Criticismo jurídico

Unidimensionalismo normativo do Direito

Para Kant:
◈ Kant tinha como ideia central de que todo o conhecimento
se inicia com a experiência, mas também existe o
conhecimento que vem da razão com seus instrumentos,
como a experiência com os fatos da realidade empírica;

◈ No criticismo jurídico, Miguel Reale destacou três principais nomes
de autores importantes dessa corrente de pensamento, que são:
⬥ Rudolf Stammler (1856-1938): Filósofo alemão, conferiu à
ciência do Direito atribuindo-lhe metodologicamente os
instrumentos dos “fins e dos meios contrapostos” aos “de causa e
efeito” das ciências naturais;

◈ Seu ponto de partida é a consciência, não como entidade
psicológica, mas como atitude do homem perante a si
mesmo e a realidade na qual situa-se;
◈ Em seus dizeres:
“A sociedade humana não se desenvolve em uma vida
econômica por si e numa existência jurídica como algo em
separado: ordem jurídica e ordem econômica são
necessariamente um e o mesmo”

⬥ Giorgio Del Vecchio: (1878-1970): Aceita o Direito Natural
porém sem distar das influências kantianas, de viés racionalistas,
que sobressaltam principalmente nos aspectos lógicos e
gnosiológicos;

◈ Utilizou a gnosiologia criticista como base para
desenvolver suas ideias filosófico-jurídicas, seus alicerces
são os três trabalhos componentes da Trilogia: “I
presupposti filosofici della nozione del diritto, Il concetto
del diritto e Il concetto della natura e il principio del
diritto”.

⬥ Hans Kelsen : Em seu pensamento atribui à ciência jurídica
método e objetos próprios, suficientes para vencer confusões
metodológicas e conferir autonomia científica aos juristas;

◈ Obra: Teoria Pura do Direito;
◈ Nas palavras de Kelsen: “a inevitável pluralidade de
significações, de modo que possam fornecer o maior grau
possível de segurança jurídica”.
