b. Opiniões consultivas
Artigo 96, § 1, Carta
A Assembleia Geral ou o Conselho de Segurança poderá solicitar parecer consultivo da Corte Internacional de Justiça, sobre qualquer questão de ordem
jurídica.
Outros órgãos das Nações Unidas e entidades especializadas, que forem em qualquer época devidamente autorizados pela Assembleia Geral, poderão também
solicitar pareceres consultivos da Corte sobre questões jurídicas surgidas dentro da esfera de suas atividades.
2. Israel e palestinos

⇒ Quais são as consequências jurídicas advindas da construção do muro que Israel, Potência Ocupante, está
construindo no Território Palestino Ocupado, incluindo o interior e os arredores de Jerusalém Oriental, tal como
descrito no relatório do Secretário-Geral, considerando-se as regras e os princípios do direito internacional,
notadamente a Quarta Convenção de Genebra de 1949, e as resoluções do Conselho de Segurança e a Assembleia
Geral sobre a questão?
A Corte poderá emitir pareceres consultivos sobre qualquer questão jurídica, sob solicitação de qualquer
organismo autorizado para isso por Carta das Nações, ou de acordo com as disposições da mesma.
Outros órgãos das Nações Unidas e entidades especializadas, que forem em qualquer época devidamente
autorizados pela Assembleia Geral, poderão também solicitar pareceres consultivos da Corte sobre questões
jurídicas surgidas dentro da esfera de suas atividades.

A Assembleia Geral poderá discutir quaisquer questões ou assuntos que estiverem
dentro das finalidades da presente Carta ...
- trata-se de uma solicitação de parecer consultivo e não de uma recomendação da AG sobre uma disputa ou situação
- Artigo 24, Carta: o CS tem RESPONSABILIDADE PRIMÁRIA sobre a manutenção da paz e a segurança internacionais
Interpretação inicial – se uma questão relativa à manutenção da paz e da segurança internacionais estivesse na agenda
do CS, a AG NÃO deveria fazer recomendações sobre essa questão
if the Security Council, because of lack of unanimity of the permanent members, fails to exercise its primary
responsibility for the maintenance of international peace and security in any case where there appears to be a threat
to the peace, breach of the peace, or act of aggression, the General Assembly shall consider the matter immediately
with a view to making appropriate recommendations to Members for collective measures. . . .
A CIJ conclui que a AG não contrariou o sentido do Artigo 12 – não excedeu à
sua competência
- em 2003, o CS não aprovou uma resolução sobre a construção do muro por Israel
nos Territórios Palestinos Ocupados por causa de um voto negativo de um P5 (EUA).
A solicitação não versa sobre uma questão de “natureza legal”, no sentido do Artigo 96, parágrafo 1, Carta,
e do Artigo 65, parágrafo 1, Estatuto
⇒ A CIJ observa
If the General Assembly requests the Court to state the “legal consequences” arising from the construction
of the wall, the use of these terms necessarily encompasses an assessment of whether that construction is
or is not in breach of certain rules and principles of international law - Quarta Convenção de Genebra
sobre a Proteção de Civis em Tempos de Guerra (1949)
The fact that a legal question also has political aspects, “does not suffice to deprive it of its character as a
‘legal question’ and to ‘deprive the Court of a competence expressly conferred on it by its Statute’, and the
Court cannot refuse to admit the legal character of a question which invites it to discharge an essentially
judicial task”.
⇒Israel alega que
The Court should decline to exercise its jurisdiction because of the presence of specific aspects of the General Assembly’s request that
would render the exercise of the Court’s jurisdiction improper and inconsistent with the Court’s judicial function.
⇒A CIJ observa
Article 65, paragraph 1, of its Statute - “The Court may give an advisory opinion . . .” The Court retains a discretionary power to decline to
give an advisory opinion even if the conditions of jurisdiction are met. Given its responsibilities as the “principal judicial organ of the
United Nations” (Article 92 of the Charter), the Court should in principle not decline to give an advisory opinion, and only “compelling
reasons” should lead the Court to do so.
The first argument the Court should not exercise its jurisdiction in the present case because the request concerns a contentious matter
between Israel and Palestine - Israel has not consented to the exercise of that jurisdiction. The Court observes in this respect that the lack
of consent to the Court’s contentious jurisdiction by interested States has no bearing on the Court’s jurisdiction to give an advisory opinion
settlement without its consent. The opinion is requested on a question which is of particularly acute concern to the United Nations, and
one which is located in a much broader frame of reference than a bilateral dispute.
In the light of the foregoing, the Court concludes that it has jurisdiction to give an opinion on the question put to it by the General
Assembly and that there is no compelling reason for it to use its discretionary power not to give that opinion .
