EVOLUÇÃO HISTÓRICA DOS DIREITOS HUMANOS

Conceitos iniciais

Os Direitos Humanos são normas (positivadas ou não) que buscam garantir a dignidade da pessoa humana,
assim entendida como – grosso modo – uma qualidade inerente ao ser humano, que merece ser respeitado,
protegido e ter garantidos um conjunto de direitos indispensáveis à vida humana.

Segundo Antônio Perez Luño, Direitos Humanos são um conjunto de faculdades e instituições que, em
cada momento histórico, concretizam as exigências de dignidade, liberdade e igualdade humanas, as quais devem
ser reconhecidas positivamente pelos ordenamentos jurídicos em nível nacional e internacional.

Nesse sentido, é importante diferenciar as seguintes expressões 




DIREITOS DO São os direitos naturais do homem, não positivados (nem internamente, nem
HOMEM internacionalmente). Trata-se de uma expressão de cunho naturalista - jusnaturalismo.

DIREITOS São os direitos humanos previstos nas Constituições dos Estados, gozando de proteção
FUNDAMENTAIS interna (constitucional).

DIREITOS São os direitos inscritos e positivados em tratados ou costumes internacionais, gozando

HUMANOS de proteção internacional.

Trata-se de um conjunto de normas e medidas que objetivam proteger os direitos

DIREITO humanos dos envolvidos em tempos de conflitos armados ou de guerra. Dentro desta

HUMANITÁRIO proteção estão abarcados os soldados, os prisioneiros de guerra e a população civil.

A Cruz Vermelha é um exemplo de organismo ligado ao Direito Humanitário.

Por fim, faz-se necessária a diferenciação entre direitos e garantias fundamentais:

São bens e vantagens que podem ser usufruídos pelo indivíduo.

DIREITOS
Estão previstos em normas declaratórias.

São os meios usados para assegurar os direitos.

Estão previstas em normas assecuratórias e podem ser:

GARANTIAS
o Gerais: quando vedam abusos.
o Especiais: quando usadas para fazer valer os direitos ou as próprias garantias gerais.

Dimensões de direitos

Introdução

Para fins didáticos, os Direitos Humanos são sistematizados em grupos organizados a partir do critério
do momento histórico e político em que foram demandados e incorporados ao ordenamento jurídico. Esses grupos
são denominados gerações (ou dimensões) de direitos.

 TERMINOLOGIA 

 


Atualmente, o termo mais aceito pela doutrina é “dimensões”, uma vez que este carrega a ideia de que os
direitos não se substituem, mas se agregam. Assim, enquanto “geração” dá a ideia de substituição, “dimensão”
denota soma.

1ª dimensão

o Direitos civis → direitos do cidadão (liberdades individuais).

DIREITOS
o Direitos políticos → direitos políticos ativos (votar) e passivos (ser votado).

ATUAÇÃO DO
Deve ser, na maioria das vezes, negativa (abstenção estatal).
ESTADO

FUNDAMENTO Liberdade.

EXEMPLOS Vida, liberdade, propriedade, etc (ex.: art. 5º da CRFB/88).

2ª dimensão

DIREITOS Direitos econômicos, sociais e culturais.

ATUAÇÃO DO
Deve ser positiva (prestação estatal).
ESTADO

FUNDAMENTO Igualdade.

EXEMPLOS Saúde, educação, alimentação, moradia, etc (ex.: art. 6º da CRFB/88).

3ª dimensão

DIREITOS Direitos difusos.

FUNDAMENTO Fraternidade ou solidariedade.

EXEMPLOS Meio ambiente sadio, desenvolvimento, paz.

Outras dimensões

o Primeira corrente: são os direitos relacionados com a democracia, a informação e

o pluralismo político das minorias.
DIREITOS DE
o Segunda corrente: são os direitos relacionados com a genética, envolvendo a
4ª DIMENSÃO
preocupação com a gênese do ser humano, como questões relacionadas à
clonagem e ao estudo de células-tronco.

DIREITOS DE São os direitos relacionados com a cibernética; a preocupação com o mundo virtual e o
5ª DIMENSÃO futuro da humanidade.

OBS.: não há consenso nas classificações da 4ª e 5ª dimensão, sendo que alguns doutrinadores defendem
que esses direitos já estão inseridos na 3ª dimensão.

Internacionalização dos Direitos Humanos

Após as violações aos direitos humanos ocorridas na Segunda Guerra Mundial, torna-se necessária a
criação de sistemas internacionais de proteção, possibilitando a demanda jurídica em caso de violação.

Trata-se da internacionalização dos Direitos Humanos, que tem como consequência a relativização do
conceito de soberania e a transformação dos indivíduos em sujeitos de Direito Internacional.
