The Lei 13,129/2015 modiies the leter of the articles 1st, 2nd, 4 th, 13th, 19th, 23rd, 30th,
32nd, 33rd, 35th and 39th of the Lei 9,307/1996, thus modifying and enhancing arbitration
in Brazil. The main reforms consist of permiting public administration to make use of
this mechanism as well as it: a) allows the parties to choose their judges; b)interrupts
prescription terms whenever arbitration is instituted; c)concedes precautionary and
urgency decisions within the use of arbitration; c) originates the arbitral leter (document);

Such resolution is a compass to all Judiciary, thus receiving the name of Judiciary National
Program. This speciic edition focuses on how conlicts are solved in Brazil. It considers
several already discussed issues in order to provide as a tool extra-judicial means, such as
consensual methods, regulated by the Law of Mediation and the Law of Arbitration; it also
compliments the maintenance of ADR initiatives scatered throughout the country and its

of ODR Fellows and an Annual Conference that has met more than
ifteen times on ive continents.142
ODR first entered the Brazilian market in 1996, and each
subsequent project has evolved in terms of reach, technology, and
sophistication. By 2010 eBay was resolving more than 60 million
disputes per year through its ODR platform, more than the entire US
Civil Court system. In 2011 eBay spun out some of its ODR technology
to start Modria.com, an ODR provider that supports resolutions around
the world. Since 2000, ODR mechanisms have resolved more than 400
million disputes globally, and that number continues to grow.
International organizations have promoted ODR as a solution
to access to justice challenges since 2002. UNCITRAL, the United
Nations organization in charge of harmonizing global laws, convened
a Working Group devoted to ODR with more than 66 member nations.
As ODR took of in geographies like North America and Europe,143
the development of ODR in Brazil began in earnest a decade later. An
international survey of the growth of ODR by Melissa Conley Tyler
indicated that Brazil’s use of ODR lagged behind initiatives in other
geographies,144 but the clear potential of ODR approaches in tackling
the challenges being experienced in Brazil was clear even before ODR
experiments began in earnest. The delay in Brazil’s adoption of ODR
approaches might have even been a beneit in retrospect, as other
geographies tested and reined ODR tools, ensuring that Brazil could
learn from best practices prior to beginning their own initiatives. The

marketplace that ODR approaches are welcome, and that is causing
developments to accelerate.
The expansion of internet access is also fueling the reach of
ADR. Brazil is a very large country, with marked diferences in income

3.3.1 E-negotiation
Negotiation is a form of conlict resolution where the dispute is
resolved only between the disputing parties, with no third party neutral
involved. Depending on how the e-negotiation is designed, the resulting
process can result in an enforceable agreement which may enable one
party of the other to compel judicial enforcement if necessary. We will
now analyze four e-negotiation providers to call out the variations in
their approaches.
The oldest and most used e-negotiation tool in Brazil is called
“Reclame Aqui”. In this online platform, (i) the consumers are able
to register their virtual or physical complaints related to products,
services or companies; (ii) then, the companies are convoked to answer
the complaints, presenting the available solutions; (iii) and, at last,
the consumer registers his evaluation regarding the atitude of the
company and informs whether his mater was plainly solved or not.
In such procedure the parties are not helped by a third party and the
participation of lawyers is dismissed.
“Reclame Aqui” has generated promising results157 for it promotes
quick communication between the parties. The platform is free of cost
and possesses mechanisms that maintain high levels of solvency of the
negotiated terms, though not generating an executive title. Basically,
the developed strategy to bind the negotiators to the result of their
deliberation accrues from the publicity of the results obtained. It causes,
consequently, a concern to the companies regarding the building of a
good reputation in the market as well as to their buyers.158 After all,
“reputation systems allow users to make judgments as to which sellers
provide the greatest chance of a successful transaction, and therefore
lowest risk of dispute”.159

the mater of the cause and generates a judicial executive title164 which
is legally enforceable.
Finally, the last platform we will examine is eConciliador
which began setling disputes in January 2014. eConciliador is an
intelligent data-driven negotiation software that resolves civil and
labor legal disputes as well as customer service claims in less than ive
minutes. This fully automated platform allows parties to negotiate
and setle disputes 24/7, with or without a lawyer, and at any stage
of the dispute – before the claim is iled (extra-judicial), once iled
(judicial) and even post-sentencing (pós-sentença). eConciliador is able
to achieve this through its customized algorithms that are tailored to
the client’s setlement policies and the software also learns and reacts
to the proposals being made by the user. As an automated platform,
eConciliador can negotiate and setle and unlimited number of cases
simultaneously. Once the case is setled, plaintifs upload the executed
setlement agreement to ensure enforceability.
While many of these examples focus on cases within the courts or
at risk of being iled in court, there is also a considerable and growing
use of e-negotiation as a means of resolution/prevention of conlicts
outside of the justice system. The primary application of e-negotiation
in this context is the ield of consumer relations. The eiciency of
ODR is extremely helpful in resolving consumer issues before they
undermine customer trust and loyalty, or bubble up in social media.
It is not necessary to have the threat of judicial enforcement to make
these extrajudicial e-negotiation processes successful, because the
parties are more than adequately incentivized by their desire to preserve
strong buyer-seller trust.165
The use of e-negotiation mechanisms is especially interesting
when there is no explicit conlict of interests between the parties, or
when the conlict is still in an early stage. These online platforms are
intended to smooth communication between the parties at the earliest
appearance of a potential problem and to foster mutually-acceptable

3.3.2 E-mediation
E-negotiation is often very informal, but e-mediation is slightly
more regulated. The challenge of ensuring the process and the neutrals
are truly impartial requires a bit more oversight than e-negotiation
processes, which are entirely driven by the parties themselves. In
Brazil our research veriied the dynamic of a growing preference for
mediation as ODR techniques become more legitimized. The legal
changes speciically call out e-mediation as a preferred process, so that
may explain why e-mediation has improved its status in such a short
period of time.
From this perspective, e-mediation has the highest proile due
to its up to date legal authorization (Law 13,105/2015 and 13,140/2015).
As such, there are quite a few recent e-mediation initiatives in Brazil:
“Vamos conciliar”,166 “Justiça sem processo”167 and “Juster”.168 These
platforms operate in a straightforward and similar way, facilitating
face-to-face mediation via videoconferencing to enable the parties to
communicate with the mediator, so there is no need to examine each
in turn.
As a rule, e-mediation requires a software platform that assures
the conidentiality and privacy of the negotiations. Parties are often
quite sensitive to the security of the information shared in these online
sessions, though any outcome must be agreed to by both disputants.169
Adherence to the agreed upon solution is improved because both
parties have veto power over any resolution achieved, ensuring that
the parties feel ownership over the outcome. However, Brazilian Law

3.4.3 Enforceability
One major challenge to the expansion of ODR is the lack of
mechanisms to ensure adherence to the terms accorded by the parties.
Study after study has shown that parties don’t want agreements,
they want outcomes. If e-mediation delivers millions of agreements
that are promptly ignored by the parties, it will have been a waste
of time. According to Maxime Hanriot, “the lack of enforceable
outcomes constitutes a major hurdle for the development of ODR, and

3.5 Conclusion
One may say that Brazil presents a quite promising environment
for the development and exploration of ODR. The Brazilian market
is large, there is signiicant support from the judiciary, new laws are
creating momentum and visibility, and there is a large backlog of cases
that demand resolution. The challenges we have presented in this article
are important barriers and must be overcome, but we believe the social
and economic beneits coming from the deployment of ODR services in
Brazil will create enough enthusiasm to overcome the obstacles. In the
short or medium terms Brazilian ODR may signiicantly diminish the
volume and the costs of litigation and, therefore, reduce the Custo-Brasil –
Brazilian Cost – of delivering fast and fair resolutions to Brazilian
citizens while expanding access to justice.

4.4 Conclusões
As plataformas de ODR contribuem para a criação de uma nova
cultura de desjudicialização, bem como reforçam um compromisso com
a duração razoável do processo. A busca por métodos adequados que
são mais simples, rápidos e inanceiramente acessíveis é um grande
passo para a solução alternativa à justiça tradicional, hoje em crise.
O presente artigo visou apresentar um panorama geral do que
tem sido desenvolvido no Brasil, tanto no âmbito privado, quanto no
âmbito público, tendo como ponto de partida a experiência europeia,
bem como a crise do Judiciário brasileiro tradicional. Para isso, buscou-
se apresentar dados que ilustrassem a necessidade de desjudicialização,
os benefícios da implementação das plataformas de ODR na Europa
e, também, demonstrar como a evolução da ODR no Brasil já vem se
mostrando altamente promissora.
Inicialmente, sobre os dados da European Comission, pode-se
aferir que, apesar do breve período de funcionamento, a plataforma
é altamente eicaz em tempo e economia inanceira, atingindo no di-
reito consumerista a garantia de que o consumidor terá mais chances
de resolver seus conlitos de forma efetiva e imparcial, o que o torna
uma parte menos vulnerável em litígios contra grandes corporações.
A consequência é que mais consumidores persigam seus direitos,
conlitos sejam criados e resolvidos mais frequente e efetivamente e, a
partir disso, haja efetivo progresso na consolidação dos princípios da
segurança jurídica e da paridade de armas.
É importante o comparativo com o cenário e os benefícios da
experiência europeia, uma vez que essa plataforma é a plena con-
solidação do que se entende doutrinariamente por plataforma de
ODR. Conclui-se que, apesar da plataforma governamental brasileira,
consumidor.gov, ser altamente eiciente, ela apresenta uma limitação à
desjudicialização quando não adota plenamente os métodos de ADR,
como é feito pela plataforma da European Commission.
Conclui-se, também, que o cenário privado de plataformas brasi-
leiras é altamente promissor. Isso porque, apesar dos gargalos apre-
sentados em pesquisa não oicial, as vantagens de desjudicialização,
celeridade e economia inanceira são plenamente alcançadas. Assim,
visualiza-se as plataformas de ODR como verdadeiras alternativas e
soluções ao Judiciário brasileiro, percebendo-se que o direito se desen-
volve de fato quando aliado aos avanços tecnológicos, tanto no âmbito
público de resolução de conlitos, quanto no privado.

5.1 Introduction
More and more sources of law are (freely) available online in
Europe and the rest of the world. It concerns both legislation and case
law and possibly others like legal commentaries. Professionals may
already get lost in the multitude of information, let alone ordinary
citizens and (small and medium sized) enterprises. Traditionally
commercial publishers provide this information, plus support for
access. Legal experts write commentaries for them, editors provide
links between diferent (types of) sources and warn subscribers for
interesting new developments and case law. Now that large amount
of sources of law become electronically available online, the question
is whether new ways for supporting access can be developed. One
stream of research may be directed towards crowdsourcing, have users
of legal information share their collections of material, the links they
see between diferent sources, their commentaries, etc. Another stream
of research is directed at (semi-) automated linking and clustering of
sources of law, analysis of the network of law to ind authoritative
sources or predict the change of opinion of higher courts, etc.201 In the
OpenLaws.eu project we explore both approaches (WASS et al., 2013).202

other jurisdictions (e.g Palmirani et al. (2003) for Italy; Tran et al. (2013)
for Japan). For inter-case law links it is a bit more diicult, but we have
shown it works for the Dutch case (Winkels et al. (2011) and so did Van
Opijnen (2014)). That leaves inding citations in case law to legislation
and possibly inding links in other sources of law like commentaries
to both case law and legislation. In this paper we will focus on inding
references to legislation in Dutch case law and how we can use these
to improve access to Dutch sources of law.
The data available in the Dutch oicial portals is not ideal for
further analysis like natural language parsing or network analysis.205 For
legislation we started transferring the data to an RDF linked data format
in 2011 and storing it at the Metalex Document Server (HOEKSTRA,
2011). The server currently contains 45,165 document versions (March
2016), and this number is growing every day since every change to
the weten.nl site is added to the triplestore. In Winkels et al. (2013)
we describe how we generate networks for legislation using SPARQL
queries on the RDF data. Here we will describe how we build a network
of relations between case law and legislation.

can be used for resolving the reference later on. We consider high
precision to be more important than high recall.206 Users will forgive
us if we miss a reference, but be annoyed by false ones. We evaluated
this procedure by checking 25 randomly selected documents by hand.
These documents contained 163 references to legislation of which
141 were correctly identiied (recall of 87%). There was one false
positive (precision of 99%). The references we missed were mostly
those to the ‘Vreemdelingencirculaire’ (‘Aliens act’, a lower law that has
a diferent structure than regular ones) and treaties with very long
names like ‘Europees Verdrag tot bescherming van de rechten van de mens
en de fundamentele vrijheden’ (‘Convention for the Protection of Human
Rights and Fundamental Freedoms’). When we tried to capture this
with regular expressions, they would match too easily, often matching
entire sentences where they should have matched only the law. We
declared these conventions outside the scope of this irst experiment.
Resolving the references was a bit trickier, since sometimes they
used anaphora, e.g. referring to ‘that law’. In such cases, the citation
was resolved by using the previous law identiier if it existed, i.e.
we assume that the complete law was introduced just before in the
text and resolved correctly. We used the same process for resolving
ambiguous title abbreviations; e.g. ‘WAV’ is an abbreviation of ‘Wet
Arbeid Vreemdelingen’ (law on labour for immigrants), ‘Wet Ammoniak en
Veehouderij’ (law on ammonia and livestock) and ‘Wet Ambulancevervoer’
(law on ambulance transport). Most of the time the full title is used
before the abbreviation is used.
Another issue is determining the exact version of the law the
case refers to. Typically, a judge will refer to the version that is in force
at the moment of the decision, but it may also be the version that was
in force at the time of the relevant facts, or even sometimes an earlier
version of the relevant law, etc. We cannot decide which version is the
correct one without interpreting the content of the case. Therefore we
decided to resolve the reference to the ‘work’ level of the source of law,
i.e. no particular version.207 The resulting references are added to the
XML of the case law document. The inal network of the 13,311 case

documents has 85,639 links to legislation (on average 6.5 references per
case); the links connect the ECLI identiier208 of the case with the BWB
identiier of the (part of) law it refers to.
We evaluated the resolving process by checking 250 random
ones by hand. Of these, 234 should have been resolved since the other
16 were outside of the scope of this experiment. 198 were resolved
correctly (a recall of 85%). We had 10 ‘false’ positives, i.e. references
that were declared out of scope, so a precision of 95%. The results were
good enough to continue. Since case decisions may refer to the same
source of law, e.g. an article, more than once, we count the number of
references and compute the weight of the link between the case and
the article as: W= 1/n where n is the amount of occurrences of a certain
reference and W is the weight of the edge. The lower the weight, the
stronger the impact on the network is.

scores. Now we can determine the n most similar documents for any
focus document. We chose to only take into account the focus documents
that have at least four outgoing references for now, this because of the
relatively low recall of the parser. If a focus document has only one
outgoing reference, the bag-of- references similarity scores will be
either 0.0 or 1.0; this may be acceptable in a later stage with a superior
reference parser, but at this stage these extreme scores are too uncertain.

evaluations. The evaluators were given ive randomly selected cases for
which they ranked three suggestions from best to worst, and for which
they stated whether any of the three suggestions is good enough for a
recommender system. One of the three suggestions was most similar
according to the method using a topic model, another was the most
relevant based on the references to legislation according to Winkels
et al. (2014) and one of the suggestions was based on a combination
of the two methods. For the combination of the two methods, a list
of the top 200 suggestions according to the topic model was obtained
(for each randomly selected case), and also a list of the top ten suggestions
according to the references to legislation. The irst suggestion from the
top ten list that appeared in the other list of the top 200 suggestions,
was chosen as the suggestion based on both methods. The evaluators
were unaware of which suggestion was obtained by which method.
5.4 Conclusions
We described results of research that is part of the OpenLaws.
eu project. Ultimate aim is to deliver a platform for using, sharing and
enriching big open legal data. Besides ofering users the opportunity to
collect, organize and annotate legal data, we also want to ofer automatic
suggestions based on analysis of existing data. In the future that may
also be based on user-generated data. Users of OpenLaws can already
annotate sources of law, highlight sections or phrases, group sources
together in folders and link a source to other sources. In the future, this
data can be analysed as well to improve suggestions for other users.
For now the recommendations are based on the analysis of oicial
sources of law. We have presented irst results for available data in the
Netherlands. Based on analysis of the network of both legislation and
case law, we ofer users suggestions for interesting material based on
their current focus document.
We have shown that it works quite well to automatically ind
and resolve references to legislation in Dutch case law. The parser was
perhaps a bit over-ited for the immigration domain, since it performed
less well in the tax domain. It can easily be improved, but we will have
to check whether this has repercussions for the immigration domain
and how it performs in other legal ields. The prototype system will
perform much beter when running on a proper server. We also did not
exploit the network of case law itself this time. In Winkels et al. (2011) we
showed that this can be used to estimate the authority of cases, so if we
include this the suggestions of relevant case law should be improved.
The network of references can be used to provide users of the
legislative portal with relevant judicial decisions given their current
focus and moreover, suggest additional relevant legislative sources.
Another next step is adding legal commentaries and doctrine to the
network and possibly parliamentary data.
When compared with suggestions of case law based on similarity
of the actual text of the judgements, whether seen as just ‘bags of
words’ or as a mixture of ‘topics’, users seem to prefer those over
the suggestions based on network analysis or similarity in reference
structures. We still have the intuition that similarity in reference
structure indicates some common feature of cases, but perhaps it is too
abstract for users. In our irst experiment we treated the references as
an unordered set; perhaps we should retain the order and try again.

1.1 Introdução
O presente artigo objetiva analisar a relação entre a inovação
tecnológica característica da quarta revolução industrial e seus relexos
no âmbito das ciências jurídicas. O fenômeno pode ser analisado por
duas perspectivas. A primeira vertente –, foco do presente estudo –,
diz respeito à forma como o direito se relaciona com as dinâmicas
disruptivas que vêm impactando os diversos setores econômicos. Já
a segunda, trata da forma como este fenômeno se relaciona com o
impacto que a tecnologia exerce no âmbito do exercício proissional
das carreiras jurídicas.1
Em obra recente, Paul Mason expressa que quase sem ser
notados, territórios inteiros de vida econômica estão começando a se
mover num ritmo diferente. O autor destaca a proliferação das moedas
paralelas, de bancos de tempo, de coletivos e espaços autogeridos.
Além disso, notam-se novas formas de propriedade, novas formas de
empréstimo e novos contratos legais: toda uma subcultura de negócios

Este talvez seja um dos grandes desaios dos Estados neste início
de século XXI – criar mecanismos normativos de estímulo para que
mentes e capital sejam atraídos para a formação de modelagens que vão
melhorar a vida de seus cidadãos, sem que isso implique gasto público.
O que estamos a defender é que ao menor sinal de possibilidade de
nova dinâmica, o Estado rapidamente debata as vantagens, balize da
maneira menos intervencionista o modelo, e garanta que as validações
entre mercado e startups serão respeitadas pelo Estado. Isso ganha
especial importância no momento em que se compreende que os países,
enquanto ainda existentes barreiras soberanas, estão em disputa entre
si por tal atração.
Trata-se de um mundo em concorrência, em que os avanços
tecnológicos parecem inevitáveis, e em que o sistema legal passa a ser
um vetor relevante a ser analisado para o estabelecimento das empresas.
A vantagem de ser pioneiro nos usos destas novas dinâmicas está no
potencial de criar centros de pesquisa, plantas industriais e estar passos
à frente de outras nações que não tenham normas de fomento.
Para ilustrar o ponto, cabe tratar dos carros autônomos, ou seja,
automóveis conduzidos sem motoristas. A questão que se coloca é: se
a população de um país acredita majoritariamente que tais veículos
serão uma realidade nos próximos anos, por consequência lógica essa
nação deveria se preocupar em regular a prática da maneira mais célere
possível.
Enquanto players como Google, Uber e Tesla investem pesado
para transformar a icção cientíica em realidade, contando já com
a tecnologia pronta para início de testes em grande escala, todos os
países no mundo terão as mesmas condições de criarem ambientes
férteis para atração da operação de tais empresas. Motoristas serão os
futuros ascensoristas de elevador, proissão fadada ao esquecimento,
e é importante que as sociedades compreendam esse fenômeno.
Se o carro autônomo efetivamente se concretizar como realidade
nos próximos anos, o que vamos vivenciar é uma revolução completa
na indústria automobilística. Uma revolução silenciosa mundial já vem
ocorrendo com os carros elétricos. Em que pese a crítica dos céticos, no
âmbito da Tesla, Elon Musk acertou em cheio. As viagens civis rumo
ao planeta vermelho justiicadamente ensejam maiores dúvidas, muito
embora diversos investidores qualiicados apostem nisso.9

Google se espalha com uma velocidade cada vez mais intensa por
diferentes segmentos da economia. Trata-se muitas vezes de demanda
do mercado e dos próprios colaboradores, o que implica constatar que
o direito do trabalho precisa se adequar, sob pena de ser compreendido
como razão de atraso social – perspectiva já compartilhada por alguns
setores econômicos especíicos.
Um aspecto de natureza geracional, abordado de forma breve
anteriormente, diz respeito às principais características da geração Y,
millenials, ou ainda geração on demand, que já se encontra plenamente
inserida no mercado de trabalho, e ao longo dos próximos anos gal-
gará passos acelerados rumo às lideranças do setor público e privado.
Aspectos como o desejo de valorização do reconhecimento nas insti-
tuições, a diiculdade em vivenciar dinâmicas hierarquicamente estra-
tiicadas e o anseio por compatibilizar vida proissional e pessoal são
apenas alguns dos elementos que movem esta nova geração de indi-
víduos. A própria tecnologia, que integra diversos momentos da vida
pessoal e proissional, rompe com a barreira estanque que tradicio-
nalmente separava trabalho e tempo livre.
Outro aspecto a ser analisado diz respeito à utilização das plata-
formas como forma de exploração econômica. As modelagens deno-
minadas de marketplace, B2B, B2C, O2O, entre outras, ensejam uma nova
realidade. As novas aplicações tecnológicas oportunizam a estruturação
de diversos micronegócios. Estamos caminhando a passos largos para
uma nova realidade que, sob a perspectiva marxista, pode ser carac-
terizada como a ditadura da pequena burguesia. Momento em que a
dita exploração do trabalho, em diversos segmentos, parece sucum-
bir às modelagens de parceria entre empresas, ou entre indivíduos e
empresas.
A ausência de vínculo empregatício é uma marca das novas
dinâmicas, cabendo um próprio questionamento a respeito da existência
ou não de relação de trabalho. A zona cinzenta que se coloca entre uma
relação eminentemente civil e trabalhista é o que enseja a relexão de que
uma nova categoria, que aqui deinimos como direito do colaborador,
se insere. Parece relevante que haja uma proteção para ambos os lados,
empresas e indivíduos que se relacionam em dinâmicas de B2B, B2C,
O2O ou marketplace. No entanto, o que existe hoje do ponto de vista
normativo parece não ser adequado, implicando necessárias e urgentes
mudanças.

2.1 Introdução
O desenvolvimento tecnológico e a inovação têm o condão
não somente de transformar os meios de produção econômica, mas
também – e sobretudo – de alterar profundamente o meio social, seja na
divisão do trabalho, seja nas percepções do indivíduo sobre o mundo.
Ao tratar da divisão do trabalho social, Durkheim12 já propugnava que
o progresso não seria meramente efeito do tédio, mas antes de tudo o
resultado da complexiicação da sociedade, consistindo a inovação em
meio para a sobrevivência das diversas formas de vida que são próprias
da modernidade. Como qualquer outra transformação, diicilmente a
inovação tecnológica seria aceita sem qualquer animosidade.
Os estudiosos da Revolução Industrial dos séculos XVII e XVIII
indicam que suas maiores consequências foram sociais, na medida
em que a transição para a nova economia criou miséria e desconten-
tamento, levando empresários e burgueses empedernidos à falência e
produzindo, entre trabalhadores, revolta que os conduziu a reagir à
