AUTO DE INFRAO: Ato administrativo que d cincia ao infrator da disposio

legal infringida e da penalidade aplicada.
Conforme estabelece a legislao vigente, o autuado tem o prazo de 20 (vinte) dias, a
contar da data de recebimento do Auto de Infrao, para recolher a multa arbitrada ou
apresentar defesa escrita, acompanhada das provas que julgar necessrias, sob pena de
revelia.
O pagamento da multa no isenta o infrator de cumprir as obrigaes necessrias para
sanar as irregularidades que deram origem infrao e aquelas de outra natureza
previstas na legislao vigente.
As defesas devero ser dirigidas ao rgo fiscalizador competente.

INFRACTION WARNING: Administrative act that warns the responsible of the legal
provision that was infringed and the penalty imposed.
As established by current legislation, the responsible has a period of twenty (20) days
from the infraction deed receipt date, to collect the arbitrated fine or submit written
defense, accompanied by the evidence that are necessary, under penalty of default.
The payment of the fine does not exempt the responsible to fulfill the necessary
obligations to remedy the deficiencies that led to the warning and those otherwise
provided by law.
Defenses should be addressed to the competent supervisory body.

AUTO DE EMBARGO: Ato administrativo de interrupo na execuo de obra em

desacordo com a legislao vigente, que pode se dar de forma parcial ou total.
O no cumprimento ao embargo caracteriza crime de desobedincia capitulado no artigo
330 do Cdigo Penal Brasileiro.
Ser embargada imediatamente a obra quando a irregularidade identificada no permitir
a alterao do projeto arquitetnico para adequao a legislao vigente e a consequente
regularizao da obra.
O descumprimento do embargo ou da interdio torna o infrator incurso em multa
cumulativa, calculada em dobro sobre a multa originria.
Caso se verifique a continuidade da obra aps o embargo, o responsvel pela
fiscalizao requisitar os equipamentos e materiais necessrios para proceder a
demolio da parte acrescida.
A obra embargada somente poder ter continuidade depois de sanadas as irregularidades
que deram origem ao embargo.

EMBARGO ACT: Administrative act that interrupts works in construction sites that
violate current legislation; can occur in partial or total form.
Failure to comply with the embargo features is classified as disobedience, capitulated in
Article 330 of the Brazilian Penal Code.
The construction site will be immediately stopped (banned) when the identified
irregularity does not allow changing the architectural design to suit the current
legislation and the subsequent regularization of the work.
Failure to comply with the ban forces the responsible to pay cumulative fines,
calculated twice as much as the original fine.
In the event of the continuation of work after the embargo, the responsible for
monitoring the construction sites will require the necessary equipment and materials to
carry out the demolition of the increased section of the construction site.
The embargoed construction site can only be continued after the deficiencies which led
to the embargo are fixed.

AUTO DE INTERDIO: Determinao administrativa de impedimento de acesso a

obra ou a edificao que apresente descumprimento de embargo ou situao de
iminente, que pode se dar de forma parcial ou total.
O no cumprimento interdio caracteriza crime de desobedincia capitulado no artigo
330 do Cdigo Penal Brasileiro e torna o infrator incurso em multa cumulativa,
calculada em dobro sobre a multa originria.

PROHIBITION ACT: Administrative determination of denying access to work or

building that presents embargo breach or impending situation that can occur in partial or
total form.
Failure to comply with the prohibition features is classified as disobedience capitulated
in Article 330 of the Brazilian Penal Code and makes the responsible convicted of
cumulative fines, calculated twice as much as the original fine.

INTIMAO DEMOLITRIA: A demolio total ou parcial da obra ser imposta ao

infrator quando se tratar de construo em desacordo com a legislao e no for passvel
de alterao do projeto arquitetnico para adequao a legislao vigente.
O infrator ser comunicado a efetuar a demolio no prazo de at trinta dias, exceto
quando a construo ocorrer em rea pblica, na qual cabe ao imediata.
Caso o infrator no proceda a demolio no prazo estipulado, esta ser executada pela
Administrao Regional em at quinze dias, sob pena de responsabilidade, sendo o
valor dos servios efetuados cobrados do infrator. Na hiptese de no pagamento, o
valor ser inscrito na dvida ativa.

DEMOLITION NOTIFICATION: The total or partial demolition of the construction

site will be imposed on the responsible in the case of construction that violates the law
and is not possible to change the architectural design for compliance with current
legislation.
The responsible shall be informed to make the demolition within thirty days, except
when construction occurs in a public area in which action is immediate.
If the responsible fails to demolish within the stipulated time, the demolition will be
performed by the Regional Administration within fifteen days, under penalty of
responsibility, and the value of the performed works are charged to the responsible. In
the event of non-payment, the amount will be entered in the direct debt of the
responsible.
