RESUMO
ABSTRACT
This paper aims to analyze, from the perspective of Civil-Constitutional Law, the
existence of new methods - also called rituals - of conflict resolution, specifically with
regard to the realization of the right to access to justice. The main purpose of the
research will be to analyze the new alternative means of pacification of litigation -
specifically the institutes of Mediation and Conciliation -, their scope, as well as their
efficiency in facilitating and expanding the access to justice in society, allowing a
larger space for parties are heard and actively and effectively participate in building
the best solution to their own conflicts. The methodology applied in the present study
was deductive, in view of conducting doctrinal research, in addition to the use of
scientific articles, books and current national legislation. Finally, it will be possible to
conclude from this study that access to justice should be treated as one of the most
basic and fundamental rights of society and that full access to it should be
increasingly facilitated through the help of new alternative dispute resolution.

1. O ACESSO À JUSTIÇA
Os doutrinadores complementam:
Art. 8º. Toda pessoa tem direito de ser ouvida, com as garantias e
dentro de um prazo razoável, por um juiz ou tribunal competente,
independente e imparcial, estabelecido anteriormente por lei, na
apuração de qualquer acusação penal contra ela, ou para que se
determinem seus direitos ou obrigações de natureza civil, trabalhista,
fiscal ou de qualquer natureza. (TORRES, 2002, on-line)
(...) difundir a mensagem de que todo homem, independente de raça, credo, condição econômica,
posição política ou social, tem o direito de ser ouvido por um tribunal independente e imparcial, na
defesa de seu patrimônio ou liberdade. (BULOS, 2007, p. 482)
Ainda, necessário destacar que o acesso à justiça tem por objetivo concretizar
os direitos garantidos ao cidadão pela ordem jurídica. Nesse aspecto, segue o
posicionamento de Wilson Alves de Souza:

Por sua vez, a Mediação é um instrumento pelo qual uma terceira pessoa,
neutra e imparcial, auxilia na facilitação do diálogo entre as partes, a fim de que seja
construída – com autonomia e solidariedade, a melhor solução para o conflito.

3. CONSIDERAÇÕES FINAIS
Ademais, os novos rituais de pacificação de litígio não estão surgindo para subtrair
ou reduzir a competência do Judiciário, pelo contrário, são técnicas que auxiliam,
somam e incrementam o trabalho desempenhado pelo Poder Judiciário. Por fim, os
novos instrumentos de resolução de conflitos surgem para promover a cidadania,
através da plena e efetiva concretização de direitos e, principalmente, o
fortalecimento da cultura dos Direitos Humanos, através do acesso à justiça para
todos.
