critérios de análise
b.1) ANVISA – será realizada análise documental, quando o produto tiver PT registrado.
b.2) IBAMA - seguirá os seguintes procedimentos:

Caso 3: Inclusão de PTE2 em PF registrado com base em PTE1 de mesmo PTR.
Os produtos técnicos equivalentes podem ser incluídos em todos os produtos formulados com
base em produto técnico equivalente, desde que possuam o mesmo produto técnico de
referência.
*Os critérios dispostos nos casos II e III não se aplicam a produtos técnicos equivalentes à base
do mesmo ingrediente ativo registrados com produtos de referência distintos.
Caso 4: Inclusão de PTE2 em PF registrado com base em PTE1 de PTR distinto.
A inclusão de um PTE em uma formulação que tem como base outro PTE registrado com
produto de referência distinto será realizada pela comparação entre o perfil do novo produto
técnico equivalente – PTE2 e o perfil do produto técnico de referência que dá suporte ao produto
técnico equivalente – PTE1 já registrado na formulação.
Caso o novo produto técnico seja equivalente em Fase I a esse produto técnico de referência,
poderá ser incluído na formulação.
Caso o novo produto técnico apresente novas impurezas ou incremento superior a 3 g/kg ou
50%, o pleito será indeferido.
Caso 5: Inclusão de PT2 com dossiê próprio em PF registrado com base em PT1 de dossiê
próprio.
Quando a solicitação de inclusão de PT em PF envolver produtos técnicos registrados com
dossiê próprio será realizada a comparação das declarações quali-quantitativas dos PTs.
O PT a ser incluído na formulação deverá ser equivalente ao PT que dá suporte ao produto
formulado.
Caso sejam atendidos os critérios de equivalência em Fase I, ou seja, o PT a ser incluído não
apresente novas impurezas em teor ≥ 1 g/kg ou incremento de impurezas superior a 3 g/kg ou
50%, o novo PT poderá ser incluído no PF.
Caso o novo PT apresente novas impurezas em teor ≥ 1 g/kg ou incremento de impurezas
superior a 3 g/kg ou 50%, o IBAMA procederá à comparação da toxicidade dos mesmos para

organismos não-alvo, utilizando os critérios de equivalência dos perfis ecotoxicológicos dos
produtos técnicos, conforme Anexo X do Decreto nº 4.074/2002.
O perfil ecotoxicológico do novo produto técnico será considerado equivalente ao perfil do
produto técnico que deu base à formulação, se os resultados dos estudos ecotoxicológicos,
utilizando as mesmas espécies, não diferirem por um fator maior do que 5.
Caso 6: Inclusão de PTE em PF registrado com base em PT de dossiê próprio que não é
referência.
Neste caso, será realizada a comparação das declarações quali-quantitativas dos PTs. O PT a ser
incluído na formulação deverá atender aos critérios de equivalência em relação ao PT que dá
suporte ao produto formulado. Caso sejam atendidos os critérios de equivalência em Fase I, o
novo PT poderá ser incluído.
Caso o novo PT apresente novas impurezas em teor ≥ 1 g/kg ou incremento de impurezas
superior a 3 g/kg ou 50%, o pleito será indeferido.
Caso 7: Inclusão de PT de dossiê próprio em PF registrado com base em PTE.
A inclusão de um PT de dossiê próprio em uma formulação que tem como base um PTE será
realizada pela comparação entre o perfil do novo produto técnico e o perfil do produto técnico
de referência que deu suporte ao produto técnico equivalente – PTE já registrado na formulação.
Caso o novo produto técnico seja equivalente em Fase I a esse produto técnico de referência,
poderá ser incluído na formulação.
Caso o novo produto técnico apresente novas impurezas ou incremento superior a 3 g/kg ou
50%, o pleito será indeferido.

Procedures for the inclusion of manufacturer in technical product (PT) and
the inclusion of technical product (PT) in formulated product (PF)
Pass on the XI meeting of the Technical Advisory Committee for Pesticides, 04/12/2013, with the
incorporation of suggestions taken on CTA and business meeting held in 28/03/2014 .
1. Inclusion of manufacturer into technical product:
The request for the inclusion of technical product formulated product shall be applied to the
registrant in accordance with the provisions of Art. 22 of Decree No. 4,074/02.
a) Documents to be submitted by the applicant company along with the request (MAPA,
IBAMA and ANVISA):
I. Description of the production process of technical product, contemplating their steps of
synthesis, their by-products and impurities, supplied by the manufacturer, containing:
a) Flowchart of chemical reactions and yield of each step of the process;
(b) Identity of reagents, solvents and catalysts, with their respective degrees of purity;
(c) General description of the conditions that are controlled during the process (for example:
temperature, pressure, pH, moisture);
(d) Description of the purification steps (including those used for recovering or recycling the
starting materials, intermediates or generated substances);
e) Discussion on the theoretical training of all possible impurities generated in the production
process.
II. Study of five batches for the new plant.
III. Replacing the documents/studies of items I and II may be presented letter of access to data
already contributed in other processes in the registry.
(b) Criteria for analysis (MAPA, IBAMA and ANVISA):
For the inclusion of new manufacturer in the registry of a technical product must be met the
following criteria:
I. The maximum level of each impurity of the new font must be less than or equal to the
constant declaration of quality quantitative composition technical product registered;
II. Not exist, the new source, new quantified impurities above 1 g/kg, or increase in the
level of impurities, in relation to the Declaration of the quantitative composition of
technical product registered.
III. The minimum level of active ingredient of new font must be greater than or equal to the
constant in the Declaration of quality quantitative composition technical product
registered.
Comments:
- Failure to meet the abovementioned criteria will result in the application being rejected.
2. Inclusion of Product Technical into Formulated Product
Case 1: Request for the inclusion of new manufacturing source in technical Product
which is the basis of the Formulated product registration.
• When a new source is included in the technical product, following the legal inclusion
procedures, the inclusion of this source in the formulated product will be automatic.

• After publication in the DOU of the approval of the inclusion of the new technical product
manufacturer, the registrant should amend the labels and leaflets of the product(s) formulated
on the basis of this technical product.
• In the Certificate of Registration of a product formulated in the "Manufacturer" item, will
appear the name(s) of the technical product(s), its authorised manufacturers and the
registration number of the PT.
• The certificate of registration of formulated products containing the PT trademark and
registration number which provides the basis for the formulation for already registered
products will be issued first for those with full manufacturer inclusions in completed
technical products and later for other formulated products.
• Confirmation of the technical product(s) on the basis of the formulation should be based on
the IBAMA PPA which can be consulted in Agrofit.
• In case there is no PPA in Agrofit containing technical product, must be held a consultation
with the Ibama to advise the technical product.
• No longer be necessary to request inclusion of the manufacturer in the PF according to the
article 22 of Decree No. 4,074/2002;
• IBAMA and ANVISA will notice to the MAPA and registrants informing the archiving of
applications in processing containing only the request for inclusion of manufacturer in PF
already requested or authorized for the PT.
• The applications in processing containing more than one request will be evaluated for
considering conclusion:
If you have already completed the inclusion in PT → all requests will be completed;
If the inclusion in the PT has not yet been evaluated → request for inclusion of manufacturer
will be filed and the others will be completed.
Note: for further records the registration certificate will be issued containing the manufacturer
in the technical product.

a) Documents to be submitted by the applicant company along with the request (MAPA,
IBAMA and ANVISA):
(I). Certificate of registration of the technical product to be included in the formulation.
II. Letter of access to technical product data to be included in the formulation (in case
the technical product is owned by a company other than the applicant).
Case 3: Inclusion of PTE2 in PF registered on the basis of PTE1 of the same PTR.
The equivalent technical products can be included in all products formulated on the basis of
technical equivalent product, since they have the same reference technical product.

* The criteria set out in cases 2 and 3 shall not apply to technical products equivalent to the
basis of the same active ingredient registered with different reference products.
Case 4: Inclusion of PTE2 in PF registered on the basis of separate PTE1 PTR.
The inclusion of a PTE in a formulation based on another PTE registered with distinct
reference product will be performed by comparison of the profile of the new technical
equivalent product – PTE2 and the reference technical product profile that supports technical
product equivalent – PTE1 already registered in the formulation.
Where the new technical product is Phase I equivalent to that reference technical product, it
may be included in the formulation.
If the new technical product shows new impurities or increases above 3 g/kg or 50%, the
application shall be rejected.
Case 5: Including PT2 with its own file in PF registered on the basis of own file PT1.
When the request for inclusion of PT in PF involves technical products registered with own
file, a comparison of the qualitative declarations of the PTs shall be made.
The PT to be included in the formulation should be equivalent to the PT that supports the
formulated product.
If Phase I equivalence criteria are met, i.e. the included PT does not present new impurities in
1/g/kg or impurity increments above 3 g/kg or 50%, the new PT may be included in the PF.
Where the new PT presents new impurities in 1/g/kg or impurities in excess of 3/g/kg or 50%,
IBAMA shall compare their toxicity to non-target organisms using the criteria for equivalence
of ecotoxicological profiles of technical products as set out in Annex X to Decree 4.074/2002.
The ecotoxicological profile of the new technical product shall be considered equivalent to the
profile of the technical product on the basis of the formulation if the results of the
ecotoxicological studies using the same species do not differ by a higher factor than 5.

Case 6: Including PTE in PF registered based on PT with own file but not a reference.
In this case, a comparison shall be made of the qualitative declarations of the PTs. The PT to be
included in the formulation should take into account the equivalence criteria in relation to the
PT that supports the formulated product.
If Phase I equivalence criteria are met, the new PT may be included. If the new PT shows new
impurities in 1g/kg or impurities increase above 3g/kg or 50% the application shall be rejected.
Case 7: Including PT of own file in PF registered on the basis of PTE.
The inclusion of an own-file PT in a formulation based on an PTE shall be carried out by
comparing the profile of the new technical product and the profile of the reference technical
product that supported the equivalent technical product (PTE) already recorded in the
formulation.
Where the new technical product is Phase I equivalent to that reference technical product, it
may be included in the formulation.
If the new technical product shows new impurities or increases above 3 g/kg or 50%, the
application shall be rejected.
